ITEM:  Permit Extension

Charbonneau home 727 Chapel Road, South Windsor,
CT  06074, permit #94-15W.

This permit will expire on April 7, 2002.  They are requesting a three-year extension on this permit.  Commission members discussed this briefly and determined the longest this permit could be extended for would be two years.

ITEM:  Correspondence & Reports

Commission Wasik informed members that she has advocated for a funding initiative on behalf of the County Conservation Districts.

Chairperson Warren told Commission members that The Connecticut River Watershed Council would be celebrating their 50th anniversary by co-sponsoring The Great Connecticut River Fish-In on June 1, 2002.  They are requesting a donation from this Commission.

A memo from Matthew Galligan, Town Manager was received.  The memo was regarding a Municipal Development project in the I-291 Corridor.  The Town Manager would like each Commission to look at the plan and comment as a unit.

Appl. #02-02W Clark Realty

Ms. Karen Isherwood from Design Professionals came before the Commission to represent this application.  She explained that she is before the Commission to request that a berm placed in the regulated area be allowed to stay as it has been planted.  The disturbance is 21,000-sq. ft. of upland review area, .25 acres of wetlands have been filled in.  The berm provides a visual and noise barrier for the residential area.  A letter from John Ianni was submitted to the Commission.  It stated that the wetlands between the barn foundation does not meet the vegetative criteria for inclusion as Jurisdiction Wetlands on the federal level but does meet the State criteria for soil type.  As mitigation for this disturbance, the applicant is offering 1.03 acres of open space (donated by Pond Estates), and extensive wildlife plantings.

Mr. Pawlak from Connecticut EcoSystems came before the Commission.  He explained that for the proposed plantings he has chosen species that will provide habitat value.  Jeff felt that Mr. Pawlak

Mr. Richard Sietz of 112 Gilbert Lane came before the Commission to speak in favor of this appeal.  He felt there are many benefits of this berm such as a safety for children, visual barrier and a noise barrier.



Mr. Mark Hagen of 128 Gilbert Lane stated he is in favor of keeping this berm.  It blocks site and sound from the mall.

No one from the public spoke in opposition to this appeal.

Commissioner Heffler felt at this point it would be detrimental to this area to remove the berm.

Commissioner Wasik agreed with Commissioner Hefflers statement, but is very upset about the disturbance happening in the first place without a permit.

Commissioner Nicholson felt there would be more damage done if the berm were removed.  He also stated he would like IWA/CC to consider penalties for disturbance of wetlands during the construction process of subdivisions.

Jeff concurred with the Commission saying that if the berm were removed, the area may not continue to function as a wetland anyway.

Conditions:

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on April 3, 2007.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

5.      A contact person shall be identified on the plans.

Stabilize the south side of the berm with a legume seed mix and ground cover.

Erosion control blankets and topsoil to be used on the slope.

We recommend a bond in the amount of $25,000 be submitted to the Planning & Zoning Commission to ensure establishments of the plantings being used as mitigation and the transfer of 1.03 acres to the South Windsor Land Trust 30 days from the time of this approval.

Any large debris on the 1.03 acres to be removed, subject to staff inspections.


ITEM:  New Business

Appl. #02-08P Pine Woods Subdivision

Mr. Sands Aeschliman came before the Commission to represent this application.  He explained that this request would consist of a 3-lot subdivision.  The subdivision will be on septic systems and wells.  This proposal will have no disturbance to wetlands or the upland review area.

Answering questions from the Commission, Mr. Aeschliman explained that the curtain drains have been relocated because the Town Engineer was concerned that the water would bleed out to the road.  While clearing is done, there will be an attempt to keep as many trees as possible.

Commissioner Kelly suggested to the applicant that they should install erosion control measures prior to clearing.

Jeff told Commission members that statements could be put on the deed to let potential buyers know that their lot contains upland review area.

Ms. Karen Isherwood from Design Professionals came before the Commission to represent this application.  Ms. Isherwood explained that this project would consist of two phases.  The first phase would consist of a 50

Answering questions from the Commission, Ms. Isherwood explained that the impervious coverage on the site is 49.4% after both phases are complete.  The business has been in operation since 1980 and with both phases complete  there would be no additional discharge from this site.  The State of Connecticut, Department of Environmental Protection and Department of Transportation will both be checking on all of the levels.

Ms. Isherwood stated she has received comments from Jeff and the Town Engineer, which will be incorporated into the plan.

Public Hearing continued until April 17, 2002.

ITEM:  Old Business

Chairperson Warren said that the Commission has received two memos from the Town Attorney.  The first memo states that if the Commission approved this application the lots would be conceived as buildable lots (Attachment C).  The second memo explains the different options that are available for this Commission (Attachment D).

Commission Forzley could not come to the meeting tonight.  He sent a memo that expresses his concerns with this application.  The memo was read into the record (Attachment E).

Commission members discussed this application at length.  There was a unanimous concern that the proposed lot configuration would lend to unacceptable disturbances to wetlands when some of the lots were developed.  It was a general consensus that it would be in the best interest of this Commission to deny this application.  This would allow the applicant time to reconfigure the subdivision and come back with a new application.  

Mr. Peter DeMallie from Design Professionals presented a letter from the applicant withdrawing this application.
