ZONING BOARD OF APPEALS

Minutes                     1                                  June 7, 2012

The following are motions made during the June 7, 2012 Public Hearing/Regular Meeting.

Public Hearing

Chairperson Berstene called the public hearing to order at 7:38 pm in the Madden Room.

The recording secretary read the legal notice into the record as it was published in the Journal Inquirer on Saturday, May 26, 2012 and Saturday, June 2, 2012.

Appl. 2763-12 – Wendy and Joseph Goudreault - request for a 14 foot variance to Table 3.1.2A and to modify a previous variance granted (App. #544- granted 6/10/66) to allow a second floor addition on the existing garage, six feet from the property line (20 required), at 321 Abbe Road Ext., AA-30 zone.

Mr. and Mrs. Goudreault presented the application. They are seeking a modification of the existing variance that was granted for the one story garage to allow a second level above the garage.  They want to add two bedrooms above the existing garage and will not be changing the footprint of the structure.  The roof of the garage would be raised to the level of the existing roofline of the house.  The Goudreault’s presented architectural drawings of the structure before and after the addition.  They feel the hardship is the position of the sewer line in the back yard and the position of the oil tank on the outside of the house.  The oil tank is situated opposite the furnace and hot water heater in side the house.  To place the addition elsewhere would entail reconfiguring all the existing bedrooms.

Commissioners discussed at great length the placement of and alternatives to the addition being built above the existing garage.  Taken into account was the sewer line in the back yard, the position of oil tank on the outside of the house, the pitch of the roof on the rear of the structure, the interior configuration of the house, the impact to the neighborhood with the addition above the garage, and the application to modify the existing variance vs granting a new variance based on the change in regulations since the variance was originally granted in 1966.

Motion to: close the Public Hearing at 8:52 pm.

Deliberative Session

Motion to: approve Appl. 2763-12 as presented, with the condition that there is no extension of the footprint of the existing structure upon completion of the addition.

Hardship: Difficulty of building over the existing sewer line and configuration of interior of existing house not feasible to put addition behind existing bedrooms.

There would be minimal or no adverse impact to the neighborhood.

Etter: Interior is not relevant, and building over sewer line is not based on factual information.
