Chairman Hebert calls the meeting to order at 7:00 pm followed by the Pledge of Allegiance.

Selectman Stuart motions to approve as presented June 4, 2013 meeting minutes, Selectman Hall seconds passes 4-0

Strategic Building Solutions re: Middle School/High School project: present is School Building Committee Chair Wendy Meade and project managers from SBS Jon Winikur and Tim Alix. Wendy Meade says they are here to give an overview of the overall project. Although they are excited with the quality of the project and that it is under budget, the deadline dates have not been met. The original deadline for completion of the middle school was 4/1/13, when that was not met the time schedule was reinvented to 5/1/13 and then again to 6/1/13. Still not complete they have been given a date of the end of July, beginning of August. 2 weeks ago in an Executive Session, the School Building Committee voted a Lack of Confidence vote with TLT (general contractor) regarding meeting deadlines. The issue has been brought to the MSBA’s attention. SBS Jon Winikur stated that it was a critical issue missing the deadline of 4/1 at that point they decided to leave classes in place and not take occupancy until summer so to not disrupt the kids education. Selectman Chizy feels SBS and the School Building Committee are doing a great job, the State should step in more forcefully seeing as they are funding part of the project. What is complete, is beautiful, it is not SBS or the School Building Committees fault. Mr. Winikur responds that the State does watch over these projects carefully but they leave it to the local discretion for the contractor knowing there are a lot of eyes on site every day. Selectman Stuart begins by saying it is important to delineate SBS from TLT. SBS and Wendy Meade are top notch and have done a fantastic job. This reflects on TLT. At some point, MSBA must say to the contractor, you are off the list of approved contractors.  Mr. Winikur states that the process begins at local level by prequalifying the contractor to be chosen with reference checks. TLT passed the reference checks. Selectman Stuart says in speaking with Superintendent Ted Friend, September is crucial. So far we have filed for liquidated damages, what is the next step. Wendy Meade replies that at some point this will end up in litigation. Selectman Hall thanks them for the update and keeping the BOS in the loop. Obviously the time concerns are important but this building will be around for a long time, Dave is concerned with the quality of the work, this is our legacy we need to insure that quality is being adhered to. Jon Winikur states that it is very important to have the architectural team, the engineers and the town officials on site working full time watching the work that is going on. Jon goes on to say as frustrating as TLT is with the delays, the sub contractors are actually quite good. Chairman Hebert thanks them for coming in, we put a lot of confidence in our project managers, the deadline issues are the fault of TLT but where are the checks and balances here, this isn’t the 1st school TLT is doing the state should step in and make them more accountable.

Appointment Renewals:  Clerk of the BOS Dave Hall reads as listed the reappointments, Selectman Chizy places a hold on the 2 reappointments to the Conservation Commission as well as one reappointment on the Zoning Board of Appeals.  TA Smith reads his reappointments at this time. Hearing no questions, Selectman Chizy motions to appoint all appointees that were not placed on hold, Selectman Stuart seconds passes 4-0

IMA for Animal Control Officer Services: TA Smith reviews with the BOS this is for a contract with Millbury and Sutton for Dan Chauvin. Issues had been addressed such as a backup person and an auto allowance. Jim states that Selectman Hall called earlier to ask about Millbury’s share of Medicare taxes and retirement contributions. That has been addressed and added into the contract.  Hearing no concerns, Selectman Hall motions to approve the IMA for Animal Control Officer Services with the Town of Millbury as presented, Selectman Stuart seconds passes 4-0.

TA Update:
  • Goals & Objectives meeting scheduled for July 30th 6pm at Blackstone National
  • MRA Sport to hold triathlon at Marions Camp this Friday (June 21st, Police and Fire will have boats on the water
Chairman Hebert states that Singletary Lake Boat Ramp is closed to boaters, will this affect the triathlon? TA Smith replies that he spoke to Dave Divateli with MA Fish and game; he does not feel it would be an issue with the Police and Fire Dept on the water for this event.
  • Employee Appreciation cookout was Friday June 7th. Thank you to the employees for a successful year.

Announcements:
        Selectman Hall reads the Eagle Scout notice of Anthony Fattman

Round Table:
        Selectman Chizy says the Food Pantry is in great need of food. Kids will be out of school and therefore eating another meal at home.
        Selectman Stuart commends all parties involved with the use of Marion’s camp for the triathlon. Alex please be respectful of the neighbors and clean up when done.
        Selectman Hall thanks Jim for holding the Employee Appreciation luncheon.
        Chairman Hebert commends the Chief of Police and his dept. for stopping an attempted armed robbery last Thursday.
