J. Teachout reviewed the information from the previous site visit.
M. Briggs stated the stone wall area needs to be stabilized so it won’t tip over onto the cleared area. They need to give the Conservation a plan, for the record, showing the fixing of the wall.
J. Teachout replied the wall would be fixed with either riprap or earthen material, and she would get the revised plan to the Conservation.

The Public Hearing was opened at 7:10pm. M. Briggs read the hearing notice as it appeared in the Millbury Sutton Chronicle.
The project consists of building a 10 x 16’ tool shed by hand, placed on cement blocks. No hazardous materials would be stored in shed.
Present: Thomas Jakubiak, owner
T. Jakubiak reviewed the information shown on the plans, the construction of the pre-built shed, and the two 6” trees to be taken down and replaced.
M. Briggs stated the replaced trees need to be 2.5 caliper when replanted.

The Public Hearing was opened at 7:25pm. M. Briggs read the hearing notice as it appeared in the Millbury Sutton Chronicle.
The purpose of this hearing is to review a Request for Determination of Applicability submitted to the Conservation Commission by Michael & Deborah Stewart, Sutton, MA. The existing house needs to be serviced by a new well. The current well is within 100’ of an abutting septic system and its own septic system.

M. Allen reviewed the previous information stating that the former owners installed a septic system upgrade. On the previous plan a well was to be installed. However, the well was not installed and the three trees that were to be re-planted, according to the original Order of Conditions never were planted. The well was shifted about six feet so that no other trees would need to be cut down. Six trees are to be re-planted and are shown on the new revised plans for the well.
M. Briggs reviewed the old Order of Conditions activity, which is now stabilized with no breakouts. He would like to see a few trees put on the back side for shade for the steam.

M. Briggs said to get a revised plan then a Determination could be issued. Once the work was done the Commission would review it.
It was suggested to put sump pump in and a hay bale line to the corner of the house.
A Request for a Certificate of Compliance is needed for the records, to close out the old Order of Conditions.

The project consists of single family house, septic system, well, etc.
Present: Robert Murphy, Murphy Associates, Francis Venincasa, owner
R. Murphy explained about this new Notice of Intent filed by Mr. Venincasa. Since the other Order of Conditions, which is now four years old, has expired. The site had been started by Don Hamelin but was not completed by the expiration date of the Order of Conditions issued. A new Notice of Intent was filed by the new owner, Mr. Venincasa. The original plans were submitted with this new notice because the proposed design will not change. The well and driveway was installed a few years ago. The existing town stone headwall and pipe under the roadway appear to be collapsing. The only work subject to the Wetlands Protection Act is the slope on the downhill side of the septic system. The house, driveway, and well are all
outside of the buffer zone.
J. Sheehan stated that was not correct because the runoff and channel are directly connected and are not working correctly.
R. Murphy replied the amount of flow from the pipe at times is horrendous because it is dug up where the rocks are. It needs to be strengthened.
The Board will do a site visit on November 8, 2008 at 9:00am.

Water runoff issue

R. Murphy reviewed the current Order of Conditions, and what work has been done in the driveway. The hay bales are in place. There is subsurface water going through the area and with the machines going through, he told Mike McGovern to put three additional hay bale dikes. They will be in tomorrow. There was a temporary detention pond made for the water flow.
M. Briggs state there should be an emergency supply of hay bales on the site.
Abutter:
Janice Moore, 55 Stone School Road, is concerned with the water coming over her property, and driveway.
The Board will do a site visit on November 8, 2008 at 9:30am.

The page 9 error was fixed and would be forwarded for everyone’s records.
The Board signed an Order of Conditions for 172 Manchaug Road and signed the Determination for 13 W. Sutton Road.
The Board did not sign a Certificate of Compliance for 26 Irma Jones Road as this is incomplete.
These complaints were discussed: 15 Southwick Road /Doug Lebel, and 5R Jamieson Court.
Note: This years MACC Conference will be on February 28, 2009.
