Minutes                                       1                                       November 17, 2011

The following are motions made during the November 17, 2011 Public Hearing/Special Meeting.

Public Hearing

Vice Chairperson Berstene called the public hearing to order at 7:36 pm.

The recording secretary read the legal notice into the record as it was published in the Journal Inquirer on Saturday, November 5, 2011 and Saturday, November 12, 2011.

Appl. 2756-11 – Todd Waterman – request for a 10 foot variance to Table 3.1.2A to allow the placement of a storage shed 10 feet from side property line (20' required) on property located at 258 Abbe Road, RR zone.

Mr. Waterman stated that the 10 x 12 ft shed will be from Kloter Farms high-end line.  The proposed position of the shed is due to the multiple terraces and upward slope of the rear yard, along with the placement of four Sugar Maple trees on the property.  Mr. Waterman feels that the shed will add value to the property, as well as be aesthetically pleasing.  Mr. Waterman presented a letter in support of the application from his neighbor, Margaret Shea.

Commissioner Dickey-Gaignat observed that four other sheds in Mr. Waterman’s immediate neighborhood were within the 20 foot setback area.   Commissioner Dickey-Gaignat had Mr. Waterman point out where the Sugar Maples are located on the property.

Commissioner Jeski had Mr. Waterman confirm that the backyard slope was uphill.

Commissioner Kupchunos questioned whether there is a septic system on the property or town sewer.  Mr. Waterman confirmed that it is town sewer.

Commissioner Berstene clarified that the topography consists of a sloping hill and terraces not wide enough on which to place the shed safely.  Commissioner Berstene asked if the hedges on the south side of the house would block the view of the shed from the street.  Mr. Waterman responded that they are only about waist high so would not block the view.

Berstene closed the public hearing at 7:56 pm

Deliberative Session

Motion to: approve Appl. 2756-11 – Todd Waterman – request for a 10 foot variance to Table 3.1.2A to allow the placement of a storage shed 10 feet from side property line (20' required) on property located at 258 Abbe Road, RR zone, as stated on application.  

The Board concluded the hardship to be the sloping topography of the rear yard and the existence of Sugar Maple trees that will be preserved with the proposed location of shed.
