ZONING BOARD OF ADJUSTMENT
SUNAPEE, NH
      
August 10, 2006

MEMBERS PRESENT: CHAIRMAN  PETER URBACH, VICE CHAIRMAN JAMES LYONS,  ALTERNATES : ALEX KISH , SVEND FILBY AND HARRY GAZELLE.

Don Weatherson, Richard Guyer and Robert Henry were absent.

The meeting was called to order at 7:00 P.M. by Chairman Peter Urbach.

Alex Kish was voting in place of Don Weatherson. Harry Gazelle was voting for Richard Guyer and  Svend Filby was voting for Robert Henry.

COMMUNICATIONS:     The Board was reminded of the summer Town  Meeting that will be held on August 15 at the High School.
The members were also reminded of the Fall Law Lecture Series .


PLANNING BOARD REPORT:  The Bell Engineering Inc. Map # 203. Lot #7 for a two lot sub-division was continued to September 7th.
A merger of Lot # 63 & # 11-5D. Map # 235 was approved for Pierre Cameron , Jr. Real Estate Limited.
An application to change the name of property usage of Map  #133 . Lot # 93 to Soo-Nipi Realty Trust, Real Estate Office was approved.
Proposed subdivison and site-plan amendments were handed to members. Comments are due by September 21st.
The problems of excessive water and silt problems at the Self Storage Unit Project were discussed.

MINUTES:   The minutes of July 13 were reviewed.  There was one correction. On page 2, concerning Case # 06-32,  The new  boundary line adjustment will be 14.5’ from the existing building instead of the previous 5’ boundary line. Harry Gazelle made a motion to approve the minutes of July 13 as corrected. James Lyons seconded the motion. There were five yes votes.

PUBLIC HEARING:   Case # 06-36. Richard Osborne. Map # 226. Lot # 30. Seeking a Special Exception. Art. IV. 4:10. as required under ZBA Regulations , for a boat storage and marina facility. 284 Rt. 11. Sunapee. Richard Osborne and Arthur Osborne presented the case. The property is in a Rural Residential Zone. There are about 35 acres. 6 acres are out of current use. There is an existing building. The existing trailor will be used for storage. They also have storage in Newport. Teresa Boel asked if there would be excessive noise. The applicant did not think there would be a lot of noise.

Some work would be done in Newport. Richard asked if there would be an problem later on when he wants to build a house within the six acres. The Board did not feel there would be a problem. The Public part of the hearing was closed. James  Lyons felt that the definition of a marina should be revised. James Lyons made a motion to approve the request of Richard Osborne. Case # 06-36. Map # 226. Lot # 30. for a Special Exception. Art. IV. 4:10 for a boat storage and marina facility at 284 Rt. 11. Sunapee. Harry Gazelle seconded the motion. There were five yes votes.

Sharon Knapp asked to speak to the Board concerning the problem on Cory Road in Sunapee. Originally a garage was approved and then living space was added. Stone walls were built. There is excessive use of parking facilities. She feels betrayed  of what has been constructed. She has spoken with Roger Landry concerning the problems. She wants something done about violations. The Board will contact  Roger. Mrs. Knapp wants to be present when it comes before the Board.

Carl Berntsen asked to be heard. He says that he has all of his paper work . including the State approval for crossing Wetlands and wants his case to be heard. The Board voted to hear the case on August 22nd.

A motion was made to adjourn the meeting at 7:45 P.M. Harry Gazelle seconded the motion. All members were in favor.
