The following are motions made during the September 5, 2013 Public Hearing/Regular Meeting.
Chairperson Berstene called the public hearing to order at 7:33 pm in the Madden Room.
The Recording Secretary read the legal notice as published in the Journal Inquirer into the record.
Public Hearing
Appl. 2771-13 – Cheryl LeBlanc - request for variances to Section 2.5 and Table 3.1.2A to allow: 1) the expansion of a non-conforming structure for the construction of a garage addition resulting in a 34’ front yard setback (50’ required); 2) an 8’ variance to allow a 12’ side yard setback (20’ required) for property located at 96 Ident Road, A-40 zone.
Ms. LeBlanc presented some background information for the application and answer questions from the Commissioners. Ms. LeBlanc stated that due to the constraints of the lot and position of the septic system in the rear of the property a hardship is created for any other location.
The Commissioners determined they had enough information from the applicant.

Deliberative Session

There was a short discussion regarding the hardship and non-conformity of the property due to changes in regulations.
Motion to: approve Appl. 2771-13 – Cheryl LeBlanc - request for variances to Section 2.5 and Table 3.1.2A to allow: 1) the expansion of a non-conforming structure for the construction of a garage addition resulting in a 34’ front yard setback (50’ required); 2) an 8’ variance to allow an 12’side yard setback (20’ required) for property located at 96 Ident Road, A-40 zone, with the following condition: as represented on Zoning Location Survey #213027, dated 8-19-13, prepared by Gary B. LeClair, LLC.
The Board concluded the hardships to be: the structure is existing as non-conforming due to subsequent regulation changes; and the location of the septic system in the rear of the property.
