SUNAPEE BOARD OF SELECTMEN
7:00 PM Town Office Meeting Room

Present: Fred Gallup Chairman, William Roach Vice Chairman, Charlotte Brown, Donna Nashawaty, Town Manager

Also Present: Peter Urbach and Suzanne Gottling

Chairman Gallup opened the meeting at 7:00PM  

Selectmen Action
•Motion to accept the nomination of Barbara Sullivan as an alternate to the Harbor House Livery Committee by Selectman Brown, seconded by Selectman Roach. All in Favor.
•Motion to allow Chairman Gallup to sign the use of facilities application submitted by the Sullivan County UNH Cooperative to use the Safety Services Building on February 2nd by Selectman Brown, seconded by Selectman Roach. All in Favor.
•The use of facilities application submitted by the Sunapee-Dartmouth Region Homebuyer Seminars on May 11th tabled until next meeting.
•The Board signed the MS-6 and Default Budget. The Board also resigned the Town Warrant that had a typo on the one signed at the last meeting.

Chairman Gallup wanted to express his condolences to the Sullivan Family, who lost their mother, Eva Sullivan, when a small plane crashed into their RV while vacationing in South Carolina last week.

Town Manager Report
Donna Nashawaty was contacted today by the Town Attorney regarding the ongoing bankruptcy issues with Muzzy Brook Properties Management, which is 11 Pleasant Street in Georges Mills. Muzzy Brook Properties has been in bankruptcy for the last 4 years and each time they ask the Town if they will accept lesser amount for the taxes, which the answer has been no. According to Donna Nashawaty, at the final bankruptcy hearing the Court can order a lesser amount that originally owed. The court could rule that instead of the Town receiving 18% interest on the outstanding balance, the court could rule that the Town would only receive 8% interest on the outstanding balance. As it stands right now, the Town has 4 years of property tax liens that include the unpaid water and sewer bills. The taxes for 2010 remain unpaid. In summary there are taxes, water and sewer bills and interest that are due to the Town. The total outstanding as of today is $49, 246. Muzzy Brook Properties would have 5 years to pay off the debt. The Town Attorney works with a Bankruptcy Attorney and in Donna Nashawaty opinion, she feels the Town should have the Bankruptcy Attorney find out what the arguments are in the case that will be going to court on January 31, 2011. Donna Nashawaty wanted to make sure the Board was aware of what was going on in this bankruptcy case.  


Miscellaneous
•Donna Nashawaty asked if anyone on the Board had any ideas for the cover of the Town Report. Donna Nashawaty suggested using a photo of the children running towards the playground equipment at the dedication of the Lynn Peirce Memorial Playground.  
•Donna Nashawaty asked the Board to think about who they would like to dedicate the 2010 Town Report to.
•Donna Nashawaty reminded the Board that their next scheduled meeting was on Monday, February 7th, the same day as the School Deliberative Session. The Board decided to reschedule the meeting to Monday, February 14 and then every 2 weeks after that. If there are any building permits to be signed, the Board can sign on Tuesday, February 8th, the Town Deliberative Session.
