LACAC Meeting Minutes for September 5, 2012
The Meeting was called to order at 7:35pm

Members present: Len Golder, Lisa Lavina, Bob Glorioso.   

Also present: Anne Van Tine, Stow TV Coordinator, Bob Mong, and Lew Halprin

Lavina moved and Glorioso seconded to accept the minutes of the June 5 meeting.  This was unanimously approved.

VanTne reported that Comcast had accepted most of Stow’s recent counter offers including paying Capital Equipment funding of $83,333 over a 4-year period. She reported that Attorney Bill August recommended removing Section 11.2 “Liquidated Damages” since it could have the effect of limiting damage payments.  Lavina moved and Glorioso seconded to remove the section.  Approved on a 2-1 vote.

Discussion took place about Section 6.8. Comcast prefers the term “Passive Coax Fiber Network.”  Attendees discussed whether this term is accurate. Comcast is reluctant to use any language that implies support for data.  Attendees indicated that they were willing for this discussion with Comcast to continue.

Up to $10,000 for attorney fees had previously been approved for the calendar year.  VanTine  recommended increasing authorization for up to $16,000.  Golder so moved and Lavina seconded.  Approved Unanimously.

VanTine reported that a Stow resident and candidate for state senate had requested cablecast of a video which VanTine felt was edging on political advertising.  The candidate did not debate but was just interviewed by one member of a partisan organization.  VanTine indicated she would suggest to candidate not to air this event, but to cablecast a more balanced debate later.  Members informally agreed that VanTine was acting correctly.

The group reviewed comments from Lew Halprin with these agreements:
  • Not to pursue further getting HD signal
  • Not to pursue Section 4.12 system maps
  • Not to pursue 6.2 ability to take over Bolton channel
  • 6.2 open but language Comcast proposes is standard
  • 6.3 That the contract description regarding ongoing payments is adequate but that Halprin’s detailed payment schedule should be kept for reference.
  • Attorney August is checking how percents are handled when split across a quarter.
  • 7.1 That the language is based on the law and we cannot adjust it
  • 11.2, to remove this section on Liquidated Damages
  • 12.1 that had already agreed Comcast office does not need to be in Hudson.
  • 12.14 That Stow will not be able to obtain viewer information since Comcast will not disclose it to any station.
VanTine distributed copies of legal notices for the Sept 19 public hearing.  Notices will run in the Stow Independent and Beacon Villager.  She also described preparations for the hearing.  The hearing intend is to get input from residents.

Lavina moved and Golder seconded to adjourn at 8:50 pm. The motion passed unanimously.
