        7:00 p.m. – January 26, 2010
Sutton Town Hall, Selectmen’s Meeting Room
Members in Attendance:                           
John Hebert, Chairman; Richard Hersom, Vice-Chair; Members Michael Chizy and Ryan Fattman

Also in Attendance:     James Smith, Town Administrator; Debbie Jacques, Administrative Secretary

Chairman Hebert calls the meeting to order at 7:00 followed by the Pledge of Allegiance.

Selectman Fattman motions to approve January 26, 2010 minutes as presented, Selectman Chizy seconds passes 3-0-1 (Selectman Hersom abstains as he was not present at 1/5/10 meeting).  
Selectman Fattman motions to approve but not to be released at this time, Selectman Chizy seconds passes 3-0-1(see above)

Appointment and swearing in of Police Officer Jeffrey Simakauskas: TA Smith introduces Officer Simakauskas as a recent graduate of the State Police Academy.  Selectman Chizy questions if this is a new position or filling of a vacancy. TA Smith replies that it is filling a vacancy due to a priority in Public Safety. Selectman Hersom motions to ratify the Town Administrators appointment of Mr. Jeffrey Simakauskas to the position of full time police office, Selectman Chizy seconds passes 4-0.  At this time Town Clerk Laura Caruso swears in Officer Simakauskas, Chief Towle pins the new officer.  Chief Towle says that he will be a nice fit to the department. Officer Simakauskas thanks the board, his family and friends at this time.

Acceptance of deeds for Quabbin Path: This is a road that has been voted on at Town Meeting and accepted as a town road. Planning Director Jen Hager informs BOS that this is one of Dana Gravisons projects. She goes on to say that there is a partial certificate of compliance due to the newly manicured retention basin. There has been $3000.00 set aside in the event additional loam and seed is needed. Selectman Fattman motions to accept the Quabbin Path Deeds on behalf of the Town, pursuant to the October 19th Town Meeting authorizing vote, Selectman Hersom seconds passes 4-0

Town Administrator Update:
  • Budget- Governor spoke at MMA Conference proposing level funding for local aid and Chapter 70. TA Smith will be presenting the draft budget to the BOS on February 16th, 2010.
  • Solar Grant & RFP- letter of support from Congressman Neal was sent in support of the solar grant. Solar bids opened on January 13th, out of the 7 submittals, 6 were responsive. They are being reviewed at this time.
  • Shaw Plan- received proposal form Gates Leighton to draft a plan for Shaw Farm.
  • Conflict of Interest Law- reminder to BOS that per changes of the law, acknowledgement of the Law summary and on line test must be taken by April 2010.

        Selectman Chizy- Food Pantry still in need of donated items.\
        Selectman Fattman- Welcomes new officer to town.
        Selectman Hebert- will be attending the CMMPO  meeting on Wednesday, February 3, 2010.




Selectman Chizy motions to enter into Executive Session under MGL Chapter 39,  § 23B, #3 To discuss strategy with respect to collective bargaining or litigation with the sole purpose of re entering the public meeting for sole purpose of adjourning, Selectman Hersom seconds passes 4-0
