August 16, 2011

A meeting of the Stow Conservation Commission was held at the Stow Town Building, 380 Great Road, Stow, Massachusetts, on August 16, 2011 at 7:30 in the evening.

The Conservation Commission meeting was called to order at 7:30 PM.

Approve Minutes

Kathy Sferra made a motion to approve the minutes of July 19, 2011 as drafted and amended. Helen Castles seconded the motion and it was passed unanimously

Ingeborg Hegemann Clark made a motion to approve the minutes of August 2, 2011 as drafted. Kathy Sferra seconded the motion and it was passed unanimously.

Application & Municipal Certification
Taylor Road CR

Kathy Sferra reviewed the application for the Conservation Restriction for the open space portion of the subdivision on Taylor Road being built by Habitech, Inc.  Pat Perry was instructed to send the revised document to Habitech’s attorney for a final review before sending to EOEEA for review.

Declaration of Open Space Restriction/Highgrove Estates

The document was to be signed and sent to the Commission for signatures.  The Commission agreed not to object to any portions of the properties located in Acton being free of any deed restrictions.  The Commission did not receive the document. No action was taken.

Request for Determination of Applicability
Hiley Brook Road Culvert & Marboro Road Culvert

At 8:10 Rebecca Mattison opened the public hearing without testimony due to the absence of the applicant for replacement/repair of the culverts on Hiley Brook Road and Marlboro Road and agreed to continue the public hearing to September 6, 2011.  

Ingeborg Hegemann Clark made a motion to continue the public hearing regarding culvert repairs on Hiley Brook Road and Marlboro Road to September 6, 2011 at a time to be determined. Kathy Sferra seconded the motion and it was passed unanimously.

Enforcement Order (OOC #299-0514)
277 Sudbury Road (U-3 #19)

The Enforcement Order requested that Mr. Shimmel appear before the Commission at this meeting and provide evidence of slope stabilization. The homeowners, Christopher and Dana Barrile, appeared as well.  

Mr. Barrile showed pictures of the slope that appeared to be partially covered with weeds. The Commission explained that if they do not put a seed mix down, invasive plants would take over. Shimmel agreed to plant the remainder of the bushes and seed the area with a mix specified by the Commission. The homeowners agreed to water the seed and plants after installation. The homeowners agreed to rake out the silt that had accumulated at the silt fence.  The Commission is to be notified when the work is completed for a final inspection prior to the issuance of a Certificate of Compliance.  

C.W. Fuels/Community Convenience (#299-0334 & 0528)
626 Great Road (R-10 #41)

A fine of $300 was approved at the Commission’s June 21, 2011 meeting. Proprietor, David Lorden, did not pay this fine or contact the Conservation Commission office to schedule a meeting with the Commission on September 20th to discuss getting the site into compliance.  The unpaid violation will be sent to Concord Court by the Stow Police Department.  

The Commission agreed to issue an Enforcement Order and another $300 fine. As a means of communication, the manager of the convenience store will be sent a copy of the new violation by a Stow Police Officer. A deadline of September 6, 2011 was issued for Lorden to respond to the Commission to arrange for a meeting.

Kathy Sferra made a motion to issue an Enforcement Order and a $300 fine to David Lorden.  Helen Castles seconded the motion and it was passed unanimously.  

Restoration Project (#299-0536)
11 Hale Road (U-5 #32A-1)

Ingeborg Hegemann Clark visited the site recently after project completion. She suggested that man-size stones be placed at the corners of the channel. She instructed Kent Seith, homeowner, to seed the driveway that goes to the beach and granted permission for the silt curtain to be removed.

Center School Building Site Update

On Friday, August 12th Ingeborg Hegemann Clark conducted a site inspection at the school building site to view the stream prior to restoration work.  In attendance was Glenn Davis, representing the school, Jeff Triosi, representing PJ Stella, and Rich Cordiero, representing Cincotta.  The stream was still dry.  Rich Cordiero suggested that the gravel and sands in the streambed be raked out by hand.  Hegemann Clark agreed and will go back and inspect the stream when the work has been done.  While on the site, she pointed out to them the areas of visible bank as the base condition the stream should be returned to.  She also asked about the old well.  No decision has been made as to its closure.

While on the site, Hegemann Clark asked to see the current SWPPP reports.  She had previously spoken with Joe Stella of Stella Construction and reminded Jeff Triosi that the Commission would like to receive SWPPP reports in a timelier manner.

Hegemann Clark thanked Jeff Triosi for sending one report on the clean up of the first spill site.  However, she had requested information regarding the second spill site at the entrance gate off Hartley Road and asked Jeff Triosi about it.  He indicated he was not familiar with it and Hegemann Clark said she would continue to talk to Joe Stella about it.  Joe Stella had indicated that he believed that because of the small size of the spill, no additional reporting was necessary.  The area where the second spill occurred is next to (and east of) an area being used as a wheel-wash area for trucks exiting the site.

Hegemann Clark accompanied workers to the top of the new septic system. Glenn Davis pointed out that the long swale west of the septic system had no check dams.  Glenn has recommended that check dams be installed to reduce the velocity and erosivity of stormwater.  Hegemann Clark agreed.

Doug Moffat made a motion to adjourn the meeting at 8:35 PM. Ingeborg Hegemann Clark seconded the motion and it was passed unanimously.

The Commission adjourned at 8:35 PM.
