Chairman Carino called the meeting to order at 7:09 p.m.  The following actions were taken during the October 2, 2007 Regular Meeting of the W.P.C.A.

B.      ACCEPTANCE OF MINUTES OF PREVIOUS MEETING

Mr. Carino stated that he did not have a chance to review the minutes; therefore, he suggested to postpone the approval.

Motion to postpone the approval of minutes for the September 4, 2007 Regular Meeting.

C.      NEW BUSINESS

The person representing Item C1 was not in attendance at this time; therefore, Chairman Carino suggested moving to Item C2 on the agenda.

        2.      75 Valley View Drive - (Approval to Connect)

Mr. Shaw gave opening remarks and explained that this property is located at 75 Valley View Drive.  A lateral was provided for this house on Valley View Drive in a way that the property owner would have to pump up to the sewer, and that the force main would have to be located close to the corner of the house and the property line.

Mr. James Throwe was in attendance on behalf of the property owner.  He reported that the property owner would have to pump up to the sewer, however, the property owner does not want to pump; therefore, he is proposing to go into the manhole located on Norman Drive.

Mr. Shaw stated that system might require for a cleanout, and Mr. Throwe will provide details once he takes out a permit from the Engineering Department.

Motion to approve the application as presented for connection to the Town's sewerage system for residential home located at 75 Valley View Drive, South Windsor; connection to a manhole at station 11+81.84 on Norman Drive as more specifically shown on plans entitled: "Sanitary Sewer Construction, Birch Hill Area, South Windsor, CT - Norman Drive Sta. 7+00 to Sta. 11+81.84", Designed by James S. Minges & Associates, Inc., Farmington, CT."; Drawing No.: 18-G, Comm. No.: 208-7G; Dated 6-12-73."  This approval was subject to final technical approval of the Town of South Windsor Engineering Department.

        1.      1359 Main Street - (Approval to Connect)

Mr. John Jacques was in attendance for this application.  He made a correction on the agenda; the actual address is 1359 Main Street, not 1371 Main Street.

This is a proposed building with an existing lateral coming off the main and because of the pitch they are proposing to use a grinder pump and put in a pump station.

Mr. Havens, Jr. asked if there is any right of way required for this property.  Mr. Jacques responded no because is going across their front yard; there is 140 feet of frontage.

Motion to approve the application as presented for connection to the Town's sewerage system for proposed residential home located at 1359 Main Street, South Windsor, as more specifically shown on plans entitled "Jacques, 1371 - 1375 Main Street, South Windsor, CT" Prepared by Design Professionals, South Windsor, CT; Sheet No.: 1 of 1, "Plot Plan, Job NO.: 2464, Drawing No.: JOBS\2464\2464_BASE.DWG, Dated: 7/3/07, Revision date:  9/18/07."  This approval is subject to providing an external electrical outlet with proper transfer switch meeting all appropriate code requirements for the purpose of providing auxiliary power (generator).

        3.       FOG Compliance Report

Mr. Shaw gave opening remarks and reported on the FOG Program and compliance for the requirements to switch over from an old ineffective passive inside interceptor to a more effective passive interceptor.  The Authority has adopted the regulations and the people need to comply with the new regulation.  In July 2007, a letter which outlined the elements of the new FOG regulation program was mailed to business owners, along with a guidance manual.  The letter explained that they have two months to comply.  Also the letter stated that if they had any questions of if they wanted to request an extension of time they were to contact Mr. Shaw.  Soon after September 11th, Mr. Shaw conducted inspections to find out the status of each of these businesses.  He explained to the property owners that this is a regulation and they are in violation of the regulations.

Mr. Shaw presented a list (see Exhibit A) of 22 food processing facilities in Town which did not have an approved grease interceptor in place.  None of these facilities were in compliance for September 11th.  Mr. Shaw explained to them that if they needed an extension of time that they should request an extension and to provide a schedule for compliance.  These facilities have requested an extension, some of them with schedule for compliance and other without any schedule.  The Authority needs to make a decision as to whether or not they want to grant these extensions and how much further time to allow for compliance.  Mr. Shaw also reported that he contacted the South Windsor Chamber of Commerce to ask for some assistance from Chamber members who might be willing to sit down and answer questions from the restaurant owners.

Answering question from Chairman Carino, Mr. Shaw responded that the State regulations says that people will be in compliance as of July 1, 2011, unless there was a problem.  However, the WPCA has chosen a July 1, 2009 but again there is a grease recovery problem now at the treatment plant, therefore; these facilities have to be in compliance now.

Chairman Carino suggested asking the Town Attorney if the Authority may assessment penalty fees against those business owners who fail to meet the schedule for compliance.

Mr. Ferrero suggested making a motion that for those that provided a specific date, grant them an extension until October 31, 2007 and if they complete their work by that specific date, fines would be waived; however, if they fail to complete the work the fines would be retroactive.

Chairman Carino was concerned about the fact that these people were supposed to comply by September 11th and they didn't.  Now, they asked for an extension and the Authority has not responded to their request.  Therefore, he wants the Town Attorney to be asked what are the chances of trying to get these people to pay the fines when an

extension was requested and not answered.  Mr. Shaw explained that their request is late; it was not within the two months period that they were asked to be in compliance.  

With no further questions, Mr. Ferrero made the following motions.

Motion to have Fred Shaw send a letter granting extension requests to those businesses that requested an extension with a specific schedule in mind with provision that if they are in compliance by the extension deadline, all penalties will be waived, but failure to comply by extension date will accrue a daily fee starting on September 11, 2007 to date of compliance.

Motion to have Fred Shaw send a letter to those businesses that requested an extension without a specific schedule granting a 45 day extension starting from the date of letter with proviso that if they are in compliance by the extension deadline, all fees will be waived, but failure to comply by extension date will accrue a daily fee starting on September 11, 2007 to date of compliance.

        4.      Lawrence Road Sewer Extension - (Schedule Public Hearing/Meeting with residents)

A brief discussion ensued regarding the Lawrence Road Sewer Extension.  Mr. Shaw provided to the Authority with a copy of a memo sent by Town Engineer, Jeffrey B. Doolittle (see Exhibit B).  In this memo, Mr. Doolittle provides an estimate of the price to do the survey work necessary to design the sewers on Lawrence Road and an estimate for soil borings.  Mr. Shaw recommended using some of the funds from a Capital Project for this purpose.

It is the consensus of the Authority the use of funds for Inflow/Infiltration and Manhole Rehabilitation will be contingent upon engineering using all available technical data involving borings and surveys performed in the area where sewers are currently located.

Also, it is the consensus of the Commission that a public meeting be scheduled to discuss concerns and road improvements with the Lawrence Road residents at the next meeting on November 7, 2007 if possible or otherwise, a meeting date to be held when Town staff is available.

        5.      Water Pollution Control Facility Improvements (Schedule Public Hearing with Town Council for presentation of improvements)

Discussion ensued among the Authority about setting a date to meet with Town Council regarding the WPCA Treatment Plant upgrade.  Shaw stated that he would talk with the Town Manager to get a more clear date for the meeting.

D.      COMMUNICATIONS AND REPORTS

Mr. Shaw reported that he has two applications pending for the expansion of the Water Pollution Control Facility. One application is for Zoning Board of Appeals and one for Inland Wetlands/Conservation Commission.    The Zoning Board of Appeals application will be discussed on Thursday, October 4, 2007.  And the Inland Wetland/Conservation Commission application will be discussed on Wednesday, October 17, 2007.  He also will be filing an application for the Planning & Zoning Commission.

Chairman Carino stated that he received a letter from the Town Manager.  The letter stated that the Town Manager received a letter from Bonnie Rabin, Tax Collector regarding a change in the procedure for liening property for unpaid taxes, or sewer assessments.
