The Public Hearing was opened at 7:05pm. M. Briggs read the hearing notice as it appeared in the Millbury Sutton Chronicle.
The project consists of constructing a 155,595 s.f. home improvement store, 7,000 s.f. restaurant, 3,830 s.f. fast food restaurant with drive through, and accessory retail, a portion with drive through, totaling 68,220 s.f. on Route 146, and offsite roadway improvements along Route 146 and Boston Road.
Present: Kevin Rabbitt, K.B. Rabbitt Association, Program Manager, Arthur Allen, Eco Tec, Paul Hutnak, Heritage Design Group, Keith McDonald, Chief Engineer for Roadway Improvements.
K. Rabbitt reviewed the past history from the last meeting in September 2007. He explained the newly revised plans without the soccer fields. They have an Order of Conditions for this project. They have also proceeded into the MEPA process and they received the FEIR certificate and sewer connection permit from DEP. They are meeting with the Maguire Group and the Planning Board, on Friday August 22, 2008 at 10:00am to review letters and comments.
P. Hutnak explained about the soccer fields that were removed from the plans. However, they didn’t decrease the wetland replication area. There was a reconfiguration of the buildings. Mr. Hutnak explained the Route 146 and Boston Road roadway improvements, which will be reviewed by the Maguire Group also. They will be doing some lighting. It’s not possible to treat all the runoff water specifically where it’s generating. What they have done is compensatory treatment of that water. They are proposing bringing it along a section of Boston Road and bring the runoff into the large catch basin in the back. They will bring two area catch basins from Route 146 that are not being treated now, to the catch basin
in the back. He reviewed the analysis for this area. They will end up with 25 acres of impervious area, not treated now but will be after this proposed work has been done.
K. McDonald reviewed the Route 146 and Boston Road Roadway improvement. This will also be reviewed by Maguire Group.
A. Allen explained the Determination that was approved that the up steam is not perennial. He said they are filing two separate projects within the same site. They would like to have two separate Order of Conditions permits, one for the retail development and one for the residential development.

The project consists of construction of a new single family house, new accessory lake building and their associated grading and utilities, repair and raise existing retaining wall 18 inches along the lake front.
Present: Mark Allen, Allen Engineering, Scott Goddard, Carr Research Wetland Scientist, Alice Webb, Earth Designs Landscaper, Henry Lane, Applicant’s Attorney, Teresa Wood, Certified Shorthand Reporter (Stenographer), Michael Dunne, owner.
H. Lane gave an update from the last meeting.
S. Goddard said there has been few plan changes from the last hearing. He presented a short report dated 08-18-08, including his resume. Included in the report were issues pertaining to significance wildlife habitat on this site. Although this is a wooded upland site adjacent to Lake Singletary the State has decided there are no important wildlife habitat features on the site, so there are no significant adverse impacts present on the site. The report also included alternative analysis, functions and values of the Bylaw, and flood control.
A. Webb reviewed the changes that were made on the plans showing the saving of four trees along the property lines, and will pull back the grades from the property line. Groups of shrubs were added along the property line near the lake. A rain garden will also be installed using ten different native species, shrubs, and herbaceous materials, green ferns, hardy flowing plants, and blueberries, which are not a rain garden plant but will be placed around the site in several areas. There are a total of 562 plants proposed, 19 types of native species and 12 types of cultivar native plants. Ms. Webb reviewed a table showing the placements of the above-mentioned plants.
M. Dunn stated they are putting the plants in because he wants to put the plants in, and for the record they have never proposed anything that doesn’t follow the DEP guidelines or the Conservation guidelines.
M. Allen reviewed the two sheets previously submitted. On sheet on modifications were made to the existing trees, the pine trees were mislabeled. Mr. Allen reviewed the other sheet showing the saving of the four trees, rain garden, the swale, infiltration system, and gazebo.
M. Briggs requested a spec sheet from the manufacturer of the proposed dock that would be installed, for the record.
M. Dunn replied the dock would be plastic with four aluminum posts driven in, and would get the spec sheet for the record.
M. Briggs questioned the added gazebo, and if there is going to be electricity or plumbing in the gazebo. The spec sheet is also needed for the records.
M. Dunn replied this was something they had decided to do later as an addition, but need to wait for the ZBA’s vote.
M. Briggs stated there was a concern about access to the property.
M. Dunn replied there are easements from the two neighbors.

The Commission was satisfied with the information and was able to make their decision.

Main Street & Route 146/National Grid

The project consists of site work associated with the construction of two building additions, and a separate 60,000s.f. building. The proposed building/additions are outside of the 100-ft. buffer zone.

P. Hutnak reviewed the newly revised plans on the outdoor gravel storage area. These plans will be submitted to Conservation by the end of the week. The addition would be in Sutton. A fire lane was added per the Fire Chief. There would be an outdoor gravel storage area. The new revised set of plans would be finished at the end of the week and they would get the copies to the Commission.

The project consists of demolition of existing residence, and construction of a proposed commercial retail facility and associated parking, landscaping, stormwater controls, and utilities.

P. Hutnak reviewed the information from the site visit and the existing conditions, where there is no runoff from this site existing. They would like to put a 3500-foot building on the site within the buffer zone. The have gone to ZBA for the variance to build the building. There will be three porous pavement areas, shown on the plans, per the DEP standards that would allow water to run through it. This site will have Town sewer and water.

Review Order of Conditions
65 Stone School Road

Present: Robert Murphy, Murphy & Associates, Francis Venincasa, owner, Mike …. Custom Homes, builder.
R. Murphy would like to ask for an extension for the previous Order of Conditions, but explained that the Order of Conditions has expired. He stated that the bonds were not done and the project was not done either. Mr. Murphy showed the Board the plans, showing that these plans have not changed from the original plans submitted with the first Notice of Intent. Nothing would change.
B. Faneuf said he would check on the extension of an Order of Conditions after expiration, but he thinks they would have to re-file.
The Board suggested that the applicant re-file a Notice of Intent. They will do another site visit to review the original site plans.
BOARD BUSINESS
The Board signed an Extension for an Order of Conditions for 160 Worcester Providence Turnpike, Sutton Plaza Shopping Center Expansion.
All other discussions were continued to the September 3, 2008 meeting.
The Commission will do a site visit on August 23, 2008 starting at 9:00am.
Minutes
The Board did not vote on the minutes of June 18, 2008, July 16, 2008, and August 6, 2008. This was tabled to the next meeting, September 3, 2008.
