CALL TO ORDER

Chairman Hindson called the meeting to order at 7:30 p.m.

ACCEPTANCE OF MINUTES OF PREVIOUS MEETINGS

January 2, 2001 and January 9, 2001 (Special Meeting)

Mr. Carino asked to have the minutes of January 2, 2001 amended to show the following changes:
The top of page 4 under New Business, 6 Evans Crossing – should read “that
approval was obtained from the commissioners that were contacted by Mr. Carino and at this time a formal motion to approve is being made.”
Page 4, Strawberry Fields – Conceptual Approval, line fourteen (14) should
reflect the following change “followed regarding running the line north on
Sullivan Avenue”, it was previously stated the direction was south.

Motion to approve the January 2, 2001 as amended and January 9, 2001 minutes

               The motion was carried unanimously.

Due to the fact Mr. Dickinson had not arrived it was suggested the following items be reviewed Item D, E, F, H – there was no new business in any of these items.

Mr. Dickinson arrived and approval of the previous minutes was granted as stated above.

NEW BUSINESS

Carla’s Pasta – Connecticut Avenue – Approval to Connect
Sergio Squatrito was present on behalf of Carla’s Pasta to present the application for a sewer connection of a commercial building located on Connecticut Avenue.  The property involves a manufacturer of fresh pasta, in a building of approximately 42,000 square feet.  Connection will be made through a grease oil separator.  The flow is estimated to be approximately 35,000 gallons per day and will require a D.E.P. permit.
It is estimated there could be a small amount of starch that will get beyond the separator and a surcharge will be assessed if that is the case.  The state will require monitoring be done to determine the strength of the wastewater discharge.  The area covering 5.93 acres will be subject to the connection charge in the amount of $14,825.  A special surcharge would be charged if the BOD is higher than the limit set in the WPCA regulations.  There is an 8” pipe into the grease separator with an 8” lateral from the grease separator to the 10” main line in Connecticut Avenue(which will be renamed Talbot Lane).

Motion to approve the application of Suri Realty, L.L.C. representing Carla’s Pasta for connection to the sewer of a commercial building located on Connecticut Avenue(to be renamed Talbot Lane) in accordance with Drawing  entitled “Site Development Plan for Carla’s Pasta, prepared by Messier & Associates, Inc., Manchester, CT., Job No. 00-158, dated 11/00, with revisions dated 11-13-00, 11-27-00, 11-30-00, 12-12-00, 12-15-00 and Drawing 5, dated 11-00, with revisions dated 11-27-00, 11-30-00, 12-12-00, 12-15-00 for an area covering 5.93 acres and subject to a connection charge in the amount of $14,825.
Also the following conditions apply: approval from the State of Connecticut Department of Environmental Protection for a discharge permit, monitoring of discharge to determine the surcharge to be assessed if BOD exceeds the limit set by the WPCA, an 8” line into the grease separator with an 8” lateral from the grease separator to the 10” main line located on Connecticut Avenue, also subject to technical approval of the Town of South Windsor Engineering Department.

1 Kasheta Lane – Approval to Connect
Galen Semprebon, P.E. from Design Professionals was present on behalf of Edward and Susan Kasheta to present the application for connection to the Town sewer for a private residence to be built at 1 Kasheta Lane. The site was originally approved by the Town staff for a pump station entering existing manhole on Gorski Dr., this allowed the construction to begin.  The homeowner is now before the Authority to ask for permission to connect with a gravity sewer line with a 1.3% slope with clean outs located at 100 foot intervals to the Town sewer line.

NEW BUSINESS, Continued – 1 Kasheta Drive

Discussion followed pertaining to the slope, location and number of clean outs for this connection.  Mr. Shaw stated there was no problem in having a slope of 1.3% with a gravity feed.  The clean outs are located at 100 foot intervals.  Mr. Carino stated concern for the third clean out located in the middle of the road, he felt it should be located along the side of the street.  The owner will also be responsible for the lateral located on Town property.
Motion to approve the application of Edward and Susan Kasheta for connection to the Town sewer for a single family residence located at 1 Kasheta Lane in accordance with Drawing entitled “Zoning Location Map”, Prepared by Design Professionals, Inc., South Windsor, CT, Job No. 1397, Dated 10-23-00, with revisions dated 11-22-00, 12-04-00, 12-05-00, 1-18-01, with the following conditions: the third clean out located in the middle of the road be moved to the side of the road, the property owner is fully responsible for the maintenance of the lateral located on Town property to the manhole, and the system will be gravity fed with a 1.3% slope, subject to the technical approval of the Town of South Windsor Engineering Department.

UNFINISHED BUSINESS – 350 and 364 Abbe Road Extension

Mr. Shaw distributed a Memorandum written by the Town Attorney pertaining to the issue regarding collateral estoppel (See Attachment A), and also a motion to clarify for the record that the Town does not have any liability pertaining to the two easements in question, this motion was read into the minutes by Mr. Carino, the motion is as follows:

MOTION TO RESCIND RESOLUTION OF JUNE 16, 1981 RGARDING PROPERTIES AT 350 AND 364 ABBE ROAD EXTENSION TO CLARIFY RECORD

Unfinished Business, continued 350 – 364 Abbe Road Extension

WHEREAS, at a meeting on June 16, 1981, the Water Pollution Control Authority passed a motion that proposed sewer line easements pertaining to 350 and 364 Abbe Road Extension be amended to further define the meaning of “present conditions” and to specifically grant trim rights, stating that said easement would be acceptable to the Sewer Commission upon being redrafted and executed by the parties; and

WHEREAS, in passing the above motion, the Authority specifically rejected the two sewer line easement documents drafted by the property owners prior to that meeting, withdrawing both the motion and the second pertaining to those easements and replacing it with the motion noted above; and

WHEREAS, two months after the Authority meeting of June 16, 1981, the original sewer line easements were recorded on the South Windsor Land Records without any amendments having been made as required by the motion of the Authority; and

WHEREAS, no evidence has been produced or discovered as to who caused the easements to be recorded or the reason for having them recorded; and

WHEREAS, the failure of the property owners to meet the conditions stated in the motion for nearly twenty years renders said Resolution void, in the opinion of the Town Attorney, because the motion contained the implicit requirement that the conditions be met in a reasonable amount of time, which has not been done; and

WHEREAS, although the Town Attorney has given opinion that the 1981 Resolution is void, he has also suggested that the Authority move to rescind the original motion to clear up the record and clarify that no sewer line easements exist or ever existed.

NOW, THEREFORE, I HEREBY MOVE that the motion adopted by the Authority at its meeting of June 16, 1981 pertaining to the proposed sewer line easements for 350 and 364 Abbe Road Extension is hereby rescinded to make the record clear that said motion is currently void and the conditions stated in the motion can no longer be met or satisfied.

NEW BUSINESS, Continued – Proposed Pollution Control Budget (FY 2001/2002)

Mr. Shaw reviewed the proposed pollution control budget for the FY 2001/2002 (See Attachment B). A 1.9% increase is proposed for the FY 2001/2002 budget. Discussion followed regarding the Capital Improvements that will be necessary in the next fiscal year, and additional costs for the Clark Street pump station in the amount of $235,000.  Mr. Shaw explained why the additional cost has become necessary for the Clark Street pump station.

Motion was made to add Appropriation of Funds for Facility Plan Study to the agenda under New Business – Item C4

New Business – Appropriation of Funds for Facility Plan Study

Mr. Shaw explained to the Authority the need for an appropriation in the amount of $240,000 from the Sewer Reserve Fund Balance to conduct a Facility Plan Study.  This undertaking involves the plant, the disinfection system and the collection system, this is done approximately 5 to 7 years before the capacity of the plant is reached.  We are not at this point now, however certain events have occurred and Mr. Shaw feels it is time to pursue the facility plant up grade. Discussion followed making reference to the Comparison of Alternatives (Exhibit C) that was sent to the Authority with the agenda.  It was found that combining the nitrogen removal plan along with the facility plan the State would fund the full amount of the nitrogen removal plan (up to 30%), the plant is also subject to grant funding for 20%.  There are also long term loans available with an interest rate of 2% and a term of 20 years. Mr. Shaw feels this is the appropriate time to apply for grant funding for the above projects, as the availability and competition for these funds will increase in the future.  Discussion followed with Mr. Shaw presenting several different options for the Authority to take under consideration regarding the best way to proceed.  The Authority felt Mr. Shaw’s recommendation was excellent and the following motion was read into the minutes:

BE IT RESOLVED that the South Windsor Water Pollution Control Authority hereby approves a transfer of $240,000 from the Special Revenue – Pollution Control and Sewage Treatment Fund – Fund Balance to the Reserve for Capital; and furthermore,
approves the expenditure of such funds for the completion of a Water Pollution Control Plant and Collection System Facility Plan.
