CALL TO ORDER

Chairman Hindson called the meeting to order at 7:30 p.m.

ACCEPTANCE OF MINUTES OF PREVIOUS MEETINGS

July 31, 2001

Motion to approve the June 5, 2001 minutes as submitted

NEVERS BALL PARK
Mr. Havens abstained from participating in the discussion and vote regarding approval for the connection of a lavatory to be located in the press box at Nevers Ball Park.  Galen Semprbon, Design Professionals, Inc. was present to obtain approval for a lavatory connection at the Press Box located at the Nevers Ball Park and its

Motion to approve the application for a lavatory at Nevers Ball Field by Design Professional for connection to the Towns sewerage system as shown on drawing entitled

STRAWBERRY FIELDS (approval to connect)
Galen Semprebon, Design Professionals, Inc. was present on behalf of Sullivan Town Homes, LLC to obtain approval to connect to the Town sewerage system for an elderly condominium complex to be located on Sullivan Avenue, South Windsor, CT. Mr. Semprebon was before the authority on December 5, 2000 seeking conceptual approval. At this point in time suggestions made by the authority have been made and they are now seeking final approval. The development will consist of 43 upscale senior residence condominiums, and will maintain a private pump station to a force main into the Town sewer line located on Sullivan Avenue.  The access road has been redesigned and easement from the Town has been obtained to provide access via the open space area to the south of the property, in exchange the project donated a total of 40 additional acres open space to combined with this property.  They are proposing an internal gravity sewer system that would drain to a private pump station and via force main would discharge up to Sullivan Avenue.  An extension of the sewer line in Sullivan Avenue is being proposed up one man hole where force main would then discharge.  Service would also be provided to property along Sullivan Avenue, #1156 and #1148 would be tied into the sewer line as part of initial construction; a lateral would be provided for #1164, also as part of this proposal the property adjoining this development, known as the Gelingas property would be tied into the private internal system via an easement to provide all necessary rights of discharge.  Each building will have a lateral to the street and a minimum 2% grade will be standard.  The private pump station on this property will have a back up generator in case of power failure.

Mr. Shaw brought up the issue of providing a profile on the main line sewer proposed to go down Sullivan Avenue, field measurements have to be taken to confirm the elevations and provide the Town with at least the minimum slope needed.  Mr. Shaw
Motion to approve the application of Sullivan Town Homes, L.L.C. for an elderly condominium complex as shown on drawing entitled Town Attorney approval of the two necessary easements be obtained, one from the Town and one from the private property owner involved, the profile and final review will be subject to the technical approval of the Town of South Windsor Engineering Department.

DEMING HILL ESTATES -Revision of Section 6 (approval to connect)
Galen Semprebon from Design Professionals, Inc. was present on behalf of Clark Realty, Inc. to present a revised application for connection to the Town sewerage system of a residential subdivision entitled Deming Hills Estates, Section 6. Mr. Shaw stated that approval for this connection was originally given at the June 5, 2001 regular meeting of the WPCA. Design Professionals is presenting a change in the direction of the sewer line that ran through the wetlands area to Manchester, the change would put the line running east to the site of Pond Estates at Red Rock. The Pond Estates at Red Rock area was previously approved by the authority. The line would be lowered to make to provide service to the Deming Hill Estates subdivision and also the Pond Estates at Red Rock area.  Mr. Shaw stated there was only one concern by the Town Engineering Department and that was the fact there was a large amount of ledge in the area and putting the line at 4/10th of 1% means that installation must be done correctly as there is no room for error.

VETERANS MEMORIAL PARK IMPROVEMENT PROJECT
Mr. Shaw explained that the improvements to the existing pool are a Town project.  The project involves a force main, which goes to a septic tank, this is the back flush for the pool filters, and there is still a need for this.  It has also become necessary to put in restroom facilities with a gravity feed line, which connects to the sewer line on Pleasant Valley Rd. There will also be two additional manholes installed.

Mr. Shaw passed out to the authority a history of sewer user charge payments (See Attachment A) made by the property owner. This matter had been brought up at the last meeting of the authority on June 5, 2001.  He noted that no payments have been made since 1996, the current property owner has owned the property since 1984.  Mr. Shaw also told the authority he had obtained information from Mr. Moniz regarding a state statutes that states

the Town can not go back more than three (3) years for a refund.  It does give the Municipality the opportunity by ordinance to establish a longer period of time to go back.  Mr. Shaw stated that if the authority did feel the property owner was entitled to a refund of the money paid for services he did not receive, the Town Attorney has stated the authority can go back to the Town Council and request an ordinance that would allow the WPCA to go back and refund this property owner.  The ordinance can be structured as such to put a limit on the amount of time the authority would go back for a refund. Mr. Carino felt it would be in the best interest of the authority to table this matter until the next meeting in order to give everyone the opportunity to read the information provided.  He stated it would be necessary to come up with a presentation for the Town Council in order to support the position of obtaining an ordinance. The Town Attorney will be asked to provide several different alternatives regarding this matter. Mr. Shaw will speak to the Town Manager and get feed back regarding the feeling the Town Council would have regarding an ordinance.

COMMUNICATIONS AND REPORTS
Mr. Carino brought before the authority the subject of attendance, which was discussed at the last meeting on June 5, 2001, he was discouraged by the comments made and felt there was a misunderstanding by the alternates regarding their responsibility to attend monthly meetings. Mr. Carino read from the Town Charter  which states the Council can remove any member of a board, commission or committee appointed by it if such member is absent himself of all meetings of his board, commission or committee for a period of three consecutive months. He felt the misconception is that the Charter was meant to separate members from alternates and it is his belief that the Charter did not intend to be interpreted in this way.  There are boards and commissions, which state in their bylaws, it is a requirement alternates attend one meeting each quarter.  Mr. Carino requested an item be included on the agenda of the September 4, 2001, regular meeting  to discuss the attendance of both members and alternates and put into the bylaws a statement, which meets the requirement of the Charter.

UNFINISHED BUSINESS
Regarding the removal of CVS located at 525 Buckland Road from the sewer user list Mr. Hindson asked for clarification regarding a refund of sewer user charges.  Mr. Shaw stated there was no refund involved, the property owner did not pay the sewer user charges, therefore the property only needed to be removed from the sewer user list.

MOTION TO GO INTO EXECUTIVE SESSION TO DISCUSS PENDING CLAIMS
Before motion to adjourn was made Mr. Shaw told the authority he had hoped the Town Manager would be available to discuss the Strategic Plan.  There will be books available in September which will include the WPCA and how it fits into the strategic planning.  Mr. Carino stated he felt this was an important issue, as the authority will be getting into the development of the commercial and industrial areas of the Town, with regards to the Roadway and Utilities Improvement Program.  With the development of Buckland Road and I-291 there will be partnership development between the Town and various developers.
