THE FOLLOWING ARE MOTIONS MADE DURING THE REGULAR MEETING OF THE INLAND WETLANDS AGENCY/ CONSERVATION COMMISSION – MADDEN ROOM

Vice Chairperson Kelly called the meeting to order at 7:00 pm

PUBLIC PARTICIPATION:  none

PERMIT EXTENSIONS:  none
CORRESPONDENCE AND REPORTS:  none

BONDS:  none
MINUTES:  1/7/2015, approved by consensus

CONSERVATION COMMISSION:  Folger stated that with the ground frozen there is not much to be done; there are no new scout projects in the works at this time.

WETLAND OFFICER’S REPORT:   Folger stated that there is nothing to report - the ground is frozen.

PUBLIC HEARING:  7:10 pm

Appl. #15-03P – Scannell Properties #205, LLC, Sullivan Avenue Industrial Park, Regional Distribution Center, 135 Sullivan Avenue – IWA/Conservation Commission application for an industrial site plan.  The site is located southerly of Sullivan Avenue, and easterly of John Fitch Blvd (RT 5), Industrial (I) Zone.

Motion to: close the public hearing for App #15-03P at 9:25 pm

Motion to:  approve Appl. #15-03P with the following conditions:

  • The final approved copy of the entire set of plans and this letter reproduced thereon must be submitted to the Planning Department.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.
  • The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.
  • The permit is valid for five years and shall expire on January 21, 2020. It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.
  • Bonds shall be collected in the amount of $50,000 for installation and establishment of stormwater management structures; $50,000 for establishment and maintenance of erosion and sediment controls structures; and $25,000 for wetland mitigation creation and plantings.
  • Installation of an oil/water separator in the 24 inch pipe prior to the pond.
  • Town review of proposed easements and Declaration of Lots.
  • Conservation easement over the wetland mitigation area once it is completed which will allow routine maintenance.
  • Town Engineer’s comments to be added to the revised detail plans.
All approvals required must be obtained and submitted prior to any activity on the site.
A contact person shall be identified on the plans.

Commissioner Phillips stated from a personal perspective it is a shame to see agricultural land taken out of service but as a Commissioner it is not his decision as to whether agricultural land becomes industrial land.  It is necessary to vote in accordance with the law and regulations governing inland wetlands and watercourses.  As a Commissioner, he feels the applicant has done a very good job with a proposal that uses some of the most current best management practices to protect the water resources involved on this site.  Commissioner Blondin concurs.

The motion carried and the vote was unanimous.

The Commission took a five minute break from 9:38 pm to 9:43 pm.

NEW BUSINESS:

Appl. 15-05P, Commercial Development Units 7D & 7E - request by Evergreen Walk, LLC for a wetland permit modification to the commercial component of the approved Town Square at Evergreen Walk (Appl. 11-11P), on a portion of 151 Buckland Road [within "Evergreen Walk"], and being located approximately 1,200 feet west of Buckland Road and 400 feet north of Smith Street, Buckland Road Gateway Development Zone.

Motion to:  approve Appl. #15-05P with the following conditions:

1.      The final approved copy of the entire set of plans and this letter reproduced thereon must be submitted to the Planning Department.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.
2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.
3.      The permit is valid for five years and shall expire on January 21, 2020. It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.
4.      Bonds shall be collected in the amount of $20,000 to ensure proper placement and maintenance of erosion and sediment controls; $10,000 for installation of the stormwater structures.
5.      All approvals required must be obtained and submitted prior to any activity on the site.
6.      A contact person shall be identified on the plans.

Appl. 15-06P, Residences at Evergreen Walk Unit 7B - request by South Windsor Developers, LLC for a wetland permit modification including changes to the building layouts and architectural changes of the apartments approved with Town Square at Evergreen Walk (Appl. 11-11P), on a portion of 151 Buckland Road [within "Evergreen Walk"], and being approximately 1,200 feet west of Buckland Road and 400 feet north of Smith Street, Buckland Road Gateway Development Zone.

Motion to:  approve Appl. #15-06P with the following conditions:

  • The final approved copy of the entire set of plans and this letter reproduced thereon must be submitted to the Planning Department.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.
  • The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.
  • The permit is valid for five years and shall expire on January 21, 2020. It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.
  • Bonds shall be collected in the amount of $50,000 to ensure proper placement and maintenance of erosion and sediment controls; $50,000 for installation of the stormwater structures; $24,000 for placement of wetland plantings, with a five year inspection and maintenance program to ensure establishment of the wetland plantings and maintenance of invasives.
  • Treatment of turf grass areas in the Town Square to include deep scarification of the soil with plan to be approved by Town Staff.
  • Reduce the 6 inch diameter rain garden underdrain to 4 inches in diameter.
All approvals required must be obtained and submitted prior to any activity on the site.
A contact person shall be identified on the plans.
