Vice Chairperson Warren called the meeting to order at 7:35 p.m.  The Recording Secretary read the legal notice as published in the newspaper.

Appl. #2512-01 - Carl & Jill Marino, request for a 7.5' variance to section 10.2 to
allow a proposed garage 2.5' from the property line (10' required), at 97 Edgewood
Drive, A-20 zone.

Commissioner Nadel disqualified himself from this application because he lives on Edgewood Drive and felt there could be a conflict of interest.  Commissioner Jeski was asked to sit and hear this application.

Mr. Carl Marino came before the Commission to represent this application.  He explained that he would like to construct a second garage bay attached to the house.  The house is centered on the lot and therefore there is no room to place an addition on either side of the house.  Mr. Marino also told Board members that he has three vehicles, one of which is an antique car, that he would like to be able to place in the garage.

No one from the public spoke in favor or opposition to this appeal.

Answering questions from the Board, Mr. Marino explained that the present garage is 20' deep.  The proposed second bay would be constructed to 30' deep and therefore the present garage would be deepened to match.

With no further questions, the public participation portion of this appeal closed at 7:55 p.m.

Appl. #2513-01 - Brian Ficaro, request for a 2.5' variance to section 10.2 to allow
an existing deck 7.5' from the property line (10' required) at 60 Benedict Drive,
A-20 zone.

Mr. Brian Ficaro came before the Commission to represent this application.  Mr. Ficaro explained that he had constructed a front porch and had decided on the size by using a survey from the Town and one when the house was purchased.  The Town came to inspect the porch and found that there was an encroachment on the front building line.  If the porch were cut back 2.5', there is a bay window that would block the walkway on the porch.  The house is 45 years old and Mr. Ficaro feels the front porch makes the house more aesthetically pleasing.

No one from the public spoke in favor or opposition to this appeal.


After a short discussion regarding this application, Board members found that the legal notice was asking for a side yard variance and the applicant needs a front yard variance.  Michele Lipe told members that she would look into this situation, the legal notice would be changed and the request could be heard at the November 1, 2001 meeting.  

Motion to:      continue the public hearing on application #2513-01 until the November 1, 2001 meeting.

Appl. #2514-01 - Scott Stickles, request for a 2' variance to section 10.2 to allow a
proposed porch to be 38' from the front property line (40' required) at 51
Highland Drive, A-20 zone.

Mr. Scott Stickles came before the Board to represent this application.  He explained that he would like to add a front porch onto his house and feels that his home would fit better into the neighborhood with this addition.

No one from the public spoke in favor or opposition to this appeal.

Answering question from the Board, Mr. Stickles explained that the porch will have a rail around it and also will be roofed.

Commissioner Nadel noted that the lot is rectangular and because it is on a corner lot, there are two 40' front yard setbacks to comply with.

With no further questions, the public participation portion of this appeal closed at 8:06 p.m.

DELIBERATIVE SESSION

ITEM:   Appl. #2512-01 - Carl & Jill Marino, 97 Edgewood Drive, A-20 zone

Commission Carino stated that there is no flixibility in the A-20 zones, which leaves no choice but to request a variance.

Hardship:  

Placement of the house on the property makes it impossible to construct an addition on either side of the house.
A Land restriction in the A-20 zone does not allow a 2-car garage addition constructed without entering the side yards setbacks.  This contradicts the intent of the zoning regulations, which would like to see as many vehicles as possible inside of the garage.

ITEM:  Appl. #2514-01 - Scott Stickles, 51 Highland Drive, A-20 zone

Commissioner Nadel felt that the applicant was not asking for a large porch, but because of the unusual shape and being on a corner lot, the applicant does not have much room for any type of expansion.

Vice Chairperson Warren stated he would like this application tabled because Commission members who are not present at this meeting had previously been at the September 6, 2001 meeting.  He would therefore like those Commission members present in order to make a final decision on this application.

Motion to:      table appl. #2511-01 - Messiah Evangelical Lutheran Church, request for a variance to section 17.8.5.c to allow a sign 54 sq. ft. and 12' in height (36 sq. ft. and 10' in height allowed) at 300 Buckland Road, GD zone.
