Chairman Gallup opened the meeting at 6:30PM

REVIEW OF ITEMS FOR SIGNATURE:

Chairman Gallup opened the public hearing at 7:00PM

Fireworks Ordinance
Chairman Gallup read into the minutes letters from Catherine Bushueff in support of the proposed fireworks ordinance. A letter was also read into the minutes from Stephen Curley opposing the proposed fireworks ordinance.
Public Comments
Chairman Gallup stated it was bought to his attention there was some confusion on when fireworks permit would be issued. On the permit it states permits would not be issued for any day with a class 3 rating or higher, but in Section III-H it states fireworks shall only be discharged on days when the fire danger is class one, two or three. Chief Dan Ruggles clarified that permits would not be issued with a class 3 rating or higher. A number of residents spoke in support of the proposed fireworks ordinance. The main concerns were noise, weather and fire conditions and pollution to the lake. There was much discussion on what days would be permissible without a permit, how many additional permits would be allowed by a property owner in a given year, fireworks ignited within a minimum of 50 feet from any structure, overhead utilities, or woodland. Upon obtaining a permit, the Fire Chief or any police officer of the Town of Sunapee reserves the right to inspect the permitted location. It was determined that the property owner would be responsible for individuals renting their property and the “renters would have to have written permission from the landowner. It was also agreed that that the hour that display must end by would be changed from 11:00PM to 10:00PM. While Chief Cahill supports a fireworks ordinance, Chief Cahill would like to see the Board of Selectmen update the existing noise ordinance to include fireworks ordinance. One resident asked the amount of money the town has spent working on this ordinance. Selectman Gottling said she felt it was the obligation of the Board to review and find a solution to a property owner’s complaint. The question was asked regarding how the town would notify property owners of the new ordinance, the response was it would be put on the website; newspaper ad and representatives from Atlas Fireworks were in attendance and explained they would post the new ordinance in both Newport locations. Donna Nashawaty also explained that part of the notification process is that the first offense is a written warning.

Board Comments
Selectman Gottling in favor of an ordinance that includes permitting with limits on number of permits granted and sensible hours.
Selectman Hastings and Selectman Trow agree with Chief Cahill that we should roll the fireworks ordinance into a larger, updated noise ordinance.
Selectman Smith thought the fireworks ordinance should be separate from the noise ordinance.

Public Comments
Stephen White asked if the work on the intersection of Edgemont Road and High Street was going to be done. Donna Nashawaty stated that Tony Bergeron’s  budget was tight last year because of the damage from Hurricane Irene, but Chairman Gallup said it was still on Tony “to do” list.

Selectmen Action
•Motion to allow Chairman Gallup to sign the amendment to the Abbott Library Purchase & Sales Agreement by Selectman Gottling, seconded by Selectman Smith. All in Favor.
•Chairman Gallup read into the minutes the resignation from Stephen White from the Alternate Waste Committee and Stephen White’s recommendation to disband the Alternate Waste Committee. Motion to disband the Alternate Waste Committee until it might be needed again by Selectman Trow, seconded by Selectman Smith. All in Favor.
•Motion to appoint Tom Mickle & Anne Nilsen to the Alternate Abbott Library Trustees by Selectman Gottling, seconded by Selectman Trow. All in Favor.


•Motion to allow Chairman Gallup to sign the use of facilities application submitted by the Friends of Abbott Library to use the Safety Services Building for the annual pancake breakfast on July 14th by Selectman Gottling, seconded by Selectman Trow. All in Favor.
•Motion to allow Chairman Gallup to sign the use of facilities application submitted by the Gospel Train Singers to use the Gazebo on August 12th by Selectman Trow, seconded Selectman Hastings. All in Favor.
•Motion to approve the additional hours for use of the Georges Mills town beach by the Lake Sunapee Rowing Club by Selectman Trow, seconded by Selectman Gottling. All in Favor.


Town Manager Report
Donna Nashawaty updated the Board on the redistricting lawsuit.
•Donna Nashawaty updated the Board on the monthly summary figures; Tony Bergeron gravel amount has already been spent.
•Motion to give the employees Monday, December 24th as an additional holiday in 2012 by Selectman Smith, seconded by Selectman Gottling. All in Favor.
Donna Nashawaty updated the Board on the Georges Mills pump failure that occurred on Saturday, May 5th.
Donna Nashawaty invited the Board to attend the CPR-First Aid Class that is going to be held on Wednesday, June 6th at 12:30PM at the Safety Services Building.

Chairman Gallup asked the Board in what direction they would like the Town Manager to take regarding the fireworks ordinance. Donna Nashawaty said that she had already emailed Chief Cahill and asked if he would research noise ordinances in other towns. After much discussion, the Board agreed the permissible days would be New Year’s Eve, Memorial Day, July 4th, Labor Day and Christmas. Donna Nashawaty will make the changes for the Board to review at the May 21st meeting.
