IWA/CC Minutes 9-6-2006

Chairperson Warren called the meeting to order at 7:05 p.m.

ITEM:  Public Participation

Mr. Richard Krol of 5 Stone Crossing came before the Commission to discuss the application before the Town Council to allow Corner Stone Drive residents to clear cut within an upland review area.  Mr. Krol stated he has requested becoming intervener in this matter.  Chairperson Warren explained to Mr. Krol that he would have to go to the Town Council to request becoming an intervener in this matter because there is no application before the IWA/CC.  This application would need to come before this Commission if the Town Council approves the residents request.  Jeff wrote the Town council a memo to review this situation (Attachment A).

ITEM:  Correspondence and Reports

Chairperson Warren explained that she had received correspondence from the Trust for Public Land/Connecticut River Program.  They are looking for Town’s to participate in taking care of the Connecticut River.  Hearings will be held regarding this matter at a later date.

ITEM:  Minutes

The minutes of July 19, 2006 were approved by general consensus of the Commission.

ITEM:  Conservation Commission

Wildlife Sanctuary

Jeff stated that a work crew would be necessary in October to clear the trails and remove fallen trees.

Major Michael Donnelly Preserve

On September 30th, a Scout will be working on the loop trial.

The riparian restoration area near Clark Street has come along good.  Six hundred seedlings have been planted.  The town has received a WHIP grant and will be reimbursed for all the work done in this area.  

During the winter months, the Wapping park should be walked in order to determine where trials should be located.  Two parking lots should also be developed, one on Clark Street and one on Ellington Road.

ITEM:  Wetland Officer’s Report

A violation letter was issued to William Krawski, Jr. at 178 Foster Street.  The violation involves clearing and grading activities that have occurred in the upland review area.  Jeff will visit the site on September 7, 2006 to discuss this situation.

ITEM:  Public Hearing

Jeff explained that appl. #06-39P – Town of South Windsor Fire Station has been withdrawn.

Appl. #06-40P – Chinese Baptist church of Greater Hartford

Attorney Leonard Jacobs of Jacobs, Walker, Rice & Basche, LLC came before the Commission to represent Chinese Baptist Church of Greater Hartford.  Attorney Jacobs stated that his client is seeking permission to construct a church on the East Hartford/South Windsor town line.  This construction will impact the regulated area.

Mr. Jeff Scala the Operations Manager/Project Manager at Garg Consulting Services, Inc. explained that there are wetlands 25 feet beyond the property line.  The building being constructed is approximately 35,000 square feet with associated parking.  The property will be accessed from Burnham Street.  Mr. Scala explained how the drainage on the site would be treated.  The erosion and sedimentation controls measures being developed are silt fencing around the pond, two temporary stock piles, and an anti-track pad at the entrance.  Mr. Scala then went on to explain that any area disturbed will receive 4” of topsoil and the basin area will be planted.  All staff comments have been addressed.  There are no endangered species on the property.  A small oil spill has been located on the site, but will be taken care of.



Jeff stated that the site is relatively level and the soil borings show deep sands.  The parking lots will have islands with rain gardens.  Planning & Zoning Commission will need to approve the site plan.  At that time the Town Engineer comments can be addressed.  Perimeter controls will be adequate for this site.

The Commission discussed the planting plan that has been established for this site.

Answering questions for the Commission, it was explained that the depth of the basins will be 2-2 ½ feet.

Motion to:      approve with conditions - appl. #06-40P – Chinese Baptist Church of Greater Hartford – King Street – IWA/CC application for the construction of a church, parking lots, grading, utilities, and associated improvements on property located west of King Street.  Rural Residential (RR) zone.

Conditions

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on September 6, 2011.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

5.      A contact person shall be identified on the plans.

6.      We recommend a bond in the amount of $3,000 be submitted to the Planning & Zoning Commission to ensure compliance with the erosion and sedimentation control measures.
