SUNAPEE BOARD OF SELECTMEN
6:30PM Town Office Meeting Room
Monday, September 30, 2013

Present: Fred Gallup Chairman, Suzanne Gottling, Shane Hastings,
Joshua Trow and Donna Nashawaty, Town Manager
Absent: Emma Smith Vice-Chairman

Chairman Gallup opened the meeting at 6:30PM

Motion to approve the following CZC:

APPOINTMENTS
7:00PM-Representative Linda Tanner
Representative Tanner introduced herself to the Board.

7:15PM-Library Trustees-Construction Manager Contract and Tri-Party Agreement
Donna Nashawaty reviewed the changes made to the draft agreement. After some discussion, the following actions will be taken:
  • Work with Scott Hazelton, Highway director to edit and firm GMP, including bid documents in contract.
  • Send GMP document to Attorney for review
  • Foundation to resolve difference in pledge and guarantee from bank for loan
  • Foundation and Trustees to accept Tri-Partite Agreement during minutes of a proper meeting.
  • Donna to add, “Oversight Committee to review prior to bills submitted for payment.
  • Financial statement from Trustee’s treasurer and Foundation Treasurer for bank balance to be spent for building…including capital reserve amount. Should be separate (foundation and Library trustee’s) not one entity.
  • AIA documents to be change to name Town Manager as owners agent
  • Building permit to be filed
  • Proposed meeting for BOS for Friday October 4 or Monday October 7
7:45PM-Scott Hazelton, Road Agent-Excavation Ordinance
Scott Hazelton reviewed the recommendations to the excavation ordinance that he would like the Board to adopt. Selectman Trow stated that it looked like the recommendations are just clarification to the existing regulations, Scott Hazelton agreed and went on to say
Donna Nashawaty said the Board is not required to hold a public hearing on this statue, but the Board has traditionally had a public hearing on any other ordinance change done in the past. The Board agreed to hold a public hearing on November 12th. Scott Hazelton will also make a few phone calls to local contractors.  

SELECTMEN ACTION
Motion to allow Chairman Gallup to sign the letter to accept the Perkins Pond Bid Recommendation by Selectman Gottling, seconded by Selectman Trow. Unanimous
Motion to sign the raffle permit for Abbott Library Foundation by Selectman Hastings, seconded by Selectman Trow Unanimous
eon Saturday, October 12th and Sunday, October 13th at the Harbor House Livery by Selectman Hastings, seconded by Selectman Trow Unanimous.
•Motion to approve the use of facilities form for the 4th Annual Haunted Harbor Halloween on Saturday, October 26th at Sunapee Harbor by Selectman Trow, seconded by Selectman Hastings. Unanimous

CHAIRMAN’S REPORT
Selectman Gottling was in charge on the subcommittee regarding changing the rafting rules in restricted areas on Lake Winnipesaukee and Lake Sunapee. The vote was 7 to 1 to not change the rule.  

PUBLIC COMMENTS    
John Augustine stated that at the last meeting, the Board approved the Harbor House Livery MOU and Selectman Gottling asked what the amount the Town was obligated given the work Better Future Alliance has done to date and John Augustine was wondering if that amount was going to be discussed. Selectman Gottling said she has not heard anything yet. Selectman Gottling went on to say that her question was if they were keeping track in the event the building was sold. John Augustine then asked if there is a number to date and will that be available at the next meeting. Chairman Gallup asked if the Town Manager would check into that for the next meeting.    


TOWN MANAGER REPORTS
Donna Nashawaty attended the IMCA conference in Boston last week.

8:28PM A motion was made by Selectman Trow go into nonpublic session under RSA 91-A: 3, II (a)-Dismissal, promotion, or setting compensation for public employees. The motion was seconded by Selectman Hastings, and roll call vote approved unanimous.

8:47PM A motion was made to returned from nonpublic session by Selectman Gottling. The motion was seconded by Selectman Trow, and roll call vote approved unanimous.

A motion was made to seal the minutes indefinitely by Selectman Trow, seconded by Selectman Hastings. Unanimous.

Selectman Gottling requested that bridge ordinance be moved to the next meeting.

Meeting adjourned at 8:50PM
