Chairperson Warren called the meeting to order at 7:03 p.m.


ITEM: CONSERVATION COMMISSION
Folger stated that November 3rd is the date for trail clearing at the wildlife sanctuary.  Kelly stated that there was clearing at the base of the sleding hill near Barber Hill Road and looked like there was clearing and grading on Town property.  Folger stated that it had been reported and that it will have to be restored by the developer.  Kelly stated that there should be a row or two of evergreens planted along the property line.  placeCityWarren stated that it could be part of the restoration.  

ITEM: WETLAND OFFICER’S REPORT
Folger gave an update on the Mobile Station on addressStreetOakland Road and stated that the removal wells are in place and are in working order.  They have portable filters and storage tanks placed onsite.  placeCityAppleton asked if the Town would receive a certification stating that the site is clean.  Folger stated that the Town will be sent quarterly reports on the testing of the wells.  

Folger stated that the jacking of the culvert will begin on addressStreetRye Street and said that now is a good time to start because the stream is completely dry.  Folger also stated that they have started putting protection in and have constructed a large concrete abutment.


ITEM:  NEW BUSINESS

Appl. #07-52P – Kelley Subdivision-– 617 Clark Street – Inland Wetland/Conservation Commission application for four-lot residential subdivision and associated improvements on property located northerly of Clark Street. Rural Residential (RR) Zone.

Galen Semperbon came before the Commission and gave an update of changes made to the application.  Semperbon made the following statements.
·       Two conservation easement areas were added
·       House has been shifted much further back and lot 2 has been reconfigured to contain additional land.
place·  Lot 1- the house has been shifted and the house has been rotated so that the back yard does not face the conservation easement.
·       Added additonal notes regarding the work for the water main, the sewer, and the road.
·       Added details on the plan regarding silt fence and wood chips for erosion control.

Commissioner Kelly asked how they will know what the configuration of the house will be because the plans just show a 90 x 90 box.  Folger stated that it could be a conditon of approval.  Bruce Kelley, owner of the lots came before the Commission and stated that he was not entirely sure of the configuration of the house or the shape of the house but the intention was the more logical place for a backyard.  Commissioner Kelly stated that she would like to see the layout for that lot and that the placement of the house should be shown on the plans.  Folger stated that there could be a footprint or envelope that the house and the driveway location will remain as shown on plans.  If it differs from what the plans show, the Commission can ask the applicant to come back in front of the commission for specific approval.  This discussion continued in great length.  

Kelly asked if the application is valid with Planning & Zoning.  Folger stated that the application is not valid with P & Z.  The lot is not apporved to be a building lot.  Semperbon stated that the Planning department has interpreted the P & Z reulations that interior lots have to have a single piece of property and cannot combine additional land and there is a maximum of three lots and you can go for a resubdivision.  Semperbon stated that in order to meet the Planing and Zoning’s interpretation of the regulation, they cannot utilize that piece of property they are going for interior lots as part of the Planning and Zoning application.  Semperbon stated that they have been directed to do the Planning and zoning application in two steps in order to conform to P & Z’s regulations.   Semperbon stated that they will end up with the same resubdivision as wetlands and P & Z, the only difference is that they have to go through a two-step process with P & Z.

Commissioner Kelly asked to have the numbers revised to show what the impervious coverage is compared to the upland area for placeLot A and Lot B in order to get an accurate picture.  Semperbon stated that it is an acre and a half less of the 1.63 acres and .68 of it is wetlands.  Semperbon stated that if the wetlands are subtracted on parcel A and B, 41.8 % of the two parcels are wetlands.  CityWarren stated that the size and style of the house built on placeLot 1, as well as the approach of the driveway could impact the amount of impervious coverage.  placeCityWarren stated that the question is can we guarantee which way the house faces.  placeCityWarren stated that it could be an approval condition to show the configuration of the house and to request that the person buying the house come back to the Commission if they wanted the house facing a way different from the plans.  Muller stated that because there is a conservation easement the Commission has the authority that if anything is done inside the easement area to enforce restoration.  Folger stated that the Commission has the authority to dictate if there is an impact, to require by approval condition to have a front load garage to minimize the footprint of impervious surface adjacent to the vernal pool.  

John Ianni, Soil Scientist for Highland Soils came before the Commission and stated that in approving the plan, you are approvaing separating distances.  If the applicant or the house that comes in fits within those parameters that is what is being approved (the separating distance to the wetlands).  If the house can fit within the setbacks that are shown on the plan, that is what is being approved.  

placeMarrero asked if the memo from Doolittle had been addressed.  Semperbon stated that he did not have a chance to review the memo.  placeMarrero asked if it would an issue.  Semperbon stated that it would result in a slight increase in the disturbance to the wetlands (60 sq. ft.). Semperbon stated that it could be accomodated.

Conditions

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of CityplaceSouth Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on July 25, 2012.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

5.      A contact person shall be identified on the plans.

6.      Tree line shall not be cleared on placeLot 1.

7.      Town Engineers comments of 10/3/07 must be addressed.

8.      If the house, driveway, and yard position and orientation on placeLot 1 are not substantially as shown, the application shall
shall show the commission data indicating there is no additional impact to the functions of the vernal pool.
