Chairperson Warren called the meeting to order at 7:04 p.m.

ITEM: CONSERVATION COMMISSION

Folger stated that there was talk about setting up a work party for addressStreetNiederwerfer Road to clear some trails at the wildlife sanctuary.  Folger stated that a Girl Scout troop expressed some interest in helping and suggested setting up a date sometime in November when the leaves are down.  Folger stated that the troop is also interested in doing work at Donnelly.

CityplaceWarren stated that one of the condo owners at Strawberry Fields saw a bobcat in the area and took photos of it and sent them to Marcia at the Town Hall.

ITEM: WETLAND OFFICER’S REPORT

Folger stated that it has been pretty dry since there hasn’t been any rain.  Erosion control maintenance is doing well.  Riparian plantings are doing well.  The soil is very heavy and some of the plantings seem like they could be struggling a little.

ITEM: PUBLIC HEARING

Appl. #07-46W – Miller Site Plan – 27 Pierce Road – Inland Wetland/Conservation Commission application for a site plan for a residential house, barn and paddock and associated improvements on property located northerly of Ellington Road and easterly of addressStreetPierce Road. Rural Residential (RR) Zone.
Galen Semprebon, Professional Engineer and Vice President of Design Professionals came before the Commission and stated that the site is an existing lot on the corner of Route 30 and addressStreetPierce Road.  A house and a rear pasture and barn for horses are being proposed.  Semprebon made the following comments:
·       Will connect to existing sewer
·       Request as waiver to try to put a well on the site rather than snake in a water service through the wetlands to the house.
·       Site is 4.19 acres

o       When application was submitted the wetlands were slightly different.  CityplaceLogan re-flagged the wetlands and relocated them as part of the most recent plan.

Semprebon addressed questions from the Commission.  CityplaceWarren referenced the memo from Folger that mentioned the limited clearing that must be shown on the plans and asked if the plans reflect the change.  Semprebon stated that the plans have been revised in accordance with Folger’s memo.  Semprebon also stated that a pasture seedling mixture would be added to the plans.

CityplaceWarren stated that she walked the site and it seems suitable for proposed use under the conditions shown.  Semprebon stated that it should be noted that when the wetlands were flagged a pocket appeared and the footing drain is shown running through the wetlands.  It can be changed to go around the wetlands.  Kelly stated that the fencing around the pasture should be placed to make sure that there is a twenty foot buffer between the edge of pasture and the wetlands.  Semprebon stated that the applicant is agreeable to a twenty foot buffer.  Commission members stated concern about the handling of horse manure.  Semprebon stated that there is a management program through the HEAP program.

Conditions

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of CityplaceSouth Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on July 25, 2012.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

5.      A contact person shall be identified on the plans.

6.      Footing drain will be relocated to avoid pocket wetlands.

7.      Maintain a minimum of a 25 foot non-disturbance buffer from the wetland boundary adjacent to the pasture.

8.      A manure control plan must be submitted to Town.

9.      Reinforce silt fencing with hay bales or wood chips.


Appl. #07-52P – Kelley Subdivision-617 Clark Street – Inland Wetland/Conservation Commission application for four-lot residential subdivision and associated improvements on property located northerly of Clark Street. Rural Residential (RR) Zone.
Galen Semperbon, Vice President of Design Professionals came before the Commission and presented the application.  Semperbon made the followin gcomments
·       Proposing 4 lots (2 rear lots & 2 front lots)
·       Access three lots from one driveway
·       Public water and public sewer
·       Some topographic relief
·       Moderate slope to the wetland
·       Portions of the site are wooded

John Ianni, Soil Scientist of Highland Soils came before the Commission and stated that he did the mapping of the wetlands in the spring of this year and found that the representation of the dilineated wetlands to be correct.  Ianni state that he wrote a brief report regarding the physical characteristic of the wetlands and broke them into five different areas.  Ianni made the following statements.

Wetland 1- is located along the northern property line and is an isolated depression wetland.  Most of the wetlands have been altered in the past.  The wetland has no inlet or outlet to it, with fairly short but steep slopes.  It is mostly herbacious with a lot of cattails and is ground water fed.

Wetland 2- (the largest wetland) was created into a pond and used to be wetland soils years ago.  The ariel photos that were taken in the late 50’s show it as wetlands and not a pond or open water wetland.  Mainly verbacious wetlands (cattails), some woody vegetation moving in.  The Southern part of the wetland is open agricultural field so the wetland soils extend a ways up from what would normally be considered a wetland.  It is more of a soil type wetland.

Wetland 3- (western corner if the property) is an isolated pocket wetland.  There is potentail for vernal pool.  It has characteristics but has not been inveastigated.

Wetland 4- is generally open in the center and wooded along the edge.  There is a field to both sides with a man-made ditch that tries to drain the wetland down into the larger wetland.  The ditch is somewhat non-functional because it is old.  During the highest groundwater period there is flowtoward the north.  

Wetland 5- connects to wetland 4.  It is mainly wooded Red Maple.  It ponds water and is fed by an exsisting catch basin on addressStreetClark Street.  Wetland was investigated in June of 2007 and found that that wetland contained emerging wood frogs.  A portion of it could be classified as a vernal pool based on the presence of the wood frogs.  In late June the wetland was completely dry.  

Ianni stated that he noticed in Folgers memo that he asked for recommendations for preserving the vernal pool.  Ianni stated that he was not able to put that together for tonights meeting.  Ianni said that some of the recommendations that would be made to preserve the vernal pool would be to avoid the waterline that runs along the property line which is proposed in close proximity to the pool and would be avoided during the months of March, April, May and June.  Ianni is recommending that the waterline be dug in August and September and doing so would avoid the migration period.  Ianni stated that if the house could be moved further to the west it would be helpful as well.  A conservation easement mimicing the upland review area and maintaining enough separating distance from the proposed house to the wetland and increasing the woody vegetation would help to preserve the vernal pool.

placeMarrero stated that the house on lot 2 appears to be very close to the wetlands and asked if the house could be moved further west to have a bigger buffer area.  Semperbon stated that the house has already been relocated in response to Folger’s memo.  Folger stated that the house could be moved futher back because the rear property line is not the real property line.  Folger asked why it couldn’t be moved further away so that more of the house would be outside the upland review area to the west.  Mr. Kelly stated that there is no problem moving the house to the west and it could be modified.  

placeCityWarren stated that they would ask the applicant to come back with a revised plan showing relocation of the house and an easement because the Commission does not feel comfortable acting on the application at this point.

Application was continued to October 3, 2007 for plan revisions

Appl. #07-54P – Mill on the River—989 Ellington Road – Inland Wetland/Conservation Commission application for the construction of a sun room and associated improvements on property located easterly of Ellington Road. Rural Residential (RR) Zone.

Galen Semperbon, Vice President of Design Professionals came before the Commission and presented the application.  Semperbon stated that the applicant wishes to move the existing greenhouse and put it on a desk adjacent to the waterway.  The deck would be built on pylons along the edge of the existing waterway.  

placeCityWarren asked how many sono tubes would be used.  Semperbon stated that eight tubes would be used.  Kelly stated that there should b efabric placed over the catch basin when the digging begins.
