ZONING BOARD OF APPEALS

Minutes         1       October 7, 2010

The following are motions made during the October 7, 2010 Public Hearing/Regular Meeting.

ITEM:   Public Hearing

Chairperson Wagner called the public hearing to order at 7:31 pm

Appl. 2742-10 – Vincent N. Prestileo, 140 Lake Street, South Windsor, CT - request for a 3 foot variance to Table 3.1.2A to allow an addition 17 feet from the property line (20 required), at 140 Lake Street, AA-30 zone - continued from 9/2/2010.  Re-opened at 7:35 PM

Mr. Prestileo presented the application.  After consultation with 2 builders, it was determined that there was only one feasible location for the addition due to very steep sloping on 2 sides of the property and the location of the septic system in the front yard.  Mr. Prestileo stated that his neighbors had no problem with the addition as proposed and even offered to voice their support at the ZBA meeting.

Commissioner Kupchunos stated that he is familiar with the property and that the slope on the driveway side is approximately a 45 degree angle – too steep for building.

Commissioner Lewis asked if Mr. Prestileo had considered modifying the existing breezeway into a room in lieu of the addition.  Mr. Prestileo stated that they have included the breezeway as part of the addition proposed.

Chairperson Wagner closed the public hearing at 7:45 pm.

ITEM:  Deliberative Session

Motion to:  approve Appl. 2742-10 – Vincent N. Prestileo, 140 Lake Street, South Windsor, CT - request for a 3 foot variance to Table 3.1.2A to allow an addition 17 feet from the property line (20 required), at 140 Lake Street, AA-30 zone, as shown on plans submitted.

Hardship:  Topography of lot and location of the existing septic system.  The land slopes away steeply on two sides of the property and the septic system is located in the front of house making these areas undevelopable. It was also noted there would be no negative impact on neighbors.

ITEM: Correspondence

Letter of Resignation – N’Marie Crumbie.  Chairperson Wagner acknowledged appreciation for her service on the Zoning Board of Appeals, wished her well and hoped she would be willing to participate on a commission in the future.
ITEM: Other Business

Discussion of Annual Report for 2009-2010.
  
Motion to:  approve Annual Report for 2009-2010 with correction to the spelling of Chairperson Stephen Wagner’s name:

ZBA Training with Attorney Kari Olson from Murtha Cullina. Attorney Olson presented a powerpoint providing a general overview of the responsibilities of and the regulations governing Zoning Boards of Appeal (see attachment).
