ZONING BOARD OF APPEALS

Minutes                                         1                       November 6, 2008

The legal notice was read into the record as it was published in the Journal Inquirer on Saturday October 25, 2008 and Saturday, November 1, 2008.

Motion to move the Public Hearing and Deliberative Session after Correspondence.

ITEM: Other Business

Michele Lipe gave the Commission members a handout that was a matrix of the amendments that were made to the latest zoning regulations and highlighted some of the changes, specifically the porch amendment and some changes in signage regulations.

ITEM: Correspondence

Berstene stated that he received a notice requesting the 2007-2008 Annual Report and asked that the recording secretary have copies to hand out at the next meeting.

Berstene also stated that there is a training session on November 24, 2008 regarding Roberts Rules of Order.  Berstene asked that a reminder email be sent to Commission members and that they let the recording secretary know if they will be attending.

An invitation for the Chamber’s Holiday Social was also received.  

ITEM:  Public Hearing

Appl. 2725-08- Steven Stegman- request for a variance to section 2.14 for the expansion of a non-conforming structure to accommodate an 8 foot covered porch (to be 7.5 feet from the front property line), on property located at 14 Miller Road, RR zone

Mr. Stegman came before the Commission and stated that the home was built in 1800’s and it is non-conforming to the zoning regulations.  The applicant stated that he would like to construct an 8 foot wrap around covered porch.  

Stegman stated that the property line is very far away from the road on the Nevers Road side.  The edge of the porch would only be 34 feet from the road, which is about 7 ½ feet from the property line.  

There were no public comments.

Wagner expressed concern about increasing the nonconformity.  The Commission had comments and some concerns were expressed about the possibility of the road being widened and the house would be closer to the road.  It was also mentioned that there could be a possibility that the porch could become enclosed later in time.  Lipe stated that it could be required as a condition of approval that the porch remains open.

Public Hearing closed at 8:17 pm.

ITEM: Deliberative Session

It was determined that the hardship was that the house was built in the 1800’s and the position of the house on the lot is non-conforming.

Motion to approve with conditions application # 2725-08- Steven Stegman- request for a variance to section 2.14 for the expansion of a non-conforming structure to accommodate an 8 foot covered porch (to be 7.5 feet from the front property line), on property located at 14 Miller Road, RR zone

This approval is subject to the following conditions:

1.      The porch shall meet the criteria as defined in Section 3.1.2H, Items 1, 3, 4, 5, and 6 of the Zoning Regulations.
2.      Any steps leading to the ground shall be on the Miller Road side of the porch.
