1. Boston Road Pond/Cold Spring Brook/Woodburyville Pond – street runoff into Girard pond -
     M. Briggs questioned if the catch basin dropped silt on the pond.  There is also concern with beavers being there.  The complaint letter, dated 6-12-08 was read.  
M. Brigham replied the silt didn’t come from the catch basin, it was mostly from runoff from Girard pond from 2 years ago.  Highway will make sure the beaver area has been cleaned out, then when the pond gets low enough the silt can be removed with a backhoe.  

2.  129 Hartness Road/52 Leland Hill Road – water runoff issue/yard flooding - There is an issue with runoff water in this area.  The Town needs to maintain the pipe in the road.  M. Brigham replied he spoke with both parties involved.  Here were two different causes for this water.  In 2007 the inlet pipe was blocked and the highway unblocked it.  With all the rainy weather during the winter this area filled up.  Mr. Brigham stated this drainage pipe was in this location before Orchard Estates was built, so it had nothing to do with that subdivision.  This area may have been disturbed when the sewer was repaired.  M. Brigham explained that to fix the problem the highway will dig a leaching area in front of the pipe on Winant’s side.  On Mr. Whitney’s side, Mr. Whitney agreed to do the same thing and put stone around.  This would act as a leaching area and not restrict the flow.  The water flow is minimum and there is no standing water in this area right now.  DPW will put in a sump on the Winant’s side and contact Mr. Whitney to work out details for his side of Hartness Road.  

3. 151 Mendon Road – silt issue in the stream - There is a significant water flow in this area.
    J. Sheehan stated George Kowsik said the highway did some work in that road area.  M. Briggs asked if there is something that the Town can do to change this silting problem, and the runoff going down hill into the stream.
        M. Brigham stated there are 2 12” pipes that cross the road at the low spot, and explained how this could be fixed using a berm and cleaning the catch basins to see if this quick fix would help.

4.  81/85 Griggs Road – road drain issue - The storm drain is already there.  The original drains were put in around the 1960’s.  In August of 2005 the Town rebuilt the catch basin.  Highway cleaned out the storm drain and it appears to be working better.

5. 59 Hartness Road erosion issue - This problem has been solved.

6. 48 Griggs Road area – The storm drains flow into the intermittent stream and are working correctly.
7.  47 Main Street, pooling at top of driveway – this is a State Road.  The owner needs to call Mass Highway.  There are no drainage structures in this area.  

8. Hartness Road Town sewer project – They are doing repairs to the sagging in the existing pipes.  M. Briggs questioned if they have started yet.
M. Brigham said that Conservation would need to check with the Sewer Superintendent on this project.  

9. Blackstone Street – repairs were done by highway.

10. Singletary Ave – five catch basins were put into one catch basin, the work has been finished by the State.

M. Briggs told M. Brigham if highway has an issue and needs to do work near a resource area right a way, the Commission can issue an Emergency Certificate for that work.

        T. Browder told the Commission that this project was not going forward, is on hold and has pulled out of the permitting process with the Planning Board.  The applicant Taurus, request, that the fees be returned.  

M. Briggs replied that the balance of the unused portion of the funds could be returned.

Torrey Road & Manchaug Road Town of Sutton

The Public Hearing was opened at 8:05pm.  M. Briggs read the hearing notice as it appeared in the Millbury Sutton Chronicle.
       The project consists of a resource area improvement project funded by a Mass DEP/EPA s.319 Nonpoint Source Pollution Grant.  The project includes the construction of several stormwater BMPs, focused on improving the water quality of Manchaug Pond.
Present:  Stephanie Hanson, CEI, Mark Brigham, Sutton Highway Department.
        S. Hanson said the purpose of this is to help the water quality of Manchaug Pond.  
        M. Brigham and S. Hanson both reviewed the five locations proposed around the pond, and two catch basins in the boat ramp.  He explained that the pipe will stay in place and there would be fill put around the basins.  There are also two locations in Douglas.  
The amount of the grant is $129,000 to do this work.

The project consists of moving an existing shed that was not permitted, 25’ forward from the current location.

P. Schotanus asked for approval from the site visit discussion on July 26, 2008.

M. Briggs stated the area was not staked out for the site visit, however it was measured off where the shed should be.  Mr. Briggs stated rollers or skids could be used to roll the building forward and put back on footings or sauna tubes.  He stated that this building must be off the ground, a building permit needs to be approved, and the original site must be re-vegetated.

66 Wilderness Road

The continuation was opened at 9:10pm.  M. Briggs read the hearing notice as it appeared in the Millbury Sutton Chronicle.
The project consists of construction of a new single family house, new accessory lake building and their associated grading and utilities, repair and raise existing retaining wall 18 inches along lake front.
Present: Mark Allen, Allen Engineering, Alice Webb, Wetland Scientist, Henry Lane, Attorney for Michael Dunne, owner, Scott Goddard, Wetland Scientist.
        M. Allen reviewed the information from the site visit and the changes from the last meeting.  A handout was given to the Board.  He reviewed the 4.5-acre parcel and the highlighted areas on the existing conditions.   Mr. Allen stated that Alice Webb did a tree study on the 37 trees to 42 trees to be replaced, along with all the plants that comply with the Conservation’s regulations.   Hay bale check dams along the driveway during construction, detailed alternative analysis, separating the two structures and critter openings were discussed.  Everything has been approved by the ZBA, but they don’t have the Board of Health approval yet.  
  • Webb reviewed her revised plans for the plantings, adding additional 5 trees of native species.
S. Goddard, wetland scientist gave his review of this site, as to how this project applies to the
bylaws, according to his letter sent to the Commission.

M. Briggs suggested they go to the Board of Health then come back to the Commission after their septic has been approved.  

J. Sheehan stated that if the Commission does issue the Order they would issue it subject to the Board of Health approval.

B. Faneuf reviewed his report using multiple sheets for different parts of the project that were reviewed with Mr. Allen.
