TOWN OF SOUTH WINDSOR
INLAND WETLANDS/CONSERVATION COMMISSION


Minutes                                 - 1 -                                     April 3, 2013

MEMBERS PRESENT:                Elizabeth Warren, John Blondin, Adam Reed, John Phillips, Audrey Delnicki, Hugh Brower, Richard Muller

THE FOLLOWING ARE MOTIONS MADE DURING THE REGULAR MEETING OF THE INLAND WETLANDS AGENCY/ CONSERVATION COMMISSION – MADDEN ROOM

Chairperson Warren called the meeting to order at 7:00 pm

PUBLIC PARTICIPATION:  none

PERMIT EXTENSIONS:  none
CORRESPONDENCE AND REPORTS:  Chairperson Warren stated that attending the Land Use Academy provides Commissioners with information that is very beneficial and useful.  Warren, Commissioner Muller and Commissioner Brower have previously attended.  Brower stated that it is very good training, with up to date cases and rulings.

Chairperson Warren stated that the Planning and Zoning Commission will be meeting next week working toward finalizing the Plan of Conservation and Development (POCD).  Folger stated that he had submitted a comment reinforcing the IWA’s view that natural resources should be taken into consideration when computing impervious coverage requirements on properties.  During the recent POCD hearings, some civil engineers spoke against excluding natural resource areas from consideration.  IWA supports the current verbiage in the POCD, which is that natural resource areas would be excluded from the calculations.

BONDS:  none
MINUTES:  Chairperson Warren requested the following corrections to the minutes of 3/20/2013, which were then approved by consensus:

Under Correspondence and Reports – the Land Trust, not the Audubon Society, is buying the Frank Niederwerfer property.

Under Conservation Commission – it should be leased farmland not leased open space.

CONSERVATION COMMISSION:  CT Trails Day is June 3rd, sponsored by Walk and Wheelways and Open Space Task Force at the Niederwerfer Wildlife Sanctuary.   

WETLAND OFFICER’S REPORT:  The Pleasant Valley Road violation is ongoing due to continued muddy slope conditions, there is silt fence at the bottom to contain the area.  The Patria Road neighbor is putting together a site plan and mitigation plan in order to go forward.

PUBLIC HEARING:  None  

NEW BUSINESS:  

Appl# 13-03W – Fritz – 1020 & 1010, Pleasant Valley Road – Inland Wetland/Conservation Commission application for the construction of a septic system for an existing single family house, and a new single family house and associated improvements on properties located westerly of Pleasant Valley Rd, Rural Residential (RR) Zone.

Rob Hellstrom, professional surveyor, represented the applicant.  Mr. Hellstrom reviewed the current conditions on the properties, feasibility options, and the proposed plans.  Property has a large amount of construction debris left by the previous owner that will be completely cleaned up; the shed on the property will also be removed; sewer connect estimate was obtained – sewer is cost prohibitive; it was determined that the only feasible option for the septic systems for both properties would have to cross a small portion of wetlands creating only a temporary impact to the wetlands when the piping was installed.  Piping will be designed to have a pipe within a pipe – the “sleeve” adds protection and allows for the piping to be snaked out if there is a problem instead of digging it up.
John Ianni, professional soil scientist, had mapped the wetlands and reported that the temporary disturbance to the wetlands was the most feasible plan.  Fill placed in other areas of the properties is not suitable for septic systems, must be naturally occurring material.  The wetlands are not viable for amphibian breeding with no evidence of vernal pools.
Health Officer’s approval has been obtained and Mr. Folger’s recommendations will be met.

Motion to: approve Appl # 13-03W with conditions:

  • The final approved copy of the entire set of plans and this letter reproduced thereon must be submitted to the Planning Department.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.
  • The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.
  • The permit is valid for five years and shall expire on April 3, 2018.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.  
  • Bonds shall be collected in the amount of $3,000 to ensure proper placement and maintenance of erosion and sediment controls.
  • All approvals required must be obtained and submitted prior to any activity on the site.
  • A contact person shall be identified on the plans.
  • Commission recommends that the wetland disturbance occurs during periods of low ground water.
