ZONING BOARD OF ADJUSTMENT
SUNAPEE, NH

                                                         January 11, 2007.

MEMBERS PRESENT: CHAIRMAN  PETER URBACH, VICE CHAIRMAN, JAMES LYONS, RICHARD GUYER, ALEX  KISH, AND  ALTERNATE:, SVEND FILBY,.

Robert Henry , Harry Gazelle and Roger Landry were absent..  Svend Filby  is taking the place of Robert Henry.  

The meeting was called to order at 7:05 P.M.

MINUTES: The minutes of December 14, 2006 were reviewed. Richard Guyer made a motion to approve the minutes as printed. James Lyons seconded the motion. All members present were in favor.

There were no communications or Planning Board Report.

PUBLIC HEARING :   Case # 07-1. Round Rock Properties, Inc.Map # 132. Lot # 17.
Requesting a Use Variance. from Art. IV. 4:10 in a Residential Zone to accommodate a restaurant operation at an existing commercial facility. 474 Rt. 11. Sunapee. This facility is located at the former Sunapee Community Store and owned by James Cruise. The case was presented by Charles Hirshberg. There were 10 prior seats. The owner wants to increase the seating inside to 31 seats. There is also a plan to have outdoor seating. There is a drilled well on the property. The sewer system is tied into the Lower Village Line.
Richard Guyer asked about the former marina. There will be no boats on the property. The former plan was not finally approved.
There was concern about the plan to have the gas pumps. The State has been  involved with the former pumps because of some leakage. There are four monitoring wells and one across the road. The sampling is being continued. The Selectmen have “ grandfathered ” the  future gas pumps. The monitoring will be continued until there is safe drinking water. The State is paying for the monitoring process.
The requested Use Variance is to expand  the eating facility. Svend Filby asked if the parking lot will be repaved and  grading done. There is a plan to do that work.
The Board went over the requirements of the Variance. There was some discussion concerning the fact that the proposed project is in the Residential Zone and across the road is the Village Zone.
The Public part of the hearing closed at 7: 45 P.M. James Lyons made a motion to approve the request of Round Rock Properties, Inc. Case # 07-1. Map # 132. Lot # 17 for a Use Variance. from Art. IV. 4:10 to accommodate a restaurant operation at an existing commercial facility as per plan presented and it will not be a drive-in restaurant. The grant will also be subject to the plan as submitted, pending any changes that may be made by the Planning Board. 474 Rt. 11. Sunapee.

Alex Kish seconded the motion. There were five yes votes.

The meeting adjourned at 7: 55 P.M.
