ZONING BOARD OF APPEALS


Minutes                     1                          July 10, 2014

The following are motions made during the July 10, 2014 Regular Meeting.

Chairperson Kupchunos called the public hearing to order at 8:03 pm in the Madden Room.

The Recording Secretary read the legal notice as published in the Journal Inquirer into the record.

Public Hearing  

Appl. 2776-14 – Pietro and Lori Cerone - request for a 12 foot variance to Table 3.1.2A to allow construction of an addition 38 feet from the front property line (50 feet required), on property located at 26 Brewster Road, A-30 Residential Zone.

Mr. and Mrs. Cerone presented their application.  The addition is for an in-law apartment for Mrs. Cerone’s parents.  The size and location of the addition is to accommodate health and safety issues and concerns associated with Mrs. Cerone’s father.  Building the addition at an angle to the existing house is to provide continuity as a single family residence.  Building the addition in a straight line would make the completed structure look like a duplex.  The Cerone’s stated the hardship is the irregularly shaped lot and the in-ground swimming pool in the rear, which does not allow an addition to the back of the house.  Mr. Cerone stated that their neighbors had no issue with the proposed addition.  Mr. Cerone stated that the large pine tree in the front yard, along with the placement of the addition at an angle, will decrease the visibility of the addition from the street.  Mr. Cerone offered to provide photos of similar homes in town and additional plans for their proposed addition.

The Cerone’s builder, John Jacques, explained that the angle feature improves the appearance and offered to provide photos to compare the look of houses with in-line additions versus angled additions.

The Commissioners would have liked to discuss the design in more depth with the architect and the Cerone’s had hoped the architect would be available, but the architect was not at the meeting.  There were concerns about the size of the addition and the appearance of a duplex style structure.  Based on the information available, the consensus of the majority of the Commission was that a re-design of the addition could be done so that a variance would not be required and that there was no hardship associated with the land.  From a different perspective, two Commissioners felt the shape of the lot and unavailability of the rear of the property should be considered and that the size of the addition is to accommodate the needs of the parents.

Motion to: close the public hearing on Appl. #2776-14 at 9:30 pm

Chair declared a 5 minute recess at 9:32 pm; meeting resumed at 9:37 pm

Deliberative Session

Appl. 2776-14 – Pietro and Lori Cerone - request for a 12 foot variance to Table 3.1.2A to allow construction of an addition 38 feet from the front property line (50 feet required), on property located at 26 Brewster Road, A-30 Residential Zone.
Commissioner Etter and Commissioner Kilburn agreed that there is no compelling land feature associated with the property to interpret as a hardship that would prohibit an addition and still meet the setback regulations.  A rework of the design could be done that would not require a variance.

Motion to: deny Appl. 2776-14 due to lack of hardship

Vote:  3 yea: Dickey-Gaignat, Etter, Kilburn; 2 nay:  Kennedy, Kupchunos

Old Business

Submission of Proposed Revisions to By-laws – Commission Etter stated that he would have recommendations distributed to Commissioners in August for review at the September meeting.
