Chairperson Anthony called the meeting to order at 7:35 p.m.  The Recording Secretary read the legal notice as published in the newspaper.

Appl. #2503-01 – Steven D. Atkins, request for a 15’ variance to section 10.2 to allow a proposed garage 5’ from the side property line (20’ required), at property located at 639 Chapel Road, RR zone.

Mr. Steven Atkins came before the Board to represent this application.  He explained he would like to request a variance in order to construct a garage.  Because the driveway is needed in order to gain access to the garage, it is necessary to place the garage as proposed.  There is a sewer line that is next to the house and also a tree line.  The existing house does not comply with the required side setback of 20’.

A letter from Mrs. Vivian Aitken speaking in favor of this appeal was submitted (Attachment A).

No one from the public spoke in opposition to this appeal.

Answering questions from the Board, Mr. Atkins explained that the house was built in 1966.  The house presently has a two-car garage, which is under the house.  The proposed garage would consist of two bays.

Mr. Atkins told Commission members that the only alternative, which would be in conformance to regulations, would allow no access to the garage.

Commissioner Carino stated that he felt the hardship on the property is as follows:

Relative position of the house on the property.
The location of the septic system on the property.
There would not be access to the garage if it were placed on the opposite side of the property.
The lot is heavily wooded, and would require clearing of trees if the garage were placed in a different location on the site than what is being proposed.

With no further questions, the public participation portion of this appeal closed at 7:50 p.m.



Appl. #2504-01 – Craig and Lisa Maneeley, request for a 6’ variance to section 10.2 to allow a proposed porch 34’ from the front property line (40’ required), at property located at 77 Northview Drive, A-20 zone.

Craig and Lisa Maneeley came before the Board to represent this application.  Mr. Maneeley explained that he would like to request a variance at 77 Northview Drive.  The house is being upgraded with new siding and the applicant feels a front porch, which would extend the length of the house, would add to the value of the property as well as the neighborhood.

No one from the public spoke in favor or opposition to this appeal.

Answering questions from the Board, Mr. Maneeley explained that the proposed porch will extend the full frontage of the house.  It will be open with a roof on it and Mr. Maneeley would like to see the stairs extend out to the front yard.

Michele Lipe, Assistant Director of Planning told Commission members that stairs are not included in the setback requirements.

Commissioner Wagner briefly discussed the hardship on this property explaining that a front porch can not be on any other side of the house, but the front.

With no further questions, the public participation portion of this appeal closed at 7:56 p.m.

DELIBERATIVE SESSION

ITEM:   Appl. #2403-01 – Steven D. Atkins, 639 Chapel Road, RR zone

Commissioner Carino stated that a 2’ porch would be placed on the house, but it would not be practical or functional.

Motion to:      Approve appl. #2503-01 – Steven D. Atkins, a 15’ variance to section 10.2 to allow a proposed garage 5’ from the side property line (20’ required), at property located at 639 Chapel Road, RR zone.

Hardship:

Location of the house on the property makes it impossible to place a proposed garage on any other area of the lot.
Access to the garage is necessary.
The lot is heavily treed and would require considerable clearing if the garage were proposed in another location.

Hardship:  

When the house was originally placed on the lot, it was located toward the front of the lot.
The owners of the home are attempting to beautify the house and can not place a deck on the rear of the home due to plans to construct an addition at a later time.

ITEM:  Other Business

There will be a meeting held on June 14, 2001 at 7:30 p.m. at the Fire Department Headquarters.  Chairperson Anthony and Commissioner Carino will be attending.

There will be a joint meeting with the Planning & Zoning Commission held on June 19, 2001 regarding wireless communication towers.  Mr. Joel Rinebold from the Connecticut Siting Council will be there to give a presentation.
