Chairperson Warren called the meeting to order at 7:06 p.m.

ITEM:  Minutes

The meetings of December 6, 2006 and December 20, 2006 will be reviewed and a decision can be made on them at the January 17, 2007 meeting.

ITEM:  New Business

Appl. #06-62W – Aldi Distribution Center – 295 Rye Street

Mr. Galen Semprebon, a Professional Engineer and Vice President with Design Professionals, Inc. came before the Commission to represent Aldi Distribution Center.  This application is requesting the removal of debris within the upland review area and wetland area.  All of the debris is within the wooded portion of the property.  There are fairly significant slopes along the side of the property.  The property is presently farmed and the debris that is proposed to be removed from the site is associated with the farming operation.  The areas where debris is to be removed from are along the northern section of the property and southern section of the property.  In both these areas there may be some disturbance.  Where the disturbance takes place, the area will need to be broken down into smaller subsections.  A planting schedule has been revised and stabilization measures have been provided which include topping of trees in order to allow more sunlight into the areas.  A house and tobacco barns will be removed as part of this development.

Mr. Stanley Dynia, a Soil Scientist from GZA came before the Commission.  He explained that work will occur in the upland review area as well as the wetlands.  The area’s will be protected with erosion controls and as part of stabilization plantings, mulch and erosion fabric will be used where necessary.  A full time representative will be on the site to monitor and work with the contractor and town staff.  There will be temporary impacts, but no direct permanent impacts.

Jeff Folger suggested that the size of the seedlings be reduced to a 12 to 24 inch size.  The other item that should be added to the plan is the sequence of working on the slopes.  The areas may need to be broken down further to more manageable sections.  Mr. Semprebon explained that the areas are broken down into four zones and could be broken down further if it is deemed necessary.

Answering questions from the Commission, Jeff explained that if there was strictly surface material it would be good to clear everything at once.  If material is buried, there will be a need to concentrate on sequence and to stabilize as the work goes along.  The contractor needs to be alerted where to clear first.  In the staging area, material will be placed and a berm created so that items do not wash into the wetlands.  In the staging area there will be a dump truck that will take debris off of the site when the truck is full.

Mr. Semprebon explained that the number of times going up and down slopes will be minimized by working across the slopes to remove debris and stabilize the slope as they go along.

Mr. Stanley Dynia explained that erosion fabric, hay bales and/or silt fence will be set below the work areas.  Once the work is complete, the area will be stabilized with erosion fabric and most likely some mulch.  The areas will be monitored.

Even though areas are designated as zones, a whole zone will not be stripped all at once.  The plan will be to work progressively through and stabilize the area.  Jeff requested an additional note be added to the plans that states within each zone, where practical, the area will be divided into smaller subsections and those sections will be stabilized before moving to the next area.

Motion to:      approve with conditions appl. #06-62W – Aldi Distribution Center – 295 Rye Street – Inland Wetland Commission/Conservation Commission application for the removal of debris in the wetlands and upland review area for property located on the northerly side of Rye Street, northeasterly of Commerce Way, Industrial zone (I).

The vote was as follows:  unanimous

Conditions:

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on December 20, 2011.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

5.      A contact person shall be identified on the plans.

6.      The zones indicated on the plans are to be divided into subsections during the debris removal process and must be stabilized as material is removed.

7.      The erosion mat specifications to be reviewed and approved by town staff.

8.      The revised planting schedule to be reviewed and approved by town staff.

9.      Contractor specifications to be added to the plan and to be reviewed and approved by town staff.

10.     We recommend a bond in the amount of $15,000 be submitted to the Planning & Zoning Commission to ensure compliance with the erosion and sedimentation control measures.

ITEM:  Other Business

CT. River Assembly

Ms. Kathy Hale of the CT. River Assembly came before the Commission to give an overview of what the CT. River Assembly’s role is.  She explained that the purpose of this presentation is to reassess the Assembly and make a decision on whether to expand or eliminate the CT. River Assembly.  The intent of this organization is to protect the river.  Input is given to town’s that have work being proposed in the

conservation area.  Negative input from the Assembly would require a 2/3rds vote to pass when heard by the applicable town.

Answering questions from the Commission, Ms. Hale explained that an applicant would be made aware that they needed to come before the CT. River Assembly after town staff reviews and determines that all criteria meets the necessity to go before the Assembly.  The Town Planning Department has a checklist to follow.

It was the general consensus of the Commission that the CT. River Assembly is important to South Windsor because it protects the town from impacts that could be created by organizations in other towns.
