ZONING BOARD OF APPEALS

Minutes         1               July 7, 2011

The following are motions made during the July 7, 2011 Public Hearing/Regular Meeting.

Public Hearing

Chairperson Wagner called the public hearing to order at 7:30 PM.

The recording secretary read the legal notice into the record as it was published in the Journal Inquirer on Saturday, June 25, 2011 and Saturday, July 2, 2011.

Appl. 2751-11 – Eric T. Martin – request for a 17 foot variance to Table 3.1.2A to allow a shed 3 feet from the side property line (20’ required) on property located at 541 Foster Street, AA-30 zone.

Mr. Martin presented the application.  Mr. Martin showed pictures of the 90% completed shed sitting on the property line.  Upon completion Mr. Martin proposes to move the shed 3 feet from the property line.  Mr. Martin stated that the tiering of the back yard and the mature trees at the rear of the property make it difficult to put the shed anywhere else.  Mr. Martin presented three letters from his neighbors in support of the shed being 3 feet from the property line, which Chairperson Wagner read into the record.

Chairperson Wagner read into the record 2 letters received on July 6, 2011 in opposition to Mr. Martin being granted a variance for the location of the shed.  Mr. Berstene declared a point of order stating that the letters were unsigned, there were no names or addresses shown, thus no proof the letters were from South Windsor residents and were not acceptable for this reason.  The Commissioners unanimously agreed.

Chairperson Wagner closed the public hearing at 7:57 pm.

ITEM:  Deliberative Session

Appl. 2751-11 – Eric T. Martin – request for a 17 foot variance to Table 3.1.2A to allow a shed 3 feet from the side property line (20’ required) on property located at 541 Foster Street, AA-30 zone.

Commissioner Jeski stated that the topography of the property was definitely a hardship, that cutting down the mature trees at the rear of the property was unacceptable and that she was in favor of granting the variance.

Motion to:  approve Appl. 2751-11 – Eric T. Martin – request for a 17 foot variance to Table 3.1.2A to allow a shed 3 feet from the side property line (20’ required) on property located at 541 Foster Street, AA-30 zone, as shown on the plans submitted.

Hardship: the topography of the rear yard, with a 6 ft slope and narrowing of the side yard property boundaries, along with the preservation of the mature trees at the rear of the property.  The Board felt that there would be no negative impact on the neighborhood with the placement of the shed as proposed.
