It was the general consensus of the Commission to approve the January 3, 2001

Mr. Krawski had until February 5, 2001 to respond to a cease and desist order. There has been no response, legal action will now be taken.

Appl. #00-61P – Michael Lanza, Lanza Re-subdivision, RR Open Space zone.
Abutter letters had not been sent out. This application will be heard at the February 21, 2001 meeting.

Discussion of Addington investigatory letter
Mr. Addington came before the Commission and explained that he has tried to repair areas near the Connecticut River because there has been erosion
problems continually on the river banks. 4-6’ of land has been lost per year.
After a lengthy discussion, it was the general consensus of the Commission to require no remediation for the present disturbance that has taken place. The Commission did inform Mr. Addington that any further land activities he would like to do on this property would require consultation with the Commission first.
Discussion of conservation easements and open space acquisitions
Town Attorney Barry Guliano came before the Commission to present a draft of an ordinance regarding acquisition of conservation easements and open space properties. He explained that he would be presenting this ordinance to this Commission, The Planning & Zoning Commission, and Open Space Task Force. He would like to get each Commissions input. Town Attorney Barry Guliano reviewed the entire document with the Commission.
Commission members discussed this process at length, and had concerns that this ordinance would slow the application process down. It was decided that the Commission would review this document further and meet at a later date with any questions.
The Town Attorney was asked to gather information on the following issues:
How surrounding Town Halls handle conservation easements.
See if the Town Council has the authority to delegate the power for accepting conservation easements to be handled by Inland Wetlands Agency.
If there has been any successful challenges from other surrounding Town Councils overruling a conservation easement that has been asked for by an Inland Wetlands Agency.
