The following are motions made during the September 4, 2014 Regular Meeting.
Chairperson Kupchunos called the public hearing to order at 7:32 pm in the Madden Room.
The Recording Secretary read the legal notice as published in the Journal Inquirer.
Public Hearing
Appl. 2777-14 – Barbara A. Francis-Fulop - request for an 11.3 foot variance to Table 3.1.2A to allow construction of a garage 8.7 feet from the side yard property line (20 feet required), on property located at 981 Pleasant Valley Road, RR Residential Zone.
Peter DeMallie, Design Professionals, represented the applicant. Mrs. Francis-Fulop was also in attendance. Mr. Demallie stated the reasons for the variance request included: the property is an undersized lot; there is poor drainage in the back yard; need to replace the garage & shed due to extensive deterioration because of the drainage issue; the variance is just for the expansion of the new garage (approximately 68 sq ft); driveway & vehicle orientation are a factor; preserve backyard; proximity to deck; size of garage expansion to the rear; re-grading of backyard for garage expansion will correct existing poor drainage condition; house and garage predate current zoning requirements; new garage and removal of shed will help enhance property - will look better, preserve property values, has no impact on
neighbors other than to improve the view.
Commissioner Kilburn asked if there will be re-grading of the back yard to a higher elevation to improve the drainage issue. Mrs. Fulop and Mr. DeMallie stated that there would free draining material placed under garage along with the use of footing drains. There will be some change to the grade to eliminate the drainage problem, but the change will be minimal.
Chair Kupchunos asked if there is a drainage easement on property. Mr. DeMallie said that was unknown at this time. If not, it will to drain to street.
