ITEM:  Bond

Jeff explained that there has been a request to release a bond for Filene’s for the trailer distribution center.  Jeff stated that the site is stable and the basin is growing.  Phragmites has established in the basin so the recommendation would be to remove the phragmites and hold $1,000.00 to ensure the removal of the phragmites.

Motion to:      release the bond in the amount of $4,000.00, $1,000.00 to be held to ensure removal of the invasive species for appl. #04-31P – May Department Stores – Nutmeg Road South and southerly of Governor’s Highway, I – Industrial zone.

ITEM:  Conservation Commission

Jeff told Commission members that the walkways and bridges at the Major Michael Donnelly Preserve have been repaired.  The ½ mile loop trail is being constructed by a series of Eagle Scout projects.

ITEM:  Wetland Officer’s Report

Mr. Coine who is the owner of the trailer park on Main Street was sent a warning letter for the dumping of debris on the slope.  Mr. Coine is responsible for the removal of this debris.

ITEM:  New Business

Appl. #05-34P – Evergreen Run

Mr. Alan Lamson from FLB Architectural came before the Commission to represent this application.  Mr. Lamson explained that the connection to the Woodcock property would have to be modified from the previous application in order to accommodate utilities to the property.

Ms. Michelle Carlson from Fuss & O’Neill came before the Commission and stated that with this modification there would be 3,278 square feet of direct impact to the wetlands.

Mr. Jeff Shamis, a Wetlands Expert came before the Commission to discuss this site.  He explained he has evaluated the area and has determined that although there will be an impact to the wetland; it was felt that the mitigation that has been offered will compensate for the disturbance.  Mr. Lamson added that all of the mitigation has been complete.

Commission members discussed in length the development that will occur in the future on Buckland Road and Access Management wanting developments to use shared access drives.  Disturbance to wetlands will probably occur more often because the need for traffic control and fewer curb cuts.

Motion to:      approve with previous conditions appl. #05-34P – Evergreen Run – 70-90 Buckland Road – IWA/CC minor modification to an existing permit application.  A modification to an existing permit to relocate utilities to facilitate connection with the neighboring property.

Conditions:

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on November 2, 2010.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

A contact person shall be identified on the plans.

We recommend a bond in the amount of $50,000 be submitted to the Planning & Zoning Commission to ensure establishment of the mitigation area and stabilization of the watercourses.

No building permits shall be issued on this site until detention basin #1 on the Evergreen Walk site has been adequately built to the standards of the plan that was previously approved and proposed vegetation established.

Extend the stabilization of the stream bank farther south approximately 80 to 100’ to the point where the stream is head cutting.  To be reviewed and approved by the Town Engineer.

ITEM:  Old Business

East Hartford Sand and Gravel

Jeff told Commission members that this area will perform ecological functions as well as education functions.  Jeff also stated that what is being proposed on this property is a good plan with a lot of diversity.  Access to this area has been granted through an easement, the general public will not be permitted.

Further discussion on this item was continued to the next scheduled meeting.
