INLAND WETLANDS/CONSERVATION COMMISSION


Minutes                              - 1 -                                      January 18, 2012

THE FOLLOWING ARE MOTIONS MADE DURING THE REGULAR MEETING OF THE INLAND WETLANDS AGENCY/ CONSERVATION COMMISSION – MADDEN ROOM

Vice Chair Kelly called the meeting to order at 7:02 pm

ITEM:  PUBLIC PARTICIPATION:   none

ITEM:  PERMIT EXTENSIONS:   none

ITEM:  CORRESPONDENCE AND REPORTS:      Plan of Conservation and Development Survey results were distributed to Commissioners.  Discussion will follow under Old Business.

ITEM:  MINUTES:

Motion to:  approve the minutes from December 21, 2011 as corrected

The motion carried and the vote was unanimous.

ITEM:  CONSERVATION COMMISSION:  Jeff Folger stated that an Eagle Scout recently completed a project at Donnelly which entailed constructing a rail fence around the parking lot on West Road.  Folger also reported that the debris cleanup has been completed in the parks as well as the Wildlife Sanctuary.

ITEM:  WETLAND OFFICER’S REPORT:   Jeff Folger advised the Commission of a violation that has occurred on the interior lot of the Neary property located at 1576 Main Street.  Mr. Neary clear cut all the trees on the property which includes approximately 200 sq ft area of wetlands.  This was done without any approvals and includes street trees owned by the Town.  The Zoning Enforcement Officer issued a Cease and Desist Order and Town staff has been in discussions with Mr. Neary and his attorney.  Mr. Neary will complete a full restoration plan with appropriate trees, bushes, shrubs to recreate wildlife habitat on the property.  There is a drainage issue onto an abutting neighbor’s property that will probably require a berm and erosion controls on Mr. Neary’s part.  Folger stated that Neary will not be allowed to stump the wetland area, but that the rest of the property will be stumped.  The removal of all the trees was not indicated on the site plan approved by PZC.  Apparently, Mr. Neary felt the trees could be a safety issue after the October storm.

ITEM:   OTHER BUSINESS:  Plan of Conservation and Development work session.  Jeff Folger prefaced the discussion by stating that a representative from the Commission will present the Commission’s recommendations to the Town Council on January 31, 2012.
Following are the recommendations:

Preserve Wetland Resources:

  • State a policy of “No net loss of wetlands within a sub-watershed”.
Preserve Habitat:

  • Reduce wildlife habitat fragmentation by encouraging cluster or multi-family development.
  • Provide a buffer requirement to areas adjacent to Open Space to provide natural habitat transition zones and reduce likelihood of incursions into open space by adjacent landowners.
Water Quality:  Reduce Non-point Pollution by further controlling post construction stormwater runoff.

  • Require LID Best Management Practices within sub-watersheds where the current impervious coverage exceeds 10% of the total land area within the sub-watershed.
  • Reduce impervious surfaces by excluding wetland areas from the maximum impervious coverage calculation for a site plan.
  • Encourage Green Roof technologies.
Open Space sustainability:  

  • Determine the proposed uses of subdivision open space to be acquired by the Town and insure that there are sufficient Town resources to support those uses.
  • Encourage an “Adopt a Trail” program to empower citizen volunteers to assist in routine maintenance practices on Town trails.
Access Management and wetland impacts:

  • Conduct “pilot site plans” on properties within the area where access management regulations apply to determine conflicts with wetlands, area of historical importance, or species of concern.
