Chairman Gallup opened the meeting at 6:30PM.

APPOINTMENTS
7:00PM- Public Hearing-Pole License
Chairman Gallup opened the public hearing at 7:00PM.
Norm Bernaiche gave a brief overview of the 1999 New Hampshire Supreme Court decision, which allowed under the law to tax the use of the municipal right of way. After some discussion, Chairman Gallup closed the public hearing at 7:07PM. The following is the adopted resolution; Pursuant to the provisions of RSA 231:163 and 43:2, the Board of Selectmen held a public hearing on October 28, 2013 to determine if it would be in the best interests of the public good to amend all of the existing pole licenses issued by the Town of Sunapee through October 28, 2013 to include language regarding taxation pursuant to RSA 72:23.
As a result of the public hearing, the Board of Selectmen have found it is in the best interests of the public good to amend these existing pole licenses to include the following language:
In accordance with the requirement of RSA 72:23, I (b), this license is granted to the licensee(s) subject to the condition that the licensee(s) and any other entity using or occupying property of the municipality pursuant to this license shall be responsible for the payment of, and shall pay, all properly assessed real and personal property taxes no later than the due date.
Failure of the licensee(s) to pay duly assessed personal and real property taxes when due shall be cause to terminate this license.
In accordance with the requirements of RSA 72:23, I (b), the licensee(s) hereunder and any other entity using or occupying the property of the municipality pursuant to this license shall be responsible for the payment of, and shall pay, both current and potential real and personal property taxes when due. Furthermore, in accordance with the requirements of RSA 72:23, I (b), the licensee(s) and any other entity using and/or occupying property of the municipality pursuant to this license shall be obligated to pay real and personal property taxes on structures or improvements added by the licensee(s) or any other entity using or occupying the property of the licensor pursuant to this license.
In addition, the Board of Selectmen has found it to be in the best interests of the public good to adopt a revised Pole License form to be used by the Town of Sunapee effective October 29, 2013 that includes the same langue noted above for all future pole licenses to be issued in the Town of Sunapee. Motion that the Board adopts the resolution dated October 28, 2013 on the pole license by Selectman Hastings, seconded by Selectman Trow. Unanimous.

7:10PM-Public Hearing-FEMA Money
Chairman Gallup opened the public hearing at 7:10PM
Donna Nashawaty reported that the Town has received a check for $14,753.12 from FEMA for the March 18 2013 storm. The money will be put towards some of the expenditures occurred from the storm, which are the gravel overages and remainder to drainage. Chairman Gallup closed the public hearing at 7:13PM
Motion to accept the $14,753.12 reimbursement from FEMA money and put most towards the gravel overages and reminder to drainage by Selectman Trow, seconded by Selectman Hastings Unanimous

7:20PM Chief David Cahill
Chief Cahill asked the Board to authorize Chief Cahill to spend up to $2,500 out of the special detail revolving fund for a mobile repeater. With this purchase, all four (4) of the police cars will be equipped, except for the Expedition. The mobile repeater will turn the 5-watt portable on the hip into a 100-watt portable, which can reach the repeater in the police car. Motion to give permission to Chief Cahill to spend up to $2,500 from the special detail fund to buy a mobile repeater by Selectman Hastings, seconded by Selectman Trow. Unanimous

SELECTMEN ACTION
Motion to appoint the following to the Thrift Shop committee; Marian Southall,
Betsy Webb, Marilyn Morse, and Joyce Hill by Selectman Trow, seconded by Selectman Hastings. Unanimous
•Motion to approve the appointment of Rhonda Gurney as an alternate Recreation Committee member by Selectman Hastings, seconded by Selectman Trow. Unanimous.
•Motion to approve the raffle permit for the Harbor Magic silent auction by Selectman Trow, seconded by Selectman Hastings. Unanimous
•Motion to waive the $20 sign permit fee for Abbott Library by Selectman Hastings, seconded by Selectman Trow. Unanimous


PUBLIC COMMENTS    
John Augustine had a question, did not see the current library building on the agenda, and was curious if it was going to be on an upcoming agenda as a discussion on what to do with the building. Chairman Gallup stated that right now the Board is focus on getting the new library building “off the ground.” When it gets closer to completion, the Board will hold discussions regarding future uses for the old library, which will probably be sometime next spring.       

CHAIRMAN’S REPORT
Chairman Gallup has nothing to report, but has one question, it seems like there is a work stoppage on the new library project. Donna Nashawaty stated that originally, the work was to begin about three (3) weeks after signing the contract, but Stevens’ site work had an open window, came in, and took off the top soil, had it screened, returned, and exposed the granite. Donna Nashawaty went on to say, that the first library construction meeting is tomorrow afternoon.      

TOWN MANAGER REPORTS
Donna Nashawaty wanted to thank the Board for coming in to sign the MS-5, which was submitted and hopefully, we will have a tax rate by early next week.
