CALL TO ORDER

Chairperson Carino called the meeting to order at 7:30 p.m.

Chairperson Carino appointed Mr. Havens to replace Mr. Aries as a voting member, due to the absence of Mr. Aries.

ACCEPTANCE OF MINUTES OF PREVIOUS MEETINGS

It was noted Mr. Hindson was incorrectly listed as Chairman in the minutes of February 8, 2002, this has been corrected. Also on page 1 under acceptance of minutes the wording

New Business, Continued

Motion was made to approve the application of Design Professionals, Inc. for connection to the Town sewerage system of 10 residential lots in the subdivision, known as Pond Estates at Red Rock, Section 7, located at Deming Street and Slater Street, South Windsor, CT in accordance with Drawing No. 6/10, entitled

DST OUTPUT
Galen Semprebon from Design Professionals, Inc. was present to seek approval for connection to the existing sewer line for an addition of 108,000 sq. ft. to the existing building.  The present service will be maintained, a second lateral will be constructed at the sight to connect to the present system.  There will be a small lateral running from the generator building back into the existing building.  
Motion to approve the application of DST Output for connection of laterals to the existing approved internal system, to accommodate an addition and generator building located at 125 Ellington Road, South Windsor, CT in accordance with Drawing 10/13, entitled

STONE CROSSING SUBDIVISION (Approval to Connect)

Mr. Mannarino representing Mannarino Builders was present to request approval for connection to the Town sewerage system for 2 phases of a residential subdivision known as Stone Crossing, located to the east side of Avery Street.  Six lots, numbered 2 through 7, will have low pressure pumping systems located outside of each house.  This system will pump out to the force main and then to the gravity line in Cornerstone Dr., this line flows to Overbrook Dr. and into the Town of Vernon sewerage system.  This plan has been reviewed and approved by the Town of Vernon.  Connection and assessment charges will be paid to South Windsor and forwarded to Vernon.  There was a discussion regarding the low-pressure system technology; Mr. Shaw stated this technology has been used successfully. Mr. Shaw and the Town Engineer will review the detail plans for the

low pressure pump station, their review and acceptance will be a condition of final approval.  The matter of an external outlet was also discussed; this is required to provide auxiliary power in the case of a power failure. At this time Mr. Shaw stated he has contacted the Town of Vernon for a letter stating the connection and assessment charges, this information has not been received at this time, but the amounts will be stated in the approval letter..
Motion to approve the connection of phase 1 and phase 2 of a residential subdivision known as Stone Crossing, located on the east side of Avery Street as shown on drawing entitled

GATEWAY PLAZA, INC. (Approval to Connect)

Patrick O4 homes has been deducted from this connection fee.  There will be a minimum amount of flow from the retail stores, approximately 900 gallons per day, the restaurant will have approximately 4500 gallons per day. There will be 2 grease interceptors in the restaurant which is located in the plaza as a separate building.  Mr. Carino asked Mr. Shaw to provide the Authority with the amount of intake and what the inter-town agreement states is acceptable, where we are in terms of the maximum amount.

Motion to approve the application of Gateway Plaza, LLC for connection to the Towns sewerage system for a proposed retail development located on Deming Street, Manchester, CT, in accordance with Drawing No. C-4, entitled connection charge in the amount of $15,960 be paid at the time the permit is issued; subject to the technical approval of the Town of South Windsor Engineering Department.
        Motion was made by Mr. Havens
        Seconded by Ms. Fletterick
        The motion carried unanimously

At this point Mr. Paul Burnham, liaison from the Town Council was introduced to the Authority by Chairperson Carino.

INDUSTRIAL/COMMERCIAL SEWER USER CHARGES
Mr. Shaw sent to all the members, with the agenda, a copy of the proposed Industrial/Commercial Sewer User Billing List.  An increase in flows of 28.7% was noted, as was an increase in revenues by 30.8%.  These figures represent the increase of commercial property and a growth in the commercial area over the past year.  
Motion was made to accept the FY 2001/2002 Industrial/Commercial Sewer User Billing List subject to any adjustments that the facts would dictate.

Town Attorney Guliano arrived for Unfinished Business discussion.

COMMUNICATIONS AND REPORTS

Chairperson Carino stated he had received a letter from Tom Hindson stating his decision to resign from the Authority effective March 1, 2002.  Chairperson Carino passed out a letter for the members review that he would like to send Mr. Hindson.  The Authority reviewed the letter and approved it for mailing to Mr. Hindson.

Communication and Reports, Continued

Chairperson Carino reported he has met with Mr. Shaw, Marcia Banach and the Town Clerk regarding the proper handling of easements.  There is a sample easement that was drawn up by a previous Town Attorney.  Mr. Carino felt this sample does not address the subject of private easements between individuals.  He felt these were not reviewed or approved by anyone in the Town.  Mr. Shaw stated the Planning Department works as a clearinghouse for the review of easements.  If the easement does not conform with the standard it is forwarded to the Town Attorney for review and approval.

Chairperson Carino also made a comment to the Authority with regards to an article in the Journal Inquirer, dated March 5, 2002 regarding a statement by the Director of Planning, Marcia Banach.  Ms. Banach was quoted as saying

UNFINISHED BUSINESS

735 John Fitch Blvd.
Town Attorney Barry Guliano was present to review the Draft Ordinance (Attachment B) the Authority requested be drawn up, regarding the refund of sewer user fees for the above-mentioned property.  The discussion followed with Chairperson Carino stating he is opposed to this Ordinance being proposed to the Town Council, he felt that this is a single incident of a resident paying for a sewer connection that does not exist. He felt there is no other town in the state that has adopted an ordinance of this type.  If you discover a problem exists within 3 years a resident has the right to go back to the Town and request a refund.  Town Attorney Guliano stated the legislature set a time frame of 3 years, but left the power to the municipality to change the time limit by adopting an ordinance.  Discussion followed regarding the options available to the Town.  It was agreed to leave the statute as it stands, the recommendation was made to not pursue adoption of this ordinance.
Motion was made to let the statute stand and approve the refund to the property owner at 735 John Fitch Blvd. for the 3 years allowed by law.
