CALL TO ORDER
Chairman Carino called the meeting to order at 7:32.  Mr. Dickinson asked to leave, as there was a quorum for this meeting, to attend another meeting.


ACCEPTANCE OF MINUTES OF PREVIOUS MEETINGS

July 22, 2003 and September 2, 2003

Chairman Carino asked the Authority to delay approval of the minutes of July 22, 2003 due to the fact the Town Attorney has been out ill and therefore has not had the opportunity to review the wording in the approval for the ownership of the sewer lines that will be located on the property within the Evergreen Walk development, these sewer lines are not a part of the Gateway Sewer trunkline.  There was a general consensus the Town should take over ownership of the trunkline only to allow for expansion on the east side of Buckland Road, but not be responsible for the laterals or sewer lines located on the private property.

Approval of the minutes of September 2, 2003 was also postponed until Mr. Shaw has the opportunity to report to the Authority the percentage of the total new connections to the sewer line, for the past year, that are the result of new construction.

NEW BUSINESS

REVIEW AND APPROVAL OF W.P.C.A. CALENDAR FOR 2004

Chairman Carino asked the members to review the calendar, mailed out with the agenda. He explained the need for a floating meeting in July, which will be scheduled at the June meeting.  This is to accommodate the needs of developers and other parties who would suffer a hardship if asked to postpone their request for approval until the authority meets in September.  There is no W.P.C.A. meeting during the month of August.
Motion was made to approve the W.P.C.A. calendar for 2004.

APPROVAL OF ANNUAL REPORT

Chairman Carino asked to have several changes made to the Annual Report. The changes are as follows:
        
Addition to paragraph one - a sentence stating the WPCA was established in 1996 and was known as the Sewer Commission.  Also, the addition of the Connecticut General Statues number (103), and the Town Ordinance
                Numbers 103 & 150.

                Under section entitled “Project Approvals”, paragraph 3, Chairman Carino
                requested a sentence be added stating the trunk line sewer to be installed
for the Evergreen Walk area will also have the capability to service the east side of Buckland Road for future development.

A copy of the revised Annual Report will be sent to all the members.
Motion was made to give conditional approval for the 2003 Annual report subject to the modifications to paragraph one and clarification of the total Gateway Commercial Zone in paragraph 3, as shown above. The revised Annual Report will receive final approval, for the record, at the next monthly meeting.

At this point Chairman Carino asked that a motion be made to move Items C5, C3 and C4 ahead of Item C1 on the Agenda, due to the fact Mr. Shaw was unavailable until later in the meeting.

DEVELOPERS AGREEMENT – REVIEW AND APPROVAL

The purpose of the Developers Agreement is to allow a developer to move ahead and recoup some of the expenses involved in connecting area property owners to
the sewer line at the time of development. The residents are encouraged to connect to the sewer at the time the developer is installing the line to the adjoining property.  Laterals are provided to all the homeowners within a specified area to allow for the connection to the Town sewer line if the resident so desires.  The Authority was sent a “Draft” copy of the Developers Agreement, for RSK-Kellco project,  to review and make any changes necessary. This agreement gives the developer the right to collect the connection fees for

a period of up to 10 years.  Mr. Moriarty noted on page 3 the amount of liability insurance coverage for personal injury appeared to be excessive.  He went on to say in previous agreements the amount was usually not as high as shown on this agreement and felt $500,000/$100,000,000 was a typographical error. The amount will be reviewed and the correct amount will be entered in the document.  Mr. Moriarty also stated in the conditional approval given to the project previously, the Town has given notification to the adjoining property owners on Ellington Road informing them they have the opportunity to connect to the sewer at this time.  The letters were sent to the 5 residents involved.  It was stated this request did not need to be included in the Developers Agreement, sending the letters is a courtesy the Town affords the residents who will be able to connect.  
Motion was made to approve the Developers Agreement between the Town of South Windsor and RSK-Kellco with the condition the liability amounts on page 3 be verified and changed.

GERICH RESUBDIVISION PLAN – ELLINGTON ROAD – Approval to Connect

Galen Semprebon, Design Professionals, Inc. was present on behalf of the developer seeking approval for connection to the Town sewerage system for a residential unit on Ellington Road.  The property owned by Mr. Gerich was recently subdivided and a lot was created to allow his daughter to build a house.  This will be a straightforward sewer connection with a 2% slope and clean-outs located every 100-ft.  This project has been approved by the Planning & Zoning Commission and has been reviewed by Mr. Shaw and the Town Engineer.

Mr. Shaw arrived at 8:30.

Chairman Carino briefly explained the changes approved for the Annual Report, as shown above, to Mr. Shaw.  

The approval for the connection of the property on Ellington Road was made at this time.

Motion was made to approve the application of Laura J. Gerich for connection to the Town’s sewerage system for a residence to be located at 1457 Ellington Road, South Windsor, Connecticut, as more specifically shown on plans prepared by Design Professionals, Inc., South Windsor, Connecticut and more specifically shown on Drawing
No. 3, entitled “Topographic Plan/Sedimentation & Erosion Control Plan”, prepared for Elizabeth & Laura Gerich, Job No. 1423; Dated July 22, 2003 with one revision dated
9-3-03 and subject to the final technical approval of the Town of South Windsor Engineering Department.
        Motion was made by Ms. Fletterick

SOUTH WINDSOR TECHNOLOGY CENTER – Approval to Connect

Mr. Shaw explained the project will be a commercial technology center located south off Sullivan Avenue. This project was before the Authority previously and obtained conditional approval pending changes requested by Mr. Shaw and the Engineering Department.  The changes requested by the Town have been made engineering firm.  

Galen Semprebon, Design Professionals, Inc. was present on behalf of South Windsor Technologies to obtain final approval for connection to the Towns sewerage system of an industrial area to be located off Sullivan Avenue, South Windsor, Connecticut. The necessary changes have been made and the developer is seeking final approval in order to obtain the necessary easements from property owners and approval from the ACOE.  This will be a straightforward connection with clean-outs every 100 ft., it will be a gravity flow line with a 12” pipe to the pump station on Route 5.  The developer of the property must obtain all the necessary approvals, at that time he will be able to secure the easements, which have been given in principal.  Additional revisions have been made in the area of the railroad crossing, and an easement will be obtained from Full Line Auto in order to connect to the sewer on Route 5.

Mr. Shaw went on to explain the line must be served by the pump station on Route 5, originally the developer proposed a pump station located on the property.  This request was rejected, as it would require the Town to take over and be responsible for another pump station. The engineer has provided information concerning analysis of flow that could be anticipated under the current zoning.  The pumping station does have sufficient capacity at this time to handle this development, under the assumptions provided by Design Professionals.  If one business were to move in with a high process flow the pump station may require upgrading.  Mr. Shaw recommends dealing with a high process flow if and when the situation were to arisein the future.  If this does occur the user will be required to make certain improvements to the pump station in order to serve them.  
There was some question as to how the upgrade of the pump station would be paid for in the event there would be a high process flow and the upgrade would be required.  The

connection charge which is paid at the time the permit is issued, placed in the Capital Reserve Fund to be held for the purpose of capital improvements which may involve upgrading of the pump station equipment.  This can be done as a system wide cost; the developers are providing connection charges for improvements that may be required in the future.  In the past this has been handled as a system wide cost.  Chairman Carino felt this could not be handled on an individual basis.  All the parcels would be required to contribute to the upgrade of a pump station if the need were to arise.  Mr. Moriarty stated the individual business is and should be assessed on its own merits at the time of development.  Mr. Moriarty further stated there are already existing guidelines to handle these situations if they should arise.  

Chairman Carino asked what the engineer would do if there were changes to be made after the project is approved by the W.P.C.A.  Mr. Semprebon responded the developer must return to the Town for final approval once the property is purchased and easements have been granted, before they can proceed to construction.  In the final review the Town staff must sign off on any and all changes that must be made.  It would not be necessary to return to the W.P.C.A. unless substantive changes to the sewer connection are necessary.  Mr. Semprebon explained some of the changes that were addressed, the first involving sanitary manholes number 22 to 25 must be gasketed, and have bolted down covers in accordance with Town standards.  By request of the Town Engineer ¾” stone will be installed to increase the level of the elevation of natural sandy material in the location to be determined by the Town Engineer.  This would allow for a more stable bedding surface in the trench in the event of wet conditions.  

Chairman Carino asked if there were guidelines used to determine what the Town staff considers a minor technical change and what types of changes would require the W.P.C.A.’s attention.  Chairman Carino requested a copy of the guidelines used by the Town staff and requested a copy be sent to all members with next month’s agenda.  Mr. Shaw said he would see that copies were sent out next month.
Motion was made to approve the connection for a commercial development to the Town’s sewerage system by South Windsor Technologies Center, South Windsor, Connecticut, to be located off Sullivan Avenue, as more specifically shown of plans entitled “Patria Road Profile”, prepared by Design Professionals, Inc., South Windsor, Connecticut, as shown on Drawing No. 34, Job No. 1253, Dated November, 2000, with revisions dated 1-08-02, 2-12-02, 4-11-02, 7-15-02, 7-08-03, 9-23-03 and Drawing No. 34A, Job. No. 1253, Dated July 8, 2003, with revisions dated 9-23-03, 9-30-03, 10-6-03, 10-7-03 and subject to the final technical approval of the Town of South Windsor Engineering Department.

There was further discussion regarding the Developers Agreement between the Town and RSK-Kellco.  Chairman Carino explained to Mr. Shaw that the Developers Agreement was reviewed and approved with the condition the amount of insurance be verified and changed.  Mr. Shaw stated letters were sent to the residents notifying them of their opportunity to connect to the sewer on Ellington Road.  The developer will be installing laterals to these properties.  The residents are not required to connect at this time, but would be in their best interest to do so at this time.  In the future if the resident decides to connect, within a 10 year period, the resident will be required to make their arrangements with the contractor, in this case RSK-Kellco, for payment.  There were several changes Mr. Shaw wanted to make to the draft agreement, on page one the property is located on the west side of Ellington Road, not the east side as written.  The third “Whereas” paragraph referenced the distance of 410 feet, the developer stated this distance is  actually 300 feet.  On the second page under “NOW THEREFORE,” it was also written the easterly side of Ellington Road and should read the westerly side.  On page three the amount should read $1,000,000 and also on page three, item 4, the paragraph indicating a bond in the amount of $50,000 could be removed, the project is 99% complete and Mr. Shaw felt it was not necessary to require this bond.  After some discussion the Authority decided to leave the paragraph regarding the bond as it appears.
Motion was made to rescind the previous approval given for the Developers Agreement.

Motion was made to give conditional approval to the Developers Agreement subject to the changes stated above and that a review and approval be made by the Town Attorney.  The Authority also gave the Chairman the authority to sign the document without returning to the WPCA if no further changes are necessary.

COMMUNICATION AND REPORTS

I-291 CORRIDOR DEVELOPMENT PROJECT

Mr. Shaw advised the Authority the Town has received a grant to provide utilities for the I-291 Corridor (See Attachment A).  The project is to be monitored by the DECD.  An engineering firm has been selected for the design of the utilities in this area, to maximize the use of the money available.  There was an issue that the Town may have to do a SEPA study, which is a very expensive environmental study before funds would be granted.  The Town Manager and others are working with the DECD to resolve this issue.

The original application provided a completion date of December 31, 2004 so it is imperative the engineer begin his work as soon as possible.

PLEASANT VALLEY PUMP STATION UPGRADE

This project is on hold awaiting approval from the State for a low interest loan.  We are currently waiting for the bond commission to put this item on their agenda.  The contractor has agreed to extend his bid price until November 10, 2003.  If we are not on the agenda Mr. Shaw will write a letter requesting this project be moved forward as soon as possible.

SUBMERSIBLE PUMP STATION UPGRADE

The firm of Weston & Sampson has been selected to do the design phase for this project.  This firm has also been selected to do the upgrade of the other four pump stations.  Funding has not been approved for the project at this time; it will be included in next year’s budget.

PUMP STATION ALARM (SCADA) – Monitoring Project

The firm of Woodard & Curran has been selected for this project.  It involves telemetry conveyance of monitoring equipment that would report the operation status of the pump stations back to a main command center.  This project will also need to be coordinated with the upgrading of the pump stations, which will go out to bid in March 2004.  

GATEWAY TRUNK SEWER – Inland/Wetland Approval

The Gateway Trunk Sewer has been approved by the Inland/Wetlands Commission.

Chairman Carino explained to Mr. Shaw approval of the minutes for July 22, 2003 and September 2, 2003 was postponed in order for the Authority to have the information presented that they had previously requested.  The first question regarded what portion of the trunk sewer line the Town agreed to take responsibility for in the Evergreen Walk development.  Since the Town Attorney has been out ill Mr. Shaw has not been able to review this matter with him.  

The other issue regarded the percentage of new sewer connections to new homes.

RESIDENTIAL UNITS ON DEMING STREET – BILLED UNDER A DIFFERENT STREET NUMBER    

It has recently come to the attention of the tax collector that 3 residential units on Deming Street in Manchester, were eliminated when the Gateway Mall was constructed.  These units were required to be taken off the residential billing list, but were listed under  different street numbers, which the tax collector uses for billing of out of town property.  Three bills were sent to the following houses which no longer exist:

        List # 32268                    155 Deming Street
        List # 30750                    173 Deming Street
        List # 30751                    163 Deming Street

These properties are no longer residential units and Mr. Shaw is looking for approval to remove them from the residential billing list.  It was necessary at this time to move this item onto the agenda for approval to be made.
