ITEM:  Conservation Commission

Witch Hazel seedlings will be planted on Saturday, April 9, 2005 at 9:00 a.m. at Nevers Road Park along the northern portion of the park where the two farm fields are located near the hiking trail.

Jeff explained to the Commissioner that they received an addendum for this agenda.  An application was submitted on April 5, 2005 and will be received tonight.  It is a modification on the application the Commission approved for Wentworth Park on Oakland Road.  In order to conform to a Department of Transportation permit, the applicant is required to widen Oakland Road.  The road will be widened on one side by 2’ and 3’ on the other side.  It will also require extending a box culvert that is under the road.  The application will be heard at the next meeting.

ITEM:  Public Hearing

Appl. #05-13W – Emerald Green/Teaberry Senior Residence

Attorney Ryan came before the Commission to represent this application.  He explained that this application consists of a three-lot subdivision.  At the last meeting a drainage system was proposed that was felt to be a good plan.  Mr. Jeff Doolittle suggested an alternative location to discharge.  The Commission then asked us to check and determine if this is a prudent alternative.  There has been a handshake agreement with Podunk Ridge condominiums to permit a discharge easement through their property.

Ms. Karen Isherwood came before the Commission.  She explained that the plan shows the new location to discharge.  The easement will encroach upon an existing conservation easement that was placed on the property during the Podunk Ridge application.  It will be necessary to make a modification to the existing conservation easement to allow part of the storm drainage system to come into the easement area.  Meets and bounds will be determined in the field with Town Staff.  Grading will also be determined with Town Staff.  Ms. Isherwood reviewed the plan that is being proposed to be implemented.  The wetland disturbance is estimated at approximately 2160 square feet.  The upland review area that is proposed to be disturbed is approximately 4800 square feet +/-.  



Mr. John Ianni agrees with the location of the flags and indicated that the wetland soils are poorly drained over a much deeper clay layer.

The landscaping plan has been revised and offers a seed mix, which has been approved by Jeff Folger.

Answering questions from the Commission, Jeff stated that he felt the new location for the drainage system is a much better area.  The plan will give an opportunity to fix existing problems as well as lengthen the travel time within the basin.

Ms. Isherwood stated that the plan has proposed for this system to be maintained by the Town.  The plan has been submitted to Jeff Doolittle.  He has indicated that grades will need to be changed and Mr. Mel Stead will need to look closer at the plan.  If the State would like to tie into this system, they would have to come to the Town for permission.  The applicant may want to look at increasing pipe sizes in order to accommodate future drainage.  Ms. Isherwood stated that she would run calculations to see if an increase would be necessary.

Jeff stated that maintenance would include a plunge pool at the bottom.

Public

Mr. Bruce Miller of 119 Barbara Road came before the Commission to ask questions regarding this application.  Ms. Isherwood explained that the Town will received an easement which will allow them access for any maintenance on the system.  The system has been sized for a 100-year storm.

Mr. Tim Friend of 887 Ellington Road felt the drainage area will help the entire area and is happy with the proposed plan.

Commission members discussed the process of how the conservation easement would need to be changed.  Jeff stated that there would be a formal request to the Town Council, which would show the exact boundaries of the new easement.

Motion to:      close the public hearing on appl. #05-13W – Emerald Green/Teaberry Senior Residence Development Drainage – 914 Ellington Road – Inland Wetland/Conservation Commission application for regulated activities in connection with the construction storm drainage structures for a three lot subdivision, and a 25-lot Senior Residence Development (SRD), on property located westerly of Ellington Road and northerly of Riverview Drive.  Rural Residential Zone.

ITEM:  New Business

Appl. #05-17P – Evergreen Run – 90 Buckland Road

Vice Chairman Forzley recused himself from this application and Commissioner Heffler chaired.

Mr. Alan Lamson from FLB Architecture & Planning came before the Commission to represent this application.  He explained that the site consists of 5 ¾ acres.  There is one 1100 square foot building planned on the site and will be developing a plan for the rest of the site in the future.  Presently there is proposed excavation and fill at the location with a stockpile at the rear of the property.  There will be erosion and sedimentation measures around the site with a temporary sedimentation basin at the front of the property.  Gas, electric and phone will be installed now so as not to have to dig at  a later date.  The plan has been revised in order to reflect Town staff comments and concerns.  All construction is presently outside of the wetlands and upland review area.  

Answering questions from the Commission, Mr. Lamson stated that the existing discharge system is presently stable.  The Holly tree on site will be relocated to a new location.  Grading will be done prior to the relocation of the tree.

Motion to:      approve with conditions appl. #05-17P – Evergreen Run – 90 Buckland Road – M/S Townline Associates – Conservation Commission application for activities in connection with the grading and excavation of a commercial building lot on property located easterly of Buckland Road.  Gateway Development Zone.

Conditions

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on April 6, 2010.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

A contact person shall be identified on the plans.

We recommend a bond in the amount of $15,000 be submitted to the Planning & Zoning Commission to ensure compliance with the erosion and sediment control measures.

The Tree Warden or Certified Arborist to supervisor the relocation of the Holly tree to ensure the protection and preparation of the tree.

Appl. #05-19P – Hudson Baylor Corporation – 300 Rye Street

Mr. Galen Semprebon from Design Professionals came before the Commission to represent this application.  He explained that the building on the site is 166,000 square feet.  The building is being proposed to be used for a recycling center for glass and recyclable materials.  The business is called Nutmeg Recycling.  As part of modifications to this site, a rail siding has been installed on the site.  The business would like to create two operating sections to this building so an office area can be constructed.  As part of this, parking will also need to be created which will include aesthetic improvements.  Mr. Semprebon reviewed the stormwater drainage that is being proposed for this site.  Based on Town Staff comments, there has been an increase of 1,000 square feet of direct wetland impacts in order to stabilize the existing eroded embankment.  Jeff Doolittle has asked to connect the drainage pipe from the proposed detention basin directly to the existing drainage pipe that crosses Troy Road at a new manhole or catch basin.  Include an inlet pipe to the side of this structure from the existing wetlands at the bottom of the slope.  There needs to be a plunge pool to trap sediments at the inlet to this pipe.  This will be a small revision to the plans.

Answering questions from the Commission, Mr. Semprebon explained that there should not be any potential for contaminated spills because the materials that the business will be working with are recycled glass and plastic products.  Through the Department of Protection regulations there needs to be a spill plan and safe guards for water quality protections.

Jeff stated that the stormwater treatment practices being proposed are a  big step forward from what the historical uses have been at this location.  Jeff explained that he is satisfied with the slope stabilization, although there may be a need to remove some canopy trees in order to get light in there to dry up some of the runoff flow.  There will be fill placed on the slope and then it will be seeded.

Answering further questions, Mr. Semprebon explained how the emergency spillway is designed into the current structures on the site.

9.      A shrub-planting plan shall be submitted for the stabilization of the drainage slope.  The plan to be reviewed and approved by Town staff,
