ITEM:  Correspondence and Reports

Draft Fine Ordinance

Jeff told members that the Town Council held a public hearing regarding the Fine Ordinance on February 18, 2003.  There was discussion regarding item 5 and item 9.  Both items are about setting administrative and hearing fees.  In item 5, it allows the Commission to set the fees and in item 9, it allows the Town Manager to set the fees.  After a short discussion, the Commission felt that the Commission should set the fees with the Town Manger’s input.

Town Attorney Guliano stated he would make the necessary changes and will bring it to the Town Council for their consideration on March 3, 2003 meeting.

New Business

Appl. #02-59P – Expo Design Center

Commissioner Kelly asked about the disposition of the lot or lots involved?

Attorney Guliano informed Commission members that this application deals with two lots, one where the building would exist and the other lot is where the detention basin is proposed.  The Town considers these separate lots from the rest of the Evergreen Walk site.

Commissioner Muller asked if there is a bond in place to ensure no problems with the detention basin?  Jeff stated that the bond the Commission sets will be enough to cover any problems, but he would also recommend that it be held for three growing seasons.


Motion to:      move that the Commission find that based upon the record before the Commission, the developers conduct as proposed in this application is not likely to cause unreasonable pollution, impairment or destruction of the public trust in the air, water or other natural resources of this State.

Commissioner Wasik read into the record her comments regarding this application (Attachment A).

Commissioner’s Heffler, Phillips, and Muller all stated that they concurred with comments made by Commissioner Wasik.

Commissioner Kelly stated that she felt there was a lot of good material brought to the Commission from the intervenor, but she did not feel the case was made for unreasonable or exceptional damage.  Commissioner Kelly also stated that some of the material presented did not fall under the IWA/CC jurisdiction.

Motion to:      approve with conditions appl. #02-59P – Expo Design Center – Buckland Road – Inland Wetland/Conservation Commission application to construct a retail building, parking lots, stormwater structures, and associated improvements on property located westerly of Buckland Road, and northerly of Smith Street, GD, Gateway Development zone.

Approval being based upon the following:

Compliance with the regulations of the South Windsor Inland Wetlands Agency/Conservation Commission.
A consideration of the statutory factors contained in C.G.S. section 22a-41.
A finding that no prudent and feasible alternatives exist to the proposed application.


Conditions:

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on February 19, 2008.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

5.      A contact person shall be identified on the plans.

Motion to:      amend the motion to include the following conditions.

Conditions:

The rain gardens shall be constructed with the supervision and installation approved by Dr. Clausen.

A bond in the amount of $20,000 shall be submitted to the Planning & Zoning Commission to ensure compliance with the Erosion and Sedimentation Control Measures.

A bond in the amount of $50,000 shall be submitted to the Planning & zoning Commission to ensure installation and establishment of stormwater structures. The stormwater bond shall be held for three growing seasons.

Permittee shall establish a system to monitor and report on the effectiveness of the stormwater system.  At a minimum, the monitoring shall determine the effectiveness of the rain gardens, the swale, and the detention basin.  Parameters to be monitored shall include, but not be limited to, the effectiveness of infiltration, peak flow control, removal of suspended solids, removal of petroleum hydrocarbons, removal of metals, and the accumulation of transport of metals and hydrocarbons in the soil.

The monitoring program shall start at approximately at the time the business opens.  A soil baseline shall be taken at this time.  A preliminary report shall be issued after one (1) year of monitoring and a final report after three (3) years of monitoring.

The program plan shall be reviewed and approved by the Town Wetlands staff prior to implementation.

Commissioner Wasik asked Commissioner Phillips if the monitoring process put into the conditions is to look for data significant on this project?  Commissioner Phillips explained that it is partly to verify data done elsewhere and to show the effectiveness of this in the soil present and therefore will be useful for future planning.

Commission members then discussed the process of a change order.

Commissioner Wasik suggested that a letter be drafted to the Planning & Zoning Commission expressing the IWA/CC’s desire to have a terraced slope along Buckland Road to allow for plantings of mature trees.

Commissioner Wasik also stated for the record the different changes she has seen on this application.

Previous comments made by Commissioner Wasik (Attachment A) are to be included in this motion.

Commissioner Phillips stated that because of the scrutiny of all parties involved and their concerns for the environment, he feels the Commission has come up with a good system to allow the implementation of this building with proper protection of the environment.  There is the ability to handle potential impacts of any future development subject to successful applications being received.

Commission members stated for the record the number of visits they had to the subject site:

Commissioner Kelly –    two visits to the site with Town staff and one visit on her own.
Commissioner Phillips –         visited the site with Town staff.
Commissioner Heffler –  visited the site with Town staff.
Commissioner Muller –   visited the site with Town staff and one visit on his own.
Commissioner Gates –    visited the site one time on this own.

Commissioner Wasik stated for the record that this is a motion as amended.

ITEM:  Other Business

Jeff presented to the Commission a power point presentation of the open space management plan.

ITEM:  Applications Received

        Appl. #03-08P Podunk Ridge

Jeff explained that the application is a senior residence development.  It is proposing approximately 600 square feet of disturbance to the upland review area.  There are six abutting properties to this site.  Jeff stated he told them in the design stage to keep all activities outside of the 50’ from the top of the slope.

Motion to:      hold a public hearing on March 5, 2003 due to public interest on appl. #03-08P – Podunk Ridge – Ellington Road– Inland Wetland/Conservation Commission application for the construction of a 21-unit Senior Residence Development, community center, stormwater structures, parking and related improvements on property located westerly of Ellington Road and northerly of Ordway Drive, A-20 Residential zone.
