SUNAPEE BOARD OF SELECTMEN
6:30 PM Town Office Meeting Room
Monday, June 4, 2012

Present: Fred Gallup, Shane Hastings, Joshua Trow, Suzanne Gottling and Donna Nashawaty, Town Manager

Chairman Gallup opened the meeting at 6:30PM

The following corrections to the May 21st meeting Selectman Gottling, lewd changed to lieu. Selectman Trow wanted to correct the sentence Chief Ruggles clarified that permits would not be issued with a class 3 rating or higher, changed to permits will not be issued for higher than a class 3 rating.  

Fireworks Public Hearing
Chairman Gallup read a letter to the editor from Minnette Sweeny regarding her opposition to the fireworks ordinance. (See attached) Chairman Gallup takes issue with the insinuation that there are some of us involved in the administration of town that want control and would abuse this ordinance. Chairman Gallup feels that any and all of our ordinances are fairly administrated amongst everyone and that no one stands to benefit from it. Chairman Gallup opened the public hearing at 7:12PM.
Chairman Gallup stated that the Board has refined the ordinance; it seems to be fairly specific as to what can or cannot happen.

Charlotte Brown had the following comments on conditions of the permit- time on permit 11:00PM, under Section III E.-time is 10:00PM.On permit time/date request it should say time/date display. John Augustine asked if the permits would be public knowledge, will he be able to know who has a permit for this specific day and time. Chairman Gallup doesn’t see any reason why they wouldn’t be public knowledge. Chairman Gallup went on to say if John Augustine wanted to stop by the town office on a Friday afternoon the staff could tell him the permits that have been issued. John Augustine suggested that the issued permits be put on the website. Selectman Gottling stated that both the Fire Chief and Police Chief will know who has a permit. Chairman Gallup said the town will look into what is involved in posting the permits on the website. Chief Ruggles stated that Dispatch has the list for issued fire permits, so the town could do the same for fireworks permits. The reporter from WNTK had a question regarding $20 permit fee to cover the administrative costs; is that in addition to the permit fee, which would be $40? Chairman Gallup replied no, the total amount would be $20. Scott Blewitt questioned Article III H three (3) permits per address per calendar year, didn’t know if that would be a difficult one to enforce. Charlotte Brown wanted to know if it would be feasible to list the permits online, it would save a lot of phone calls.  Donna Nashawaty will look into putting on the web. John Augustine asked if the Board would consider a different number of permits for residential properties vs. rental properties. John Augustine feels that the landowner, who rents to different individuals, is going to have to pay fine after fine. Chairman Gallup stated that the landowner would have to take some responsibly by making this part of the rental contract and if it becomes an issue the Board of Selectmen could take it up for review and make changes. Selectman Trow stated that Section III F states that the private owners and the person(s) displaying the fireworks shall be responsible for compliance with this ordinance, which would also apply towards the renter. Donna Nashawaty said that the landowners are already writing a fee for a lost transfer station decal into the rental agreement. For the record, Donna Nashawaty wanted to make it clear that the residents who had sent letters for the first public hearing were reflected in the continuation of hearings on the ordinance. Chairman Gallup said that all the input has been consider all the way thru. Selectman Trow said that on the permit it states the permit is not valid unless approved by the Fire and Police Chief, but in the ordinance it only states the Fire Chief. Donna Nashawaty will remove the Police Chief. John Augustine asked how residents would be notified of the new ordinance. Chairman Gallup stated that it will be on the website and Donna Nashawaty stated that Atlas fireworks said the ordinance would be posted in the store. Motion to approve the fireworks permit and ordinance with the changes discussed with an effective date of June 15th by Selectman Gottling, seconded by Selectman Trow.   3 in Favor 1 Opposed.
Scott Blewitt-Recreation
Scott Blewitt updated the Board on the recreation happenings;
The 2012 Summer Newsletter has been mailed. Two member of the Sunapee Community who has been volunteering as baseball umpires for over ten (10) years, Jeff Trow and Steve Anglin, can’t thank them enough for time. The Veterans Field project is complete. It’s dry and was done on budget. Mark Usko did a fantastic job. Dewey Field received new dugouts that were built by Craig Heino. Dewey Beach is open for the season on Memorial Day weekend. The grills will be installed next week, waiting for approval from the Fire Chief on safe placement. The poison ivy at Dewey Beach will be taken care of next week without chemicals. The skate park has been ordered and purchased. The July 4th parade and fireworks will be held on July 7th. Scott would like to transfer $22,998.78 into the general fund. Motion to transfer $22,998.78 into the general fund, by Selectman Hastings, seconded by Selectman Trow.  All in Favor
Charlotte Brown did not see any activities for the seniors in the 2012 Summer Newsletter and if they were forgotten to remember them for next year since most are Sunapee taxpayers. Scott Blewitt replied that $2000 in his budget is for senior trips and a couple of years where the money was not used up because they didn’t organize as many trips. Scott spoke with the seniors and now the money goes directly into the seniors’ checking account so they can organize the trips.  
Motion to accept the gifts of $500 Deb Pascalano and $500 Stacey Madison and add to the line item in budget to pay for the skate park by Selectman Gottling, seconded by Selectman Hastings. All in Favor
Motion to transfer $9,000 from special rec to general fund to pay the remaining amount of the skate park by Selectman Trow, seconded by Selectman Gottling All in Favor. Chairman Gallup stated that the kids said they wanted to have some ownership as far as helping to raise the money for the skate park and wondered how they were doing. Scott Blewitt replied that the kids definitely had a “hands on” approach when it came to the designing the elements of this park. Scott Blewitt went on to say that part of the $9,000 came from the Turkey Trot. The park fully designed is about $60,000, so the town is getting about half the park so it can be upgraded later. There will be annual fundraisers: Turkey Trot and the bike race, which the kids and parents   will definitely be involved. Chairman Gallup would be interested in keeping updated on how the kids are doing in regards to the fundraising and to somewhat hold their feet to the fire and actually take a little ownership. Scott Blewitt agrees that the kids need to take ownership and stated if the town doesn’t build a park the kids were involved in the kids won’t use it. Scott Blewitt hasn’t talked to the Recreation Committee, but wondered what should be done regarding the wooden elements from the old skate park. In Scott Blewitt’s opinion they certainly have a value and it’s something that could be sold for someone’s backyard or it could be deposed of. Selectman Hastings asked if the parts could be raffled. Scott Blewitt responded and also to be taken away at the new owners expense. Donna Nashawaty asked Scott Blewitt to talk to the Recreation Committee to see if they had any ideas.  
Scott Blewitt had a work day on maintaining the pump track at Tilson Park on Sunday, but was rained out. The day will be rescheduled.

•Motion to allow Chairman Gallup to sign the use of facilities application submitted by LSPA to use Sunapee Harbor for Love Your Lake Day on August 12th  by Selectman Trow, seconded by Selectman Hastings. 3 in Favor. 1 Abstain
•Motion to sign the raffle permit submitted by the Lions Club for the Duck Race on August 4th by Selectman Gottling, seconded Selectman Trow.  3 in Favor. 1 Abstain
•Motion to approve the petition and pole license for Garnet Hill Road by Selectman Trow, seconded by Selectman Hastings. All in Favor

Town Manager Report
Donna Nashawaty wanted to make sure the Board has seen and publicly noticed that the legislature will vote on the constitutional amendment CACR12 this Wednesday and the coalition asks that the towns contact their state lawmakers to make sure they will support this. After some discussion, the Town Manager will send an email to Senator Odell and Representative Bowers. Motion to have the Town Manager send along the Board’s support to Senator Odell and Representative Bowers by Selectman Trow, seconded by Selectman Hastings. 3 in Favor 1 Abstain
Donna Nashawaty had a couple of updates:
The Auditors had been here and are finishing up at their office. We should see an audit report soon.
Sunapee Center/Library Mylar has been resolved and will be recorded tomorrow.
Joint Assessor Hiring Board is process is underway.
The town received letter from Mt. Royal Academy to change road name from Seven Hearths Lane to Mt. Royal Academy. At this time, the Board is not considering any road name changes.  
The Conservation Commission meetings have been left off the town meeting calendar, it has since been resolved.
