ZONING BOARD OF APPEALS

Minutes                     1                          February 6, 2014

MEMBERS PRESENT:        James Kupchunos, Teri Dickey-Gaignat, Steven Carty, Joseph Kennedy

ALTERNATES PRESENT:     Edwina Futtner, sitting for Joseph Etter

The following are motions made during the February 6, 2014 Regular Meeting.

Vice Chairperson Kupchunos called the public hearing to order at 7:32 pm in the Madden Room.

The Recording Secretary read the legal notice as published in the Journal Inquirer into the record.

Public Hearing  

Appl. 2772-14 – Michael Giannamore - request for two variances to allow for the reconstruction and expansion of a non-conforming carriage shed: 1) variance to Section 2.14.C.1 for the expansion of a non-conforming structure to include a small addition within the side yard setback (approximately 22 square feet); and 2) a variance to Section 2.14.C.2 to allow an increase in the cubicle content of the non-conforming structure to create living space on the second floor of the carriage house, on property located at 852 Main Street, A-40 zone.

Mrs. Sabine Giannamore presented information in support of the application.  Mrs. Giannamore provided a letter of support from abutting neighbor Tim Shepard, stating that the J.E. Shepard Co. has no objection to the proposed plans.  Mrs. Giannamore stated that the carriage shed needed to be rebuilt due to its deteriorating condition and would be rebuilt as a two car garage with space above for storage or other use.  A photo was provided showing the type of structure the Giannamore’s are considering.  The height of the new structure would not be any taller than the existing house nor any wider than the building is now.  The driveway will access the garage from the north.  The property is not in the Historic District.

The Commissioners determined they had enough information from the applicant.

Organizational Meeting

Election of Officers – postponed due to lack of five regular members in attendance

Review of by-laws – Vice Chair Kupchunos stated that Commissioner Etter indicated he had recommendations for a revision of the by-laws, but Commissioner Etter was not in attendance.  Commissioners were instructed to provide recommendations to recording secretary.

Deliberative Session

Motion to:  approve Appl. 2772-14 – Michael Giannamore - request for two variances to allow for the reconstruction and expansion of a non-conforming carriage shed: 1) variance to Section 2.14.C.1 for the expansion of a non-conforming structure to include a small addition within the side yard setback (approximately 22 square feet); and 2) a variance to Section 2.14.C.2 to allow an increase in the cubicle content of the non-conforming structure to create living space on the second floor of the carriage house, on property located at 852 Main Street, A-40 zone, with the following conditions:  1. the height of the new garage is not exceed the height of the existing house; 2. landscaping to be as presented in submitted rendering.

The Board concluded the hardship to be:  the non-conforming structure due to location on the property.

Review of proposed revised 2014 Meetings Schedule – Commissioners reviewed the proposed changes but were unable to proceed due to lack of five regular members being in attendance.
