DEMOLITION DELAY COMMITTEE MINUTES
PUBLIC HEARING, 89 Sullivan Avenue
April 30, 2015
1.~~~~ Call Meeting to Order:
Chairperson Art Utay called the Public hearing to order at 7:30 pm.  The proceedings were recorded and tapes are available at the town hall.

2.~~~~~Roll Call:  
  • Members present: Wayne McKinney,  Art Utay, Viney Wilson and Walter FitzPatrick.
  • Members absent: None.
3.~~~~ Reading of Legal Notice:
  • Chairperson Art Utay read the notice for 89 Sullivan Ave. published in the Journal Inquirer on March 13, 2015.
4.~~~~ Application Presentation:
  • Attorney Wayne Gerlt for the client, Scannel Properties, stated he did not believe the five structures to be significant.  Three maps were presented, one from 1946 and one form 1956, as well as a 1931 property map which establish the structures to be older than 75 years.  Most of the structures were stated, by Environmental Services, the client’s demolition contractor, to be in poor condition and ready to be condemned by the Building Official.  The client’s historian reported that no historical structure remains for these various outbuildings.
5.~~~~ Public Comments in favor of the Application:
  • None
6.~~~~ Public Comments Opposed to Demolition or in Favor of Delay:
  • Mr. Gary Pitcock, 87 Long Hill Rd., submitted a letter dated March 13, 2015 requesting a delay.  He stated that he was not informed regarding this Public Hearing and could not find an agenda confirming this meeting on the town web site as of April 29, 2015.  He read his referenced letter.
7.~~~~ HDC Member Questions:
  • Chairman Utay pointed out that the Notification of Demolition signs were to remain posted until the permit was issued, but were removed.  He asked if the client’s representatives were aware.  They were aware, but stated they not responsible for the removal.
8.~~~~ Adjournment
  • Chairperson Art Utay announced adjournment at 7:55 PM.

April 30, 2015

1.~~~~ Call Meeting to Order:
Chairperson Art Utay called the Public hearing to order at 8:00 PM.  The proceedings were recorded and tapes are available at the town hall.

2.~~~~~Roll Call:  
  • Members present: Wayne McKinney,  Art Utay, Viney Wilson and Walter FitzPatrick.
  • Members absent: None.
3.~~~~ Reading of Legal Notice:
  • Chairperson Art Utay read the notice for 211 Sullivan Ave. published in the Journal Inquirer on March 13, 2015.
4.~~~~ Application Presentation:
  • Attorney Wayne Gerlt for the client, Scannel Properties, stated he did not believe the 211 Sullivan Ave. structures to be significant.  Three maps were presented, on from 1946 and one form 1956, as well as a 1931 property map which establish the structures to be older than 75 years.  An affidavit from previous owner, Mr. David Patria, was presented stating that he remodeled the interior of the house including windows, baseboard, and removal of plaster walls.  An affidavit from Environmental Services, Mr. Jonathon Fitzsimmons – Health and Safety Officer, confirmed the previous owner’s statement and pointed out that the original doors were also replaced.  The client’s historical consultant’s report, from Mr. David Holmes stated that following alterations, no historical materials remained in this structure.
Atty Gerlt and Scannel Project Manager, Mr. Don Tuttle discussed the status with CT-SHPO.  Dr. Banks, UCONN, performs archeological surveys during the excavation process at all three of the Sullivan Avenue Scannel sites.  To date they have uncovered a bottle and the foundation of the O’Brien house.

5.~~~~ Public Comments in favor of the Application:
  • None
6.~~~~ Public Comments Opposed to Demolition or in Favor of Delay:
  • Mrs. Virginia Macro, 1828 Main St. opposed the demolition until a construction date was established by title search and/or additional records search.
  • Mr. Gary Pitcock, 87 Long Hill Rd., stated that his letter was based on the 211 Sullivan Ave. property being listed in the SW Historic Resources Survey.  He also favorably explained David Holmes qualifications.
7.~~~~ HDC Member Questions:
  • HDC members questioned the SHPO process and the efforts made to determine the exact construction date for the house structure.
8.~~~~ Adjournment:
  • Chairperson Art Utay announced adjournment at 8:31 PM.
9.     Administration:
  • Chairperson Art Utay announced that DDC must schedule a meeting to decide on the two Scannel applications as soon as possible.  He asked each member to independently inspect the properties and assess their determination regarding significance.  He indicated that an electronic ballot might be taken in order to meet both the 15-day and overall schedule requirements.
