PUBLIC HEARING – COUNCIL CHAMBERS

Bazzano read the legal into the record as it was published in the Journal Inquirer on Thursday, November 16 and Thursday, November 23, 2006.

1.      Appl 06-49P, Cummings Amendment Option A, request for zoning amendment to Section 5.8.4 to allow grocery stores less than 22,000 square feet at least 1,000 feet from any other existing grocery store in the Buckland Road Gateway Development Zone.

2.      Appl 06-50P, Cummings Amendment Option B, request for zoning amendment to section 5.8.4 to allow grocery stores less than 22,000 square feet (with no separating distance) in the Buckland Road Gateway Development Zone.

The applications referenced above were presented by Hal Cummings together but are recognized by the commission as two separate public hearings.  Banach gave a planning report on both option A and B. There were comments from the public.  Commissioners had comments and questions.

The public hearing for Appl 06-49P closed at 8:24pm.
Discussion ensued among the commission regarding differences between the two applications.
The public hearing for Appl 06-50P closed at 8:29 pm.

Chairman Kennedy called the meeting to order at 8:35p.m.

PUBLIC PARTICIPATION
NEW BUSINESS:
Discussion/Decision/Action regarding the following:

1.      Appl 06-55P, Second Home Adult Day Health Center – request for site plan approval to operate an Adult Day Health Center (approx. 12,400+ sf) in an existing building on property located at 425 Sullivan Ave., I zone
Ecaterina Cotoiu, Program Director of Second Home ADHC, Inc. presented the application.  Banach had staff comments.  Commissioners had questions and comments.
Evans made a motion to approve Appl 06-55P, Second Home Adult Day Health Center.  Bazzano seconded the motion.  The motion carried and the vote was unanimous.
2.      Appl 06-42P, Evergreen Walk, LLC, request for zoning amendment to Section 5.8 to add multi-family residential use as a Special Exception use under certain conditions in the Buckland Road Gateway Development Zone.
Discussion ensued among the commission regarding Appl 06-42P, Evergreen Walk, LLC.
Bazzano made a motion to deny Appl 06-42P, Evergreen Walk, LLC, request for zoning amendment.  Sullivan seconded the motion.  The motion carried 6 to 1.  The votes were as follows:  Kennedy, Evans, Choate, Pacekonis, Sullivan and Bazzano were in favor of the denial, Slicer was opposed.
BONDS: Callings/Reductions/Settings

IWA/CC Bond

Appl 03-21P, ECHN – Choate made a motion to release the $20,000 Erosion/Sedimentation bond.  Pacekonis seconded the motion.  The motion carried and the vote was unanimous.
