TOWN COUNCIL – Regular Meeting
Council Chambers – South Windsor Town Hall

1.      Call Meeting to Order

Mayor Delnicki called the Regular Meeting to order at 8:00 p.m.

4.      Roll Call

Members Present:        Mayor Thomas Delnicki

        Councillor Cindy Beaulieu
        Councillor Edward Havens
        Councillor Kevin McCann
        Councillor Cary Prague
        Councillor Janice Snyder
        Councillor Keith Yagaloff

Also Present:           Matthew B. Galligan, Town Manager

5.      Public Input

Mr. Don Gonalves, 40 Bayberry Trail came before the Town Council and stated he has a few comments regarding the pension, 1) The Town has not contributed the amount that is required to be funded each year; 2) There are two discount rates and he would like to know which discount rate the Town Council is talking about using.  If a high discount rate is used the present liabilities are low and if using a low discount rate the liabilities are high.  Has the Council gotten into the discount rate for present value of the liability?; and 3)  The Town has one of the richest 401K plans in the United States.

Chief Kevin Cooney of the Fire Department came forward and thanked Deputy Mayor Gary Bazzano for his service on the Town Council.  Chief Cooney informed the Council that the Oktoberfest is being held Sunday, October 27, 2013 from 2:00 p.m. at Maneeley’s.  The two honorees are Bruce Maneeley and Kevin Cooney.  The cost is $25.00 per person and all of the proceeds go towards the parade in Hartford.

5.      Public Input

Ms. Elizabeth Pendleton, 319 Hilton Drive stated that as a past Town Council member and Council candidate she understands what it takes to do the job of a Councillor.  Ms. Pendleton thanked the Council for their time, energy, dedication and all of the effort that each member has put towards the Town for the last two years.  

6.      Environmental Health & Safety Message

Councillor McCann informed the Council and public that October is Breast Cancer Awareness Month.  The biggest misconception is that many think that the main risk factor is that breast cancer is hereditary.  It is very important to pay attention to your bodies, talk with your doctor and be examined.

Mayor Delnicki requested people to not text and drive.  This can change a persons life in an instant.

7.      Adoption of Minutes

BE IT RESOLVED that the South Windsor Town Council approves the Minutes of the following Town Council Meetings:  Work Session Minutes of October 7, 2013; Special Meeting Minutes of October 15, 2013; and Regular Meeting Minutes of October 7, 2013.

Deputy Mayor Bazzano made a motion to Suspend the Rules in order to go to Item 15. A.  Councillor McCann seconded the motion; and it was approved, unanimously.

15.     Passage of Ordinance

A.      Resolution Adopting an Ordinance Authorizing the Acquisition of Open Space

BE IT RESOLVED that the South Windsor Town Council hereby adopts an Ordinance Authorizing the Acquisition of Open Space, as shown in attached, Exhibit A, a copy of which is on file in the Office of the Town Clerk.

Answering questions from the Council, Mr. Galligan explained that this Ordinance pertains to 491 King Street property that the Town Council had a public hearing on.  This Ordinance will be amended in the future as the Town acquires more properties.

Councillor McCann stated that tonight we have an amended Ordinance that added a second property at 559 Avery Street, will the Council be voting on the Ordinance or the Amended Ordinance?  Mayor Delnicki explained that the Town Council will be voting on the King Street property and then later in the meeting will deal with setting another public hearing for 559 Avery Street.

Mr. Galligan stated he would find out what the balance is for funds used to purchase the open space.  Councillor Havens felt that the Town Council should continue to monitor the balance and when it runs low another referendum should be held on open space property.

Mayor Delnicki called for a vote on the motion; it was approved, unanimously.

14.     New Business

A.      Resolution Authorizing the Town Manager to Refer Proposed Acquisition of Property Identified as 491 King Street, South Windsor, Connecticut to the South Windsor Planning & Zoning Commission

WHEREAS, according to State Statute 8-24, the acquisition of property is to be referred to South Windsor’s Planning & Zoning Commission prior to the execution of an agreement

NOW, THEREFORE, BE IT RESOLVED that the South Windsor Town Council hereby authorizes Town Manager, Matthew B. Galligan to refer the purchase of 491 King Street, South Windsor, Connecticut to the Planning & Zoning Commission pursuant to Section 8-24 of the Connecticut General Statutes.

Answering questions from the Council, Mr. Galligan stated that the price for the property is $135,000 as well as related costs as shown in attached Exhibit B.  The deal began at $400,000 but after the Town did an appraisal and the appraisal came out to be $135,000.  The Open Space Task Force reviewed the proposal and highly recommended purchasing it.

The piece of land consists of approximately 11-12 acres and has a pond that can be used for passive recreational purposes.  Do not see any complications with the Planning & Zoning Commission.  There is a stone based road going into the property.  It is not a road that cars should use but emergency vehicles can get in there.

Councillor Anwar felt that the amount of due diligence the Town has taken for this property has worked out well, the price is fair.

Mayor Delnicki stated that he feels that this property offers a lot of opportunities for passive recreation and a nice park.

Mayor Delnicki called for a vote on the motion; it was approved, unanimously.

B.      Resolution Authorizing Setting a Time and Place for a Public Hearing to Receive Citizen Input on an Amendment to an Ordinance Authorizing the Acquisition of Open Space

BE IT RESOLVED that the South Windsor Town Council hereby sets Monday, November 18, 2013, at 7:15 p.m., in the Council Chambers of the South Windsor Town Hall, 1540 Sullivan Avenue, South Windsor, Connecticut as the time and place for Public Hearing to receive citizen input on an Amendment to an Ordinance Authorizing the Acquisition of Open Space, a copy of which is on file in the Office of the Town Clerk.

Mr. Galligan explained that this is another farm (Jones property) which the Town will be having an appraisal done on.  There is a house on the property that will also need to be evaluated.  The Ordinance will need to be amended, as shown in attached Exhibit C.

Mayor Delnicki called for a vote on the motion; it was approved, unanimously.

C.      Resolution Approving a Refund of Taxes to Twelve (12) South Windsor Taxpayers

BE IT RESOLVED that the South Windsor Town Council hereby approves a refund of property taxes to twelve (12) South Windsor Taxpayers, the total of said refund being $3,831.42, and as more fully described on attached Exhibit D.

16.     Communications and Reports from Town Manager

Mr. Galligan thanked Deputy Mayor Bazzano for his time on the Council.  Good luck to everyone during the election.

18.     Communications and Petitions from Council

Deputy Mayor Bazzano stated that he has learned a lot while serving on the Council.  The number one thing that he learned is that you can not please everybody.  When the public goes to vote, please look at everything that a Council member has done, not one thing they have not done.  This is about everybody doing the best they can for the community as a whole.  Deputy Mayor Bazzano thanked everyone on the Council

Councillor Yagaloff thanked Deputy Mayor Bazzano for all of his hard work and his commitment to the community.  Councillor Yagaloff also thanked Mayor Delnicki for his hard work and for representing the Council at all of the social events and his leadership on the Council.  This Council has been one of the best working Councils.  Good luck to everyone.

18.     Communications and Petitions from Council (Continued)

Councillor Havens stated that everyone has done a good job.  The election is being held on November 5th.  The election is very important for all to go out and vote.  Councillor Havens also thanked the Town Manager for a job well done.

Councillor Anwar stated that he has learned a lot from everyone on the Council.  Council members care about the future of the community.  Councillor Anwar thanked Deputy Mayor Bazzano for his service to the Town; and also thanked Mayor Delnicki for his fairness during meeting.

20.     Adjournment

At 8:46 p.m. Deputy Mayor Bazzano made a motion to adjourn the meeting. Councillor Yagaloff seconded the motion; and it was approved, unanimously.
