Chairperson Wagner called the meeting to order at 7:00 p.m.  The Recording Secretary read the legal notice as published in the newspaper

Appl. #2641-05 – Daniel Coffey, 18 Heritage Drive, A-20 zone

Mr. Dan Coffey came before the Board to represent this application on behalf of Greg Dupuis.  He explained that back in 2000 this property was granted a variance to put a deck onto the house.  At this time Mr. Dupuis would like to construct a front porch onto the house, which will be in conformance to the regulations.  He would also like to connect the front porch to the back deck, which would not be in conformance.  Mr. Coffey said he spoke with the abutting neighbors and no one has voiced any concerns.  The house sits back from the road approximately 200 feet, and is not centered on the property.

No one from the public spoke in favor or opposition to this appeal.

Answering questions from the Board, Mr. Coffey explained the sign was posted, but realized Sunday that it was missing.  The hardship is created by the placement of the house on the property.

Michele Lipe, Assistant Director of Planning explained that this request is not covered by the previous variance request because the Zoning Board of Appeals granted the variance for a specific configuration.

Commissioner Banks stated he feels this is an extension of the deck and could be covered by the previous variance already approved.  He also felt that this could be a modification of the existing variance granted in 2000.

With no further questions, the public participation portion of this appeal and public hearing closed at 7:23 p.m.

Motion to:      approve appl. #2641-05 – to allow an expansion of the deck between the existing deck and the front porch as shown in the application at 18 Heritage Drive, A-20 zone.


The previous application granted that this application is being modified for was granted on September 21, 2000, item #2, a 10’ variance to allow extension of a deck and construction of a handicap ramp 30’ from the rear property line (40’ required) at 178 heritage Drive, A-20 zone.

The Commission discussed what was happening with the appeal for this application.  Chairperson Wagner stated that if there is a settlement proposed then they would have to come before the Board in order to get the settlement approved.
