BOARD OF SELECTMEN
February 28, 2006
Present at the meeting that was held at the Stow Town Building were Chairman Edward Perry and Selectmen Stephen Dungan and Janet Wheeler.
Selectmen John Clayton and Carole Makary did not attend.
Also present were Town Administrator William Wrigley and Administrative Assistant Susan Flint Hosier.
Chairman Perry called the meeting to order at 7:00 p.m.
Town Administrator’s Report
Mr. Wrigley asked the Board to vote to permit deficit spending of the Town’s Snow and Ice account. Per Mass General Law, municipalities may, and often do, use deficit spending of the Snow and Ice accounts for necessary winter road treatment, provided the Selectmen and Finance Committee approve it. When winter ends, the account is then balanced. The Board’s vote is described in the following section.
Mr. Wrigley updated the Board on the Cushing property litigation, where the Town’s due diligence period was extended to July 1, in order to complete percolation tests. Oral arguments on motions from both parties were scheduled for March 29 in Land Court.
Regarding the Town Administrator’s budget responsibilities, Mr. Wrigley said his report would be available the week of March 6. He requested the Board to provide its recommendations at its March 14 meeting, after which he would make his recommendations to the Board on March 28.
Deficit Spending for Snow and Ice
Mr. Dungan moved to allow deficit spending of the Snow and Ice account for the remainder of FY06, per MGL C44, s31D, Ms. Wheeler seconded, and all voted in favor.
Road Construction Borrowing
Treasurer-Collector Pam Landry visited the Board to ask for its approval of a 90-day $300,000 state anticipation note for road construction, to be reimbursed with Chapter 90 funds.
Mr. Dungan moved to authorize Ms. Landry to issue the note, Ms. Wheeler seconded, and all voted in favor. The Board then signed the note, which was witnessed by the Town Clerk.
Lottery Receipts as Local Aid
In response to letters from the Kingston Board of Selectmen and the Mass Municipal Association on returning lottery receipts to the municipalities, the Board agreed to send a similar request to Stow’s legislators, which Mr. Dungan agreed to draft.
Snow Plow Petition for Trefry Lane
The Board denied a petition for the Town to plow Trefry Lane, now a private way, based on recommendations from the Planning Board and the Superintendent of Streets. Mr. Dungan moved to deny the petition to plow Trefry Lane, per the Town’s policy, until the street is accepted by the Town or until the conditions change, based on the list of uncompleted work from the Planning Board. Ms. Wheeler seconded and all voted in favor.
Approve Minutes
January 10: Mr. Dungan moved to accept the minutes as amended; Ms. Wheeler seconded, and all voted in favor.
February 7: Mr. Dungan moved to approve the minutes as amended and Mr. Perry seconded. Mr. Dungan and Mr. Perry voted in favor; Ms. Wheeler, who had not attended, abstained.
February 14: Mr. Dungan moved to accept the minutes as written, Ms. Wheeler seconded, and all voted in favor.
February 15: Mr. Dungan moved to accept the minutes, as written; Ms. Wheeler seconded, and all voted in favor.
Before the meeting adjourned, Ms. Makary stated that she had received a phone message from the State Ethics Commission and asked if any of the other Board members had received one also. No one said that they had.
The meeting adjourned at 7:50 pm.
