SUNAPEE BOARD OF SELECTMEN
MEETING
7:00 PM Town Office Meeting Room
Monday, January 11, 2010

Present: Stephen White Chairman, William Roach Vice-Chairman, Charlotte Brown, Frederick Gallup, Emma Smith, Donna Nashawaty, Town Manager

Also Present: Katie Richardson Intertown Record, Van Webb, Chief David Cahill, Sergeant Cobb, Peter Urbach, Rem Mastin, Representative Suzanne Gottling  

Chairman White called the meeting to order at 7:00PM.

Van Webb-Chairman of the Conservation Commission
Van Webb presented the Board with a warrant article regarding the following 4 parcels of town-owned property, located around Ledge Pond:

  • Tax Map 206, Lot 7, also known as the Town Forest at Ledge Pond on Meadow Brook Road, having approximately 79 acres.
  • Tax Map 206, Lot 8, also known as the buffer lot to the Town Forest on the shore of Ledge Pond, having approximately 4.6 acres.
  • Tax Map 207, Lot 27 and Tax Map 207, Lot 28, also known as the remote buffer lot at Ledge Pond having approximately 8.42 acres.
  • Tax Map 105, Lot 21, also known as the Gore Lot on Keyes Road, having approximately 1.1 acres.
The Conservation Commission will like the Board of Selectmen to covey a conservation easement to the Ausbon Sargent Land Preservation Trust. Donna Nashawaty spoke with the town’s attorney who made a slight change to the wording on the warrant article. According to Van Webb, this is the first attempt to propose a conservation easement on town property and the Conservation Commission thought it would be valuable to find out the town’s thoughts or concerns on the matter. Van Webb explained that you need approval at town meeting to put an easement on town forest, but the 3 other parcels could fall under RSA 41:14A  Acquisition or Sale of Land, Buildings, or Both. –

If adopted in accordance with RSA 41:14-c, the selectmen shall have the authority to acquire or sell land, buildings, or both; provided, however, they shall first submit any such proposed acquisition or sale to the planning board and to the conservation commission for review and recommendation by those bodies, where a board or commission or both, exist. After the selectmen receive the recommendation of the planning board and the conservation commission, where a board or commission or both exist, they shall hold 2 public hearings at least 10 but not more than 14 days apart on the proposed acquisition or sale; provided, however, upon the written petition of 50 registered voters presented to the selectmen, prior to the selectmen's vote, according to the provisions of RSA 39:3, the proposed acquisition or sale shall be inserted as an article in the warrant for the town meeting. The selectmen's vote shall take place no sooner then 7 days nor later than 14 days after the second public hearing which is held.

II. The provisions of this section shall not apply to the sale of and the selectmen shall have no authority to sell:
~~~~~~ (a) Town-owned conservation land which is managed and controlled by the conservation commission under the provisions of RSA 36-A.
~~~~~~ (b) Any part of a town forest established under RSA 31:110 and managed under RSA 31:112.
~~~~~~ (c) Any real estate that has been given, devised, or bequeathed to the town for charitable or community purposes except as provided in RSA 498:4-a or RSA 547:3-d.

After much discussion, Selectman Brown asked which parcel is the most important to be protected, is it the town forest? If so, Selectman Brown suggested only putting the town forest on this year as a warrant article. Van Webb agreed with Selectman Brown and proposed that the 3 other parcels would be dealt with under RSA 41:14A later this year. A motion to see if the Town will vote to authorize the Board of Selectman to convey a conservation easement to the Ausbon Sargent Land Preservation Trust on the following  town-owned property to protect the property permanently. •Tax Map 206, Lot 7, also known as the Town Forest at Ledge Pond on Meadow Brook Road, having approximately 79 acres by Selectman Brown to accept as read, seconded by Selectman Gallup. All in Favor.

Town Manager Report
Donna Nashawaty received 2 petition articles today, one for library location and to raise and appropriate $8,000 to construct a ramp at Dewey Beach. More articles can be accepted up until 5:00pm on Tuesday, January 12th.
•Donna Nashawaty went over the requirements of posting a public bond hearing and why the budget and bond hearing had to be moved to January 19th.
•Donna Nashawaty went over printing the deliberative booklet and sending to the property owners prior to the deliberative session. A motion was made to give the town manager permission to take the deliberative booklet to the printing company with information available to date on January 15th Selectman Gallup, seconded by Selectman Roach. All in Favor.
•Donna Nashawaty and the Board listed the 2010 warrant articles by numerical order and motion by the Board to recommend or not.  Roll call vote, unanimously as follows:

Selectmen’s Action
8:12PM-A motion was made by Selectman Roach to go into non-public session to discuss RSA 91-A: 3, II(c) (reputation). The motion was seconded by Selectman Gallup and roll call vote approved unanimously.

8:55PM-The Board returned from non-public session. Roll call vote, unanimously. Motion to seal the minutes. Roll call vote, unanimously

8:57PM-A motion was made by Selectman Gallup to return into non-public session to discuss RSA 91-A: 3, II(c) (reputation). The motion was seconded by Selectman Roach and roll call vote approved unanimously.

9:18PM-The Board returned from non-public session. Roll call vote, unanimously.




Selectman Brown reminded the Board of the School Board Budget Hearing that was on Wednesday, January 13th.
