Tree fallen issue
R. Hines explained the large oak tree that is 20’ from the lake is falling and hanging over the neighbor’s property. The neighbor can not use their yard and would like the owner to remove the tree. The tree has been cut down.
M. Briggs did a site visit and saw the rotted tree stump from the cut tree. The only issue is if a tree is taken down it needs to be replaced with another tree of 2.5 caliper size, native species of his choice, and planted in the vicinity of where the original tree was removed. Mr. Briggs told the owner to send the Commission a plot plan of the property indicating where the new tree would be placed. Mr. Briggs thanked the owner for coming to the meeting.

Issue with Maguire Group Billing
Maguire Group paperwork was received by Conservation on Tuesday January 20, 2009. A copy was mailed to Mr. Linder, however he did not receive his papers in time for this meeting. This hearing was continued to the February 4, 2009 meeting.

Moving of Shed
P. Schotanus explained he set up a retaining block wall to place the shed on, which is 25’ from where it originally stands. He is ready to move the shed using 4 x 6’s to slide the shed in place.
M. Briggs told him to contact the office before he moves the shed. The Commission would do a site visit to check this new area as soon as possible. He can then move the shed.

Present: Jesse Nunnemacher, owner
J. Nunnemacher explained the situation of the trees falling too close to the house, and his girlfriend is very allergic to the trees. He would like to replace the trees with other native trees and shrubs for a buffer, in the back and around the side of the property. The species he is looking at are, oaks, cedar, and American hornberry, black choke cherry.
The site was viewed on the Pictometry and showed the present grove of trees.
B. Faneuf summarized his information of this resource area and the wildlife.
J. Nunnemacher told the Commission there are about four trees that are dead. The branches are falling from those trees which are very close to the house.
M. Briggs said the Commission needs a plan showing the re-planting location of the trees and/or shrubs to be planted.
The Bylaw review section #4.5.6 will be done by M. Briggs for the Town Meeting in May.
The Board signed the Determination for 51 Griggs Road/D. Lebel, and the Partial Certificate of Compliance for 22 Cote Lane/L. Legere, and will do a site visit in the spring for this complete Certificate of Compliance. They discussed the 21E review on 85 Dudley Road and the National Grid update for the existing right of way work, and the DEP review for 25 Marsh Road, John Anderson’s project. They signed the Amended Order of Conditions for 9 Maple Street.
