PUBLIC HEARING

Chairman Hindson called the Public Hearing to order at 7:02 p.m.

For the purposes of hearing the following:

Proposed sewer user charge for the fiscal year 2001-2002
Proposed changes to the Sewer Assessment Charge
Proposed changes to the Septic Disposal Fees

Mr. Hindson read the Legal Notice of proposed sewer user charges, changes to the sewer assessment charge and changes to the septic disposal fees (Attachment A) into the record, including the following tables of charges and pro-rated changes:

There was no one from the public present to offer comments.  Mr. Hindson asked if members had questions and it was noted that the matter of user charges had previously been reviewed during a regular WPCA meeting.  Mr. Carino commented he felt the increase in charges was fair and in line with current increases.  He also stated that the increase in septic disposal fees was in line with cost of living, and there has not been an increase in this fee for 8 years.  There were no other comments or questions raised by members of the authority.

REGULAR MEETING – SPRENKEL ROOM

Mr. Hindson called the Regular Meeting to order in the Sprenkel Room at 7:20 p.m. with all the members present at the Public Hearing. Mr. Oates (alternate) arrived at 7:30 and Barry Guliano, Town Attorney arrived at 7:35.

ACCEPTANCE OF MINUTES OF PREVIOUS MEETING

                           May 1, 2001

Motion to approve the minutes of the May 1, 2001 with the condition the sentence on Page 2, under Review and Comment on “Utilities Element” – stating “It was felt that the sharing of funding should be discussed and decided upon at the time, if and when the property is to be developed”, be reviewed and changes made if necessary.

NEW BUSINESS

International Fuel Cells – 195 Governors Highway(approval to discharge non-sanitary
                                          waste water to sewer)
Mr. Shaw explained the applicant was present to obtain approval for the discharge of non-sanitary wastewater to the sewer, a permit is required from the DEP that the Town must sign off on.  The applicant explained the company is installing a reverse osmosis to the ionization system in order to expand their business base in Town.  There will be an average of 50 gallons per day discharged into the system, with a maximum of 1400 gallons.  A flow meter will be on the system, the DEP permits allows a certain amount of discharge.  No special treatment is necessary at the treatment plant.
Motion to approve the application of International Fuel Cells located at 195 Governors Highway to discharge non-sanitary wastewater into the sewer system.

Deming Hill Estates, Section 6 (approval to connect)
Karen Isherwood from Design Professionals, was present on behalf of Clark Realty, Inc. to present the application for connection to the Town sewer system of a residential subdivision, entitled Deming Hill Estates, Section 6, this is the final phase located on Deming Street.

New Business, Continued
Ms. Isherwood explained to the authority that Lots 52 & 53 would tie into an existing manhole in Deming St; Lots 35 & 45,will receive service through a private easement and to an 8” main continuing from Castlewood Dr. through Lot 46. Deeds will reflect the fact that this is a private easement.  The balance of the lots will be serviced through lines in Castlewood Dr. and Lewis Rd., approximately 1200 linear feet through open space access between Lot 61 & 62 through an existing easement to an existing manhole located in Manchester. This will also require approval from the Town of Manchester. The Town of Manchester has requested relocation of the last manhole from original plans to an area right on the town line. This final section of pipe would be strictly the responsibility of the Town of Manchester. A 10’ gravel access road will be provided, as required by the Town to allow for maintenance.  No basement service will be provided to Lots 67 & 55, there will be laundry service only.  Lot 67 has any existing lateral, installed when Phase 5 was built; the flow line invert on this lateral is too high.  Lot 55 has an area of 2.69 acres; the length of the lateral makes it impossible to achieve a 2% slope for gravity flow. Mr. Shaw asked if it could be achieved with a 1-% slope and maintain a flow of 2 ½ feet per second. Ms. Isherwood stated this had not been explored, but if made a condition of approval it would be certainly be considered.

Motion to approve the application of Clark Realty, Inc. for a residential subdivision as shown of drawing entitled “Deming Hill Estates, Open Space Subdivision – Sections 6A & 6B”, located on Deming Street, South Windsor, CT and prepared by Design Professionals, Inc., South Windsor, CT., Job # 90-514, Sheet 2/16, entitled “Compilation Plan Key Map, dated January 2001, with no revisions; “Plan and Profile”, Sheets 10, 11, and 12 of 16 dated March 16, 2001; with no revisions.  Approval is subject to the following conditions: a letter from the Town of Manchester stating their approval of the plans and their request for relocation of the manhole; review of easements, for properties that require them, by the Town Attorney; Lot 55 will have a minimum slope of 1% to assure a 2 ½ foot per second flow and subject to the technical approval of the Town of South Windsor Engineering Department.

Tobacco Valley Sanitation – 38 Ident Road (approval to connect)
Karen Isherwood from Design Professionals, Inc. was present on behalf of Tobacco Valley Sanitation seeking approval to install approximately 300 linear feet of 6” PVC pipe to tie into an existing 8” gravity flow pipe for an existing building.  This proposal is in response to the failure of an existing septic system, which services 2 bathrooms in this building.  Upon approval of this connection the existing septic system will be abandoned.

Motion to approve the application of Tobacco Valley Sanitation located at 38 Ident Road, for the replacement of a failed septic system with a sewer line which will run from the back of the building, to the left, and join an existing sewer line out to the street as shown on the map entitled “Sanitary Plan”, dated April 11, 2001, Job #97-1010, with no revisions.

57 Bourbon Street –subdivision (approval to connect)
Mr. Michael Lanza was present on behalf of himself to present the application for approval to connect Lot 71A to the Town sewer system.  Applicant would like to connect the lateral from existing house to a new home to be built.  Maintenance of this line will be the responsibility of both parties.  Mr. Shaw stated he was not opposed to this application, the line will have a 2% slope, and he felt the additional flow would help with the 8” line.
Motion to approve the application of Michael Lanza, for property located at Lot 71A Bourbon St. for connection to the Town sewer system, as shown on Drawing #1 entitled “Special Exception-Resubdivision and Interior Lot Application”, dated 12-28-00, Project # 2003, with revisions dated 4-07-01, and Drawing #2, dated 12-30-00, with two (2) revisions dated 4-07-01. Approval is subject to the following conditions: proper easement drawn up and approved by the Town Attorney, and subject to the approval of the Town of South Windsor Engineering Department.

Rockville Bank – 1645 Ellington Road (approval to connect)
Mr. James Cerkanowicz, from Fuss & O’Neil was present on behalf of Rockville Bank to submit the application to connect a commercial building located at 1645 Ellington Road to the Town sewer system.  A building consisting of 2 floors of 1300 sq. feet per floor with one bathroom on each floor is being constructed.  The connection will be with a 6” PVC lateral with a 2% slope to an existing manhole.  The manhole is located on the east side of street off the paved surface.  The lot is an area consisting of 2.57 acres, 1.0 acres

will be developed. Mr. Carino asked to have the location of the property clarified, the bank is to be located at the corner of Clark St. and Deming St., the Town has not assigned an address to this location at this time.
Motion was made to approve the application of Rockville Bank for connection to the Town sewer system for property located at the corner of Clark St. and Deming St., South Windsor, CT as shown on the map entitled “Rockville Bank” by Fuss & O’Neil, Manchester, CT., dated October 2000, Project # 87546, and with sheet No. 2 entitled “Key Map”, dated 10-2000, with revision dated 5-11-01, and Sheet #3 entitled “Property Survey”, dated 10-2000, with revisions dated 3-23-01, 4-23-01 and 5-11-01, subject to the technical approval of the Town of South Windsor Engineering Department and that a connection charge to be determined be paid at the time the permit is issued.

Motion was made to return to Item C6 on the agenda by Mr. Hindson, seconded and carried unanimously.
        
23 Maple Street (sewer connection claim)
Mr. Shaw explained to the authority the property located at 23 Maple Street had a sewer lateral installed that is unacceptable to hook up.  The lateral that was provided to allow for service comes to close to the well located in the front of this property.  Two options were provided as shown on the drawing labeled Attachment B.  The homeowner has been assessed for the sewer and the lateral and this has been paid.  The problem was not discovered until the contractor was called to connect the house to the system.  Option  # 1 to tie into existing manhole, extend existing invert and install approximately 5’ of sewer pipe to a 22 degree bend and extend piping into lawn will cost $4,033.00 this includes a temporary and permanent road patch.  Option #2 would call for excavation into the road approximately 25’ downstream of manhole and install in existing 8” PVC main, approximately 25’ of pipe would be in driveway. This option would cost $3,135.00 and an additional $400.00 for repair of the driveway.  After some discussion the authority stated it was their responsibility to provide a new lateral for the homeowner. It was also felt that option #2 would be the best solution from an engineering standpoint and cost.  
Motion was made to approve the payment of $3,535. for installation of a new lateral for property located at 23 Maple Street as shown on Option #2.

651 Sullivan Avenue (approval to connect oil/water separator)
Amcell Auto presented an application for approval to connect an oil/water separator.  Mr. Shaw explained to the authority the company is installing an outside oil/water separator which is required, there is an existing connection to the sewer, but the company has decided to bring the line out the east side of the building to make a connection to existing lateral with a 2% slope, 4” PVC pipe.  This is an auto body shop with a floor drain in the building.  The oil separator is necessary to meet the requirements of the State and the Town in order to use this area as a vehicle service area. Mr. Shaw explained that part of the approval process by the State is the approval from the local Town. It will be necessary for the company to maintain an inspection log with regards to the material that is being discharged.  The line will tie in on the right of way.  Mr. Carino asked if there was a manhole at that location, Mr. Shaw stated a manhole is required at that location.  Mr. Dickinson asked if we would require a manhole regardless of the fact that it was on their property or in the right of way.  Mr. Shaw stated it would be required either way. Mr. Dickinson asked if they could bend the line to contain this on their property.  If it was on their property the Town would require an easement for the purposes of gaining access to the line for monitoring purposes.  Mr. Dickinson stated he would prefer the connection be made on the business property.
Motion to approve the application of Amcell Autobody, Inc. located at 651 Sullivan Avenue, South Windsor, CT as shown on drawing prepared by Environmental Services, Inc., South Windsor, CT., entitled “Layout of Proposed Oil/Water Separator”, dated 4-17-01, Job # 1096-2, Sheet 2 of 3 with no revisions; subject to the following conditions – the 2 laterals joined in the right of way have the appropriate manhole and subject to the technical approval of the Town of South Windsor Engineering Department.

735 John Fitch Blvd. (sewer user charge refund)
Mr. Shaw explained that a permit was issued in 1969 for property located at 735 John Fitch Blvd., for connection to the Town sewerage system. At some point it became apparent the wrong street number was recorded on this permit, it should have been listed as # 729 not 735.  The permit for 735 was not taken out off the permit file and this address was being billed for sewer user charges. Tests were performed by the Town Sewer Department and it was determined this property was never hooked to the sewer

Mr. Moniz is checking his records; as far back as he can (1992) to determine the amount of refund owed to the owner of the property.  The current owner has owned the property since 1984 and the refund will be based on this date.  Mr. Shaw stated that we are in the process of obtaining a correct figure for reimbursement to the property owner. Mr. Carino suggested a recommendation be obtained from the Town Attorney as how to approach this claim.  It will also be necessary to obtain a specific figure to be refunded.
Motion was made to table Item C8 – 735 John Fitch Blvd. – sewer user refund until more information can be obtained for the next meeting.

CVS – 525 Buckland Road (removal from sewer user list)
Mr. Shaw explained that last year the property at 525 Buckland Road was to be removed from the sewer user list due to the fact this property is served by the same water company as the shopping center and the property would be billed twice.  When the billing went out this year this property appeared on the user list again. This bill was done in error and should be removed.  Mr. Shaw did not know if CVS has paid this bill, if they have a refund will be necessary.  The property must be removed from the user list at this time.
Motion was made to remove CVS – 525 Buckland Road from the sewer user list.

Set Rates of FY 2001/2002-Sewer User Charges, Sewer Assessments, Septic Disposal Fees
The authority felt that no further discussion was needed on the new rate schedule, as it was presented at the Public Hearing and read into the record at that time.
Motion was made to accept the sewer user charges, sewer assessment charges and septic disposal fees for FY 2001/2002 as presented.

Set Date and Time for July 2001 Regular Meeting
Mr. Shaw explained that a date for July is not set when the calendar is released at the beginning of the year; a meeting is scheduled if there are items to be discussed.  If there is no business the meeting will be cancelled.  After some discussion it was decided Tuesday, July 31, 2001 would be the acceptable date.
Motion was made to set July 31, 2001 as the next regular meeting of the WPCA.

COMMUNICATIONS AND REPORTS
Mr. Oates had a concern regarding the handling of the alternate members of the authority.  His first concern was regarding the policy for an alternate showing up and the second for the procedure to notify alternates when they are needed for a meeting.  Mr. Oates noted that there was a meeting that did not have a quorum and he had received no call as to the need for him to attend.  Discussion followed regarding the need for the alternates to be notified when their presence is needed for a meeting.  It is the responsibility of the member to notify the office and also to make arrangements for an alternate to be present if they are unable to attend a meeting.
A sub committee is being formed to study the attendance issue with all the commissions
and a report will be made at that time. It was agreed that this issue would be discussed further when the report is made available.

WHEREAS, the property owner of 45 Good Hill Road incurred costs to repair a sewer line within the roadway serving said property; and

Resolution, Continued

WHEREAS, Section 98-123 of the Town Code of Ordinances provides that the owner is required to bear the cost of a sewer lateral, defined as a pipe laid incidental to the original construction of a main sewer and extending to a point at the side of the street; and

WHEREAS; the Town ordinarily bears the cost of repairs to the main sewer line; and

WHEREAS; it is not entirely clear whether the broken pipe was a lateral as defined by
Section 98-123 of the Town Code of Ordinances or part of the main sewer line.

NOW, THEREFORE, BE IT RESOLVED that the South Windsor Water Pollution Control Authority hereby agrees to settle the disputed claim by sharing equally with the property owner, the expense of the sewer line repair, which totaled $6452.72, thereby authorizing the expenditure of $3226.36 in Town funds for this purpose, upon the condition that the property owner provides an executed Release of claim to the Town in a form which is satisfactory to the Town Attorney.
